Mr. Donald H. Glass, agent for the owner, appeared at the Hearing.
Mr. Peter Sheridan, President of Southern Charter, was also present.
The owner seeks consent to convey a parcel of land having an area ·
of 7,200 square feet with frontage of 70.48 feet on the south side
of Mosley Street, located approximately 137 feet east of Yonge
Street, for commercial purposes. The owner would retain a parcel.
of land having an area of 21,500 square feet with frontage of 31 ,
feet on Mosley Street and flankage of 51 feet on the east side of:
Yonge Street, located 29.87 feet south of Mosley Street, for commer-
cial purposes. There is an existing two-storey brick dwelling
located on the subject land. There is an existing concrete bloc~
garage located on the remaining land. There is a frame storage
shed located partly on the subject land and remaining land, which
is to be removed if the application is approved.
Subsequently, after it was noted that the minimum rear yard
requirement for the dwelling on the subject land is 30 feet, the
C~mmittee agreed to allow an amendment to the application ;r.ithout
further notice, to provide a rear yard of not less than 30 feet.

The owner's land is designated "Commercial" on the Aurora Officia+
Plan. The Plan has been approved by the Minister. The land is
zoned "C" -Commercial by By--law Number 1863, which does not have·
any minimum lot frontage of building sideyard requirements, but
does require a rear yard of not less than 30 feet. The By--1m·;
has been approved by the Municipal Board. A municipal water supp:j.y
and municipal sanitary sewers are available to the owner's land. '
Reportedly, Mosley Street is an assumed public street.
In considering the owner's proposal, as amended, the Committee had
regard to subsection 4 of section 33 of The Planning Act. In this
regard, the Committee is satisfied that the proposal as amended
conforms to the Official Plan and the Zoning By-law and that the
resulting lots will be compatible with the established pattern
of development in the area. The Committee is further satisfied
that the shape and dimensions of the two lots that will result are
adequate and are suitable for the intended commercial uses and that
the conveyance is necessary in the public interest. ·
Having been made a11rare that the subject land is serviced by a
municipal water system and municipal sanitary sewers, the Regional
Health Unit has no objection to the conveyance from a public health
pcint of view. The South Lake Simcoe Conservation Authority
advises that the site does n~lie within the Flood Line Limits
for the Town of Aurora and that the Authority has no objection to
the application.
In the opinion of the Committee, a plan of subdivision approved
under section 33 of The Planning Act is not necessary to ensure
the proper and orderly development of the Municipality. Although
it has indicated other requirements, the Municipality wishes neither
5".4 of the subject land no cash in lieu thereof, for park purposes.
It is, therefore, the decision of the Land Division Committee that
Application Number A.76.4 be, and the same is hereby, APPROVED, '
upon fulfilment of the following conditions:
1. Payment of all taxes, to date, to the Town of Aurora;
2. Execution of an agreement between the Municipality and the o~er
with regard to such matters as are deemed necessary by the
Municipality, and including the following:
a) Provision of a parking area as per zoning By-law requirements
for the intended use of the two-storey dwelling.
b) Provision of a legible survey at a scale that can be
easily vie11red, to determine if the building complies vrith ·
the zoning by-law in relation to yard requirements.

c) The cleaning up of the owner's land, removal of all debris,
and maintenance of the property in a neat and tidy manner;
3. Submission to the Secretary-Treasurer, of written advice from.
the Municipality that the existing frame storage garage
stradling the proposed line of severance has been demolished
and all debris removed to the satisfaction of the Municipality;
4. Submission to the Secretary-Treasurer, of a fully executed
deed, in triplicate, conveying the subject land as amended;
5. Submission to the Secretary-Treasurer, of three white prints
of a registered Plan of Reference of the owner's entire land,
which conforms substantially with the application as amended,
and which shows a minimum distance between the existing dwell~ng
and the 9roposed line of severance to the south of not less tqan
50 feet.
6. Fulfilment of Conditions 1,2,3,4 and 5 not later than JUNE

Council in Committee reviewed the tender opening prices for the
McDonald Drive contract -copy of which is attached hereto (Letter

Council in Committee would further recommend that the award of ·
tender be with-held to the next meeting to allow for the acquisition
and finalization of property requirements and that Council would
favour the low tender -Lamco Construction.
The award of the tender will be further considered by Council
subject to the property acquisition and subject to the approval
of M.T.C.
Item #2. Maintenance Equipment.
Council in Committee discussed the purchase of an Industrial Vacuum
Sweeper and Snow Blower which will be required for this winter ·
season as part of the Town's obligation for the outside maintenan9e
of the Administration Building.
Council in Committee would recommend that the purchase of both of:
these pieces of equipment be authorized and monies have been
allocated in the Maintenance Budget for such purchases.
Item #3. M.I.A. Computer Programme School
Council in Committee discussed this matter and recommended that Mrs.
Carol Preston be registered for this course at a cost of $300.00
and the necessary transportation.

Item #4. Repair of vandali~m damaged signs.
Council in Committee received a report that it will cost in
excess of $1,700.00 to repair the damage and further were advised
that modifications to the signs could be made at a total estimated
cost of less than $3,500.00 which would allow nine more Service
Clubs and/or organizations to participate.
Council in Committee would recommend that the Clerk-Administrator
discuss with the present nine organizations an annual fee to cover
the cost of maintenance and up-keep of these signs and to contact
all non-participating Service Cluos and organizations to determine
their interest in advertising on these signs. (Requests have bee~
received in the past year from about three or four organizations.
Item #5. Sheep loss evaluation.
Council in Committee would recommend that sheep loss to Sifton Farms,
on or about the 19th. day of May, 1976, be paid in the amount of
$160.00 as determined by the Live Stock Valuer, James Rae.
Item #6. Letter 16.86 J. Traganitis. Aurora Hellenics Social
and Soccer Club. Financial Statement.
Council in Committee considered this letter further and although
the Indoor Tournament had to be re-located, Council felt that it
did everytLing possible to assist the Soccer Association by
writing of letters directions, maps, etc. and in assisting in the
making of alternative arrangements. Council would recommend
therefore that they cannot justify the spending of further tax
dollars for this event.
Item #7. Letter 16.68 Springburn -O.H.C. Re-Zoning By-La~
Council in Committee would recommend that O.H.C. be advised that
because of compatability with adjacent homes, the provisions of
the By-law for re--zoning will contain a minimum of 1,100 sq. ft. per
single family dwelling and 1,300 sq. ft. for single family dwellings
adjacent to the homes on the north bcundry of the Springburn O.H.C.
property, which are presently of similar size. ·

Council in Committee would recommend consideration of the report
Letter 16.115, and wald recommend that the Town Superintendent and

Council in Committee were made aware of a list of trees which had
been received for removal and in addition four more trees which
are doing poorly and which will require extensive monies to be
spent on them to even prolong their life, which should also be
considered.
Council in Committee would recommend that these trees be looked at
and reaction sought prior to further consideration in the form of a
contract for. tree removal.
Council in Committee waid advise that 125 trees were planted in
the Fall of 1975; 37 trees have been planted on Wellington Street
W. and the Town will continue a tree planting programme this Fall,
