over of the 2nd. Floor of the Church Street School and requested
Council's co-operation re Financial arrangements.

The o~er seeks consent to convey a parcel of land having an area of
0.037 acres with frontage of 14 feet on the eastside of Bathurs·t Street,
located approximately one-half mile north of Henderson Drive, for ·
residential purposes. The o~er proposes to convey the subject land,
which is triangular in shape, to the owner of the land abutting on
the south, to provide adequate driveway facilities for the abutting
property. The subject land will be taken into the same title and
no new lot will be created. A second application by the same o~er, to
convey 2.183 acres for residential purposes immediately abutting on
the north of the subject land, was heard concurrently, under Application
Number A.76.2. The 01rm.er would retain a parcel of land having an are~:~
of 191.6 acres excluding the land that is the subject of Application
Number A.76.2, with frontage of approximately 1,000 feet on the east
side of Bathur:t Street and a "Split" frontage totalling approximately·
525 feet on the west side of Yonge Street for recreational purposes
(Golf and Country Club )o The subject land is vacant. ,
There are a numberof buildings, including a clubhouse, service buildings
and storage sheds, etc. used in connection with the golf and country
club, located on the remaining land.

The owner's land is designated "Mnjor Open Space", "Rural" and
"Commercial" on the Aurora Officinl Plan. The plan has not yet been
approved by the Minister, However, the plan incorporntes elements of
the Township of King Official Plan in which Municipality the westerly
part of the owner's land was formerly situated. The subject land.
appears to be designated "Rural" on the King Official Plan. The
plan has been approved by the Minister. The land is affected by
Restricted Area By-law Number 986, as amended, of the former To1~1ship
of King which requires minimum frontages of 200 feet and minimum lot ·
areas of '15,000 square feet for separate residential lots. Neither
a municipal water system nor municipal sanitary sewers are available
to the owner's land and apparently none are contemplated in the
foreseeable future. Bathurst Street is an assumed public street being
v.lso designated as Regional Road No. 38.
In considering the owner's proposal, the Committee had regard to
subsection 4 of section 33 of The Planning Act. In this regard, the
Committee is satisfied that the proposal conforms to the Official
Plan and the Restricted Area By··lnw and that the proposed conveyance is
suitable for the intended purposes and that the conveyance is necessary
in the public interest.
Having been made aware thnt the subject land will be conveyed to the
owner of the abutting property to enlnrge thnt pro:t:erty , the Regionn;L
Henlth Department reports that following an inspection of the propert~,
it has no objection to the conveyance from a public health point oftVJ.ew.
It is noted tTh~t Bathu~st ·Street is a regional road and the regional
municipality has requested a 20 foot widening across the frontage of
the subject land. Comments by the South Lnke Simcoe Conservation
Authority appear to be related only to Application Number A.76.2,
heard concurrently. The Municipality has advised that amoung other
matters, it wishes payment of n park levy equal to 5% of the vnlue
o~ the subject land. However, the subject land appears to hove
nqm~nal value, it being conveyed more to settle an existing boUl,dary
dispute and provide title to a driveway presently being used by the
abutting owner.
It is, therefore, the decision of the Land Division Committee that ·
Application Number A.76.3 be, and the same is hereby, APPROVED, "llpon
fulfilment of the following conditions:
'1. Payment of all taxes, to date, to the Town of Aurora;
2. Conveyance of a strip of land, by deed, 20 feet in width, across
the Regional Road No. 38 frontage of the subject land, to The
Regional Municipality of York, without cost, and free of encumbra~ces,
said widenLng being more particularly shown on a sketch attached
to a letter by the Regional Engineering Department dated March
29th. '1976;
3. Submission to the Secretetry··Treasurer, of a fully executed deed, in
triplicate, conveying the subject la.nd only to the owner of the

The owner seeks consent to convey a parcel o£ land having an area
of 2.183 acres with frontage of 309 feet on the east side of
Bathur$Street, located approximately one-hal£ mile north of
Henderson Drive, for residential purposes. The owner would retain
a parcel of land having an area of 191.6 acres with frontage of
approximately 1,000 feet on the east side of Bathurst Street and a
"Split" frontage totalling approximately 525 feet on the west side of:
Yonge Street for recreational purposes (Golf and Country Club).
There is an existing one-storey brick dwelling located on the
subject land. There are a number of buildings, including a club
house, service buildings and storage sheds, etc. used in connection
with the golf and country club, located on the remaining land.
The owner's land is designated "Major Open Space", "Rural" and
"Commercial" on the Aurora O£ficial Plan. The plan has not yet been
approved by the Minister. However, the plan incorporates elements of

the established pattern of development in the area. The Committee
is further satisfied that the shape and dimensions of the subject land
are adequate and that the lot is suitable for residential purposes and
that the conveyance is necessary in the public interest.
Having been made aware that the subject land will be serviced by a pr~vate
water well and private septic tank and tile field system, the Regional
Health Unit reports that following an inspection of the property, it 4as
no objection to the conveyance from a public health point of view. It
is noted that Bathurst Street is a regional road and the regional
municipality has requested a widening having a width of 20 feet at the,
south limit of the subject land, a width of 50 feet at a point located
approximately opposite the dwelling, and a width of 35 feet at the north
limit of the subject land. The South Lake Simcoe Conservation Authority

advises that the south-easterly portion of the subject land lies within
the Fill and Construction Limits for the Town of Aurora, although the
existing dwelling, itself, does not lie within the limits. The
Authority suggests that if any new development is proposed on the
subject land within the Fill and Construction Limits, a prelirrdU1ary
engineering report describing the extent of flooding which would occur
on the site as a result of a regional storm should be prepared for
its examination.
In the opinion of the Committee, a plan of subdivision approved U21der
section 33 of The Planning Act·is not necessary to ensure the proper
and orderly development of the Municipality. The Committee is f~ther
of the opinion that conveyance of the subject land as a separate
residential lot will not overtax existing school facilities. The
Municipality has advised that among other matters it wishes payment
of a park levy equal to 5% of the value of the subject land.
It is, therefore, the decision of the Land Division Committee that
Application Number A.76.2 be, and the same is hereby, APPROVED, upon
fulfilment of the following conditions:

