Councillor Davis presented a report of the Planning and Development
Committee in which the Committee respectfully submitted the ·

The Planning and Development Committee held a meeting on Wednesday,
October 20th. 1976 at 7:30p.m. The following were present:

Samuel Mandel, for consent to convey a parcel of land having an
area of 28,750 square feet and frontage of 130 feet, as sho~m
hatched on a sketch attached as Appendix No. 1, for commercial
purposes.

a quorum of the Land Division Committee on Tuesday, August 17, 1976.
Mr. J. M. Stitt of Stitt, Baker and McKenzie, Solicitors, appeared
at the Hearing.
The owners seek consent to convey a parcel of land having an area
of 28,750 square feet with frontage of 130 feet on the west side ·
of Yonge Street (Provincial Highway Number 11), located approximately
265 feet north of Aurora Heights Drive, for commercial purposes
(body shop and gas pump). The owners would retain a parcel of
land having an area of 28,750 square feet with frontage of 100.09
feet, for commercial purposes. There is an existing one-storey
stucco building with an underground concrete block garage located
on the subject land. The remaining land is vacant.

The owners' land is designated 11 0ommercial 11 on the Aurora Official
Plan. The Plan has not yet been appl.'Oved by the MiDist~r. The
land is zoned "C" -Commercial by By-law Number 1863, which does .
not have any minimum lot frontage ol! building side yard requirements,
but does require a rear yard of not less than 30 feet. The By-law ·
has been approved by the Municipal Board. A municipal water supply
and municipal sanitary sewers are available to the owners' land.
The Regional Health Unit has no objection to the application from
a public health point of view as municipal services are available •
The South Lake Simcoe Conservation Authority advises that the site
does not lie within the fill and construction limits for the Town
of Aurora and that it has no objections to the application. No
advice has been received that the conveyance would be detrimental
to the cqnservation of natural resources. The Municipality has
advised that it wishes neither payment of fees, nor deeding of 5%
of the subject land nor cash in lieu thereof, for park purposes.
In considering the owners' proposal, the Committee had regard to
subeection 4 of section 33 of The Planning Act. In this regard,
the Committee is satisfied that the proposal conforms to the
Official Plan and the Zouing By-law. However, the Committee is of
the opinion that the proposal would not contribute to the proper
and orderly development of the Municipality. Reportedly, the owners
desire to divide their land in half, and to retain a parcel having
frontage of 100 feet. In order to do this, a number of "jogs"
in the proposed line of severance would be necessary to accorrmodate
the existing building and underground garage. In addition, the
Committee is advised that the irregular line of severance would
provide the retained parcel with a rear lot line dimension of
140.09 feet, which would enable access to the retained land from
Aurora Heights Drive, rather than from Yonge Street. However,
the owners' land does not abut Aurora Heights Drive, and the
Committee has not been advised of any right-of-way or easement
enjoyed by the owners across the intervening land. For the

Councillor Timpson in the Chair
Councillor Timpson presented a report of Council in Committee in
which the Committee respectfully submitted the following:
A meeting of Council in Committee was held on Wednesday, October
27th. 1976 at 8:00 p.m.

Mr. J. D. Reid -Engineer.
Mr. J. Reid was present to 4is~uss his draft report on a
sanitary sewer collection system for the south west quadrant to
the Town and the Committee following discussion, directed the
Engineer to finalize his report to update his costs and to
present the report to Council for adoption as to the future
servicing cost to be shared by the various areas when
development approaches and toprepare the approvals necessary
in conjunction with the Official Plan populations of that
area, for the purposes of the Region of York and of the Ministry
of the Environment, when time comes. ·
Letter 18-18 re: Mileage and Supervisory expense of the Frisbee
Competition -August 22nd. 1976
The letter of' explanation, which was referred to the Parks
and Recreation Committee on September 21st. was discussed and
the Council in Committee would recommend that, in future, the
Parks and Recreation Committee encourage the parents of the
participating children to supervise their children at any out
of town event and would further recommend that the Parks and
Recreation Committee see that adult supervision is provided for
such competitions or events.
Report from Mr. J. D. Reid re: Pilling Easement.
Council in Committee discussed the Engineer's report and the
request of Mr. Pilling and would recommend that the Clerk
Administrator advise Mr. Pilling that the Town would not object
to him travelling across the portion of this easement but feel
that no building or structure should be lmoated within the
easement allowance.

