BYLAW - Sell Ross Street to Metrolinx - 20100713 - 520610By-law Number 5206-10
BEING A BY-LAW to declare as surplus,
close and sell Ross Street to Metrolinx.
WHEREAS on August 13, 1984, the Council of The Corporation of the Town of Aurora
enacted By-law 2702-84 to declare as surplus, close and sell the southerly portion of
the highway known as Ross Street on Plan 17, described as Part 1 on Plan 65R-4594,
which By-law was registered on title on the August 11, 1995 as Instrument No.
R663236;
AND WHEREAS the Council of The Corporation of the Town of Aurora wishes to
declare as surplus and permanently close the northerly portion of the highway known
as Ross Street on Plan 68;
AND WHEREAS the Council of The Corporation of the Town of Aurora wishes to sell
Ross Street in its entirety as laid out on Plans 17 and 68 to the adjoining owner in
accordance with the provisions of By-law 4225-01.A, being a by-law to provide
procedures with respect to the sale of municipal land;
AND WHEREAS subsection 34(1) of the Municipal Act, 2001, S.O. 2001, c. 25, as
amended, states that a by-law permanently closing a highway does not take effect until
a certified copy of the by-law is registered in the proper land registry office;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
AURORA ENACTS AS FOLLOWS:
THAT the opened northerly portion of Ross Street legally described as Ross
Street on Plan 68, except Parts 1 & 2 on Plan 65R19055 and Part of Block A,
Plan 289, designated as Parts 4 & 5 on Plan 65R2814, Town of Aurora,
Regional Municipality of York, be permanently closed and declared as surplus.
2. THAT Ross Street in its entirety as described on Schedule "A" to this By-law
be sold to Metrolinx in accordance with the terms and conditions set out in
the Offer to Purchase Agreement appended to Corporate Report CA010-
011.
3. THAT the Mayor and Town Clerk take all actions and execute all necessary
documentation in connection with the sale of Ross Street.
4. THAT the provisions of this By-law shall come into force and take effect upon
third reading and registration of a certified copy of this By-law on title in the
proper land registry office,