The owner seeks consent to convey a parcel of land having an area of 38,280
square feet with frontage of 132 feet on the north side of Kennedy
Street West, located approximately 1 mile west of Yonge Street, for
residential purposes. The owner would retain a parcel of land having
an area of 65,340 square feet with frontage of 112 feet, for residential
purposes. There is an existing dwelling located on the subject la:nd."
The remaining land is vacant. ·
The owners. land is designated "Rural" on the Official Plan for the
former Township of King Planning Area which requires a minimum lot area
of approximately 2 acres. The plan has been approved by the Minister.
An Official Plan proposed by the Town of Aurora also designates the land
as "Rural" with similar provisions as in the King Official Plan. The
land is affected by By-law Number 986 of the former Township of Iring,
a general land use By-la1.r which requires, in the case of the subject
land, a minimum frontage of '100 feet and a minimum lot area of 15,000
square feet and in the case of the remainder, a minimum frontage of
150 feet and a minimum lot area of '1 acre. The By-law has been
approved by the Ontario Municipal Board. A municipal water supply is
available to the mmer' s land, but sewage disposal is by means of
private septic tank and tile field systems. Reportedly, Kennedy Street
West is of substandard construction and width. ·
In considering the owner's proposal, the Committee had regard to
subsection 4 of section 33 of The Planning Act. In this regard, the
Committee is of the opinion that the proposal does not conform to the
Official Plan since neither the subject or remaining lands would
meet the area requirements. In addition, the remaining land would
not conform to the provisions of the By--law in respect to minimum
frontage.
The Committee is of the view that the general area in which the ovn1er's
land is situate, will be developed by means of one or more registerd
plans of subdivision on a fully serviced urban basis, in the foreseeable
future. An amendment to the Official Plan will be required at that
time, to facilitate such development. The Committee concludes that
further development of the general area should await the preparation
of secondary planning and the necessary amendments to the Official
Plan and the Zoning By--law. In the opinion of the Committee, further
development of the owner's land prior to that time, is, at best,
premature.
It is, therefore, the decision of the Land Division Committee that
Application Number A.75.6 be, and the same is hereby, REFUSED.

The Committee recommends that a letter be sent to Mr. Blizzard
acknowledging his letter and pointing out the following facts.

1. The traffic lights '"ere placed at Yonge Street and Dunning
Avenue as the result of the usage of aaid intersection by
school buses plus the fact that several accidents had occured
involving personal injuries to pedestrians -sometimes sever~.
2. Dunning Avenue prior to the development of Edward Street (opp--
osite Murray Dr.) was the main truck route for the industrial
area on Edward Street.
3. The town is presently considering the installation of traffic
lights at Brookland Avenue and Yonge Street as further
development occurs on the vacant lands in that Planr.ing area.

5. Letter 15-118 -re: fire~rotection in Wycliffe Estates
The Committee recommends that an opinion be obtained from the
Town Solicitor regarding the use of a neighbouring swimming pool's
water for fire fighting in this area.
6. Letter 15-16 _ _--Fire Eguipm~Maintenance
The Committee recommends that the Fire Chief be authorized to take
the Fire Vehicles to a specialized big vehicle service station fo~
preventative maintenance at least twice a year. It is further ·
~ecommended that Mr. Bruce Hill continue to perform minor se~vice
functions on these vehicles. The Committee also recommends that Mr.
~ill Walker, Town Superintendent, be requested to investigate the
p~~chase of a heavy duty hydraulic hoist so that more efficient
service for the vehicles can be obtained.
7. By-law #2091-76 ~-Bicxcles on Sidewalks

The Committee recommends that third reading of this By-law be .
' postponed until the follm'ling proposed and suggested programmes otixn
be put into operation and evaluated.
1. The Committee understands that the Recreation Department is
planning to sponsor bicycle safety rodeos each spring, startillg
in the spring of 1977. It is understood that a rodeo is being
planned by the Rotary Club for this fall. ·
2. The Committee recommends that the provisions of the Highway
Traffic Act as they apply to bicycles be enforced by the police
department.
3. The Committee recommends that the Police Department be requested
and instructed to stop bicyclists who recklessly operate bicycles
on the sidewalks and point out to such persons the error of
their ways.

8. New Fire Pumper
It is now almost a full two years since this vehicle was ordered
from Thibault Fire Trucks Limited. The Committee recommends that
a complaint be laid with the Federal Department of Consumer Affairs
pointing out the false advertising by Thibault stressing fast
delivery from stock contained in the Fire Fighting in Canada
edition of July 1976.
It is further recommended that the Federal Department of Consumer
Affairs be asked to determine the reasons why delivery of this
vehicle has not occurred.
The Committee further recommends that the Town Solicitor investigate
the grounds on which a legal suit for non-delivery and non··
performance of a legal contract could be launched in the courts, and
that a letter be sent to Thibault indicating th•t such leg~l
fi\Ction is being considered. The Committee also recommends a letter
be sent to l"!r. Sincl::tir Stevens M.P. requesting him to follovl up
these matters where the Federal Government is r:sked for
assistance.