4. Old Pc.lice Buildin~.~ Cost of Wa~erwork Changes
Council in Committee were advised by the ClerkAdmjnistrator
that he had checked this matter with the Works SUP€rintendent,
Mr. Walker, and that much of the former equipment had now been
removed and the only live watermain which passed through the
building has been lowered below a safe frost level.
5. Tour of Meadowvale
Council in Committee discussed the tour of Meadowvale and the
Markborough Properties proposal and will consider same fUrther
when the Planning and Development Committee report is submitted
to Council for action. ·
6. Water Rate By-Law
Council in Committee discussed the proposed revisions of the
Water Rate By-law and although the water rates have not been
revised since 1963, it is felt that the water rates should be
revised to the following schedules on the attachment shovm as
Schedule "A" and that the By-law should be prepared for .
consideration by Council at its' next regular meeting.
7. Church Street School ••• Rental or Leasing
Council in Committee discussed the letter from the Historical
Society expressing interest in studying the feasibility of
them operating and being responsible, for the Church Street
School Building.
8. Wellington Street East -Trees
a. The job inspector of J. D. Reid and Associates had reported
to the Clerk Administrator the possibility of three trees
being removed, which was related to Council in Committee and
their locations, at the meeting held for purpose of discussion,
and were located both by locations and pictures.
Council in Committee, in consideration of this matter, would
r€commend that the two trees in front of 105 Wellington Street
East and 88 Wellington Street East, respectively, be removed
by the Region of York as part of the road construction
contract.
b. Council in Committee would further recommend that the tree
located at 82 Wellington Street East, not be removed and that
the Engineer take all precautions to protect and maintain the
tree, as much as possible.

tyler Street Bridge
Council in Committee were advised that subsidy monies now appear
available from other projects and that the Town, in the Engineer's
estimate, might be able to spend approximately $50,000.00 prior
to the calendar year end on this construction project, which
was previously approved for subsidy purposes, in the summer of
1976 but at that time we were advised that M.T.C. did not
have available funds to commence the project.
Council in Committee directed the Engineer to finalize the
specifications and place a tender call as quickly as possible, ,
that construction might start not later than the 1st. of December,
achieving some of the construction work under the available
subsidy with the balance of the work being carried into a
1977 project. This t~p3 of project makes an excellent 'rinter
works project as it involves the creek with lower water tables,
normally at this time of year, and the Y-type culvert including
the re-building of the syphon, which is all part of the structure
and is certainly one project which is urgently in need of re··· ·
construction.
Ashton Dene Subdivision ••• Acceptance
Council in Committee were advised that the Engineer has ''Tritten
his Acceptance Report and subject to the Solicitor confirming ' ·•
the correctness of all eaeemen1sand registration, would
recommend that the acceptance of the subdivision works, as
recommended by the Engineer, and be placed under the maint.~:~ance
provided.
11. Cash-In-Li.~u Ap.r>raisals
Council in Committee were advised that the Cash-In-Lieu
Appraisal for the Elderberry Hills Mustang Development has
b~~n prepared in the amount of $38,275.00 and Council in
Committee would recommend that this amount be approved ~or
inclusion as an item within the wording of the Subdivision
Agreement. The second appraisal -The Cash In Lieu evaluation
for Machell's Corners Development by Murray Binions has been
calculated in the amount of $10,000.00 and Council in Comrnittee
would recommend that this amount be approved for inclusion as
an item within the wording of the Subdivision Agreement.
12. Employee Probation
Council in Committee were advised that employees -M. Bell and
S.Blanchard Clerks in the Treasurers' Dept. and Clerks' Dept.
respectively, have co~pleted their six months probationary
period and on the recommendation of the respective Department
Heads, be confirmed in their respective employment positions.

'13. Merkur Assessm.ent Appeal to the Supr~llle Court --,... -.
Council in Committee discussed this matter and the direction
sought by Town Solicitor, Mr. R. Thomson, and as the next
step in this procedure will involve considerable legal
expense and be very time consuming and as the Town of Aurora
position is one and the same position represented by the
Assessment Commissioner of the Region of York and represented
by the Province's Lawyer,Mr. Paul Mingay, that the Town advi~
Mr. Thomson to withdraw from further active participation
in this Appeal proceeding.
