PRESENT WERE: Councillors Davis, Jackson, Miller, Roth, Stewart,
Timpson and Williamson.
Davis: "Resolved that Councillor Timpson take the Cb.Sir."

CARRIED
Councillor Timpson extended a warm welcome to the members of the
Juveaile Hockey Club and on behalf of the Council extended to
them heartiest congratulations on the winning of the Ontario
Juvenile Hockey Championship.
Miller:

All Ontario Championship;
AND WHEREAS it is a policy of the Town of Aurora that
when a Team has won a Provincial Championship that tije
Town show its appreciation by purchasing jackets tor,
the Team;
THEREFORE be it resolved that the Purchasing Officer
be authorized to Tenqer the cost for these jackets ·
and purchase same at a cost not to exceed $ ."
Councillor Miller requested that this resolution be referred
to the next Council in Committee meeting.

l}T THE MATTER OF an application by Scott Annan and Elma Annan, for
consent to convey a parcel of land having arr area of 1.84 acres
and frontage of 150 feet, as shown hatched on a sketch attached
as Appendix No. 1, for residential purposes.

Land Division Committee on Tuesday, February 17, 1976.
Mr. Thomas McPherson, Solicitor, appeared at the Hearing. Mrs.
Annan was also present.
The applicant.s seek consent to convey n parcel of land having
an area of 1.84 acres with frontage of '150 feet on the west
side of the Third Concession Road, located approximately 248 feet
north of Wellington Street, for residential purposes. The
applicants would retain a parcel of land having an area of 2.85
acres with frontage of 226 feet, for residential purposes. There
is an existing single family dwelling located on the subject land.
There is an existing single family d~Telling and a shed located
on the land to be retained.
The applicant.s 1 land is designated "Rural" on the Official Plan
of the former Township of Whitchurch Planning Area. The land is
zoned"R" -Rural by By-law Number 2042-75 which requires minimum
lot frontages of 600 feet and minimum lot areas of 25 acres.
Neither a municipal "rater supply nor municipal sanitary sewers
are available to the subject land or the remaining land and
apparently none ore contcnplntcd in the foreseeable future. The
Third Concession Road is an a8sumed public street.
The Committee notes that the Official Plan requires a lot area
of not less than 2 acres. The applicants have indicated that they
are agreeable to amending the application to ensure that both
the subject land and the remaining land each have a minimum lot
area of 2 acres, after 1.ridening. The Committee also notes
frontage from 86 feet and 694 feet and in lot area from approximatley
18,000 square feet to 47 acres. Several lots to the south which
front on Wellington Street and abut the subject land, have
frontages of 125 feet and lot areas of approximately 32,250 square
feet. The Committee is of the opinion that consideration should
be given tothe fact that both the subject land and the remaining
land are presently being used for residential purposes and that
the conveyance will not create an additional need for police and
fire protection, school accommodation, road maintenance or servicing.

The Committee is satisfied that the applicants' proposal as amended
to provide lot area of not less than 2 acres each will conform
to the provisions of the Official Plan and that the subject land
and the remaining land are suitable for the continuation of the
existing residential uses and '"ill be compatible with the
establi~bed pattern of development in the area. Further, the
Committee is satisfied that a Plan of Subdivision approved under
Section 33 of The PlanP~ng Act is not necessary to ensure the
proper and orderly development of the Municipality.
It is, therefore, the decision of the Land Division Committee
that Application Number A.75.15 be, and the same is, hereby
APPROVED, as amended to provide lot area of not less than 2 acres
after widening, as shown on a sketch attached as Appendix No. 2,
upon fulfilment of the follm1ing conditions:
1. Payment of all taxes, to date, to the Town of Aurora;
2. Payment of a Lot Levy of $700. OOto the Town of Aurora;
3. Payment of a Park Levy to the Town of Aurora inlieu of the
deeding of land for park purposes, said Levy not to exceed
5% of the appraised market value of the subject land;
4. Ontario Municipal Board approval of an appropriate amendment
to the Restricted Area By·-law affecting the applicant's land
passed by Council in response to an application submitted
by the applicants, to permit both the subject land and the
remaining land to be used for residential purposes;
5. Conveyance of a strip of land, by deed, 27 feet in width
across the Regional Road Number 12 frontage of the subject
land, to the Regional Municipality of York , . without cost,
and free of encumbrances;
6. Submission to the Secretary--Treasurer, of written advice
from the Health Unit, Regional Department of Health and
Social Services that the tile field serving the dwelling on
the subject land >·rhich may encroach onto the remainin~ land,
has been re--located to that Agency's satisfaction;
7. Submission to the Secretary--Treasurer, of a fully executed
deed, ·in triplicate, conveying the subject land, as amended;
8. Submission to the Secretary-Treasurer,of three white prints

of a registerd Plan of Reference of the applicants' entire
land, which conforms substantially with the application as
amended and which shows the distances of the existing buildings
and structures from the proposed line of severance and which:
shows the remaining land having a lot area of not less than
2 acres and which shows the 8Ubject land having an area of not
less than 2 acres after widening, and which shows the required
widening; ·
