Yonge Street adjacent to the owner's land is an assumed public street, being also designated as Provincial Highway Number 11. The Regional Health Unit has no objection to1he application from a public health point of view as municipal sanitary sewers and 1r1ater are available. No advice has been received that conveyance of the subject land for future residential purposes will be detrimental to the conservation of natural resources and flood control. Although it has indicated other requirements, the Municipality wiShes neither 5% of the subject land nor cash in lieu thereof, for park purposes. In considering the owner's proposal, the Committee had regard to subsection 4 of section 33 of The Planning Act. In this regard, the Committee is satisfied that the proposal conforms to the Official Plan and the Zoning By···law and that the adjoining land as enlarged, and the owner's remaining land will be compatible with the establish~d pattemof development in the area. The Committee is further . ' satisfied that the shape and dimensions of the two resulting lots are adequate and are suitable for residential purposes, and that the conveyance is necessary in the public interest. · In the opinion of the Committee, a registered plan of subdivision approved under section 33 of The Planning Act is not necessary to ensure the proper and orderly development of the Municipali"l:;y.
