Mr. John Le~laire of Lawlor, LeClaire, Hobson amd Machan, Solicitors,
appeared at the Hearing. He prov11ed authorization from the owner. ,
The Executors of the Estate were also present.
The Executrix of the Estate seeks consent to convey a parcel of land·
having an area of 16,139 !quare feet with no frontage on a public ·
road, for future residential purposes. It is proposed to convey the;
subject land to the owner of land abutting on the east, to be taken ·
into the same title and used as a parking area for residential
condominium apartments to be built on the abutting land. No frontag~
of 230 feet on the west side of Yonge Street, located approximately :
650 feet south of Aurora Heights Drive, will be used for residential
purposes. The subject land is vacant. There is an existing masonry;
dwelling located on the remaining land. '
The owner's land is designated "Urban Residential" by Development
Area 1 of the Aurora Official Plan. The Plan has not yet been
approved by the Minister. The land is zoned "A.9.20.30" -Apartment
Residential by By-law Number 1863, which requires minimum frontages
of 100 feet and a minimum lot area of 1,090 square feet per dwelling
unit. The By··law has been approved by the Municipal Board. A

municipal water supply and municipal sanitary sewers are available
to the owner's land. Yonge Street adjacent to the owner's land is
an assumed public street, being also designated as Provincial
Highway Number 11.
The Regional Health Unit has no objection to1he application from a
public health point of view as municipal sanitary sewers and 1r1ater
are available. No advice has been received that conveyance of the
subject land for future residential purposes will be detrimental
to the conservation of natural resources and flood control.
Although it has indicated other requirements, the Municipality wiShes
neither 5% of the subject land nor cash in lieu thereof, for park
purposes.
In considering the owner's proposal, the Committee had regard to
subsection 4 of section 33 of The Planning Act. In this regard, the
Committee is satisfied that the proposal conforms to the Official
Plan and the Zoning By···law and that the adjoining land as enlarged,
and the owner's remaining land will be compatible with the establish~d
pattemof development in the area. The Committee is further . '
satisfied that the shape and dimensions of the two resulting lots
are adequate and are suitable for residential purposes, and that
the conveyance is necessary in the public interest. ·
In the opinion of the Committee, a registered plan of subdivision
approved under section 33 of The Planning Act is not necessary to
ensure the proper and orderly development of the Municipali"l:;y.
It is, therefore, the decision of the Land Division Committee that
Application Number A.?6.12 be, and the same is hereby, APP.ROJE~,
upon fulfilment of the following conditions:
1. Payment of all taxes, to date, to the Town of Aurora;
2. Submission to the Secretary-Treasurer, of a fully executed deed,
in triplicate, conveying the subject land only to the owner of
the land abutting on the east, reportedly, Arcamum Holdings
Limited;
3. Submission to the Secretary-Treasurer, of three white p~ts of ·
a registered Plan of Reference of the owner's entire land, which
conforms substantially with the application as submitted;
4. Fulfilment of Conditions 1 ,2, and 3 not later than OCTO:BE;1:1_2, 1977.
NOTE: The above conditions must be fulfilled before certificate of
consent can be issued (subsection 12 of section 29 of The
Planning Act (R.S.O. 1970, c.349) as amended).
