REGULAR l"'EETING -'11-JANUARY 7th. 1974 REPORTS OF COMMITTEES CONT'D CONDITIONS OF CONSENT: ('I) THAT with respect to the issuance of Bu:iading Permits, the Planning Committee of the Council of the Town of Aurora adopt a Standard Work Procedure Form for use by its Building Inspection Department confirming (a) that all Town of Aurora By-law$ ~applicable to the subject application have been checked by the Building Inspector and that the plans, as submitted with the Building Permit Application, do not contravene any existing By-laws. (b) that the By-law requirements for front, side and rear yard allowances were checked by the ~plicant, or his representative when the wall footings were completed, and a written report giving actual dimensions be recieved and approved by the Building Inspection Department at that time. (c) that if my variance was evident from (b) above, then a written STOP WORK ORDER was issued pending required correction(s). (2) THAT the Committee of Addustment obtains a letter from the Planning Committee of Council confirming that the procedure referred to in Condition (1) above has been adopted and will constitute standard on-going practice in the Town of Aurora Building Inspection Department. Reasons for the Decision (~) The Committee of Adjustment is inclined to agree with the Planning Committee of Council that an honest error was made by the Building Inspector in this instance. However, the Committee of Adjustment recognizes that an error of this natu~exposes the possiblity of real hardship for the applicant and where the mistake is largely, if not solely, the fault of municipal staff could result in extensive liability to the Municipality. The Committee feels strongly that corrective action should be taken and has presented this view to Planning Committee of Council on a number of occasions. It believes that adh,erence to a simple practical work procedure, such as outlined in Condition (1) will virtually eliminate such errors in the future. (2) Condition (1) above has been discussed with Mr. Gordon Brush Planning Department, Regional Municipality of York, Mr. W. Falke, Law Branch, Ministry of Treasury, Economics and Intergovernmental Affairs, and a Barrie Surveyor, all concurred with the Committee's position in this regard. REGULAR MEETING -'12-JANUARY 7th. 1974 REPORTS OF COMMITTEES CONT'D (3) The ColDlllittee did not consider the variance to be a minor one. Since the erection of the house involved had been allowed to proceed to completion, the cost to the owner and/or the Municipality in rectifying the error would be quite substantial. The ColDlllittee would hereby go on record as declaring that in permitting the variance there is no implication that a precedent is being established and, in fact, would anticipate that conscientious implementation of Condition (1) above would virtually preclude repetition. (4) In researching the matter, the ColDlllittee came strongly to the opinion that the inclusion of this Lot in By-law 1863 (as amended) was an over-sight, and that there was no actual intention on the part of Council in making the side-yard requirements for this particular Lot any different from all the remaining lots on the street. The Co=ittee has been advised that the Town in fact did attempt to amend the By-law to exclude this particular Lot. Davis: Stewart: "WHEREAS the Aurora ColDlllittee of Adjustment have written their decision on Submission AS/73. AND WHEREAS, it was pdnted out to the ColDlllittee of Adjustment prior to their decision on such app- lication, that Condition (1) and (2) as stated are matters outside the jurisdiction of the ColDlllittee of Adjustment in determining such decision, and setting out of such conditions to consent, in that the ColDlllittee was attempting to interfere in administrative procedures of the Town. AND WHEREAS, the Courtcil concurs in the decision of the ColDlllittee of Adjustment and agrees with such decision, but not with such conditions .attached, AND WHEREAS, an appeal to the Ontario Municipal Board from the decision of the Co=ittee of Adjustment of such conditions would be very time consuming and onerous on the applicant. NOW THEREFORE BE IT RESOLVED, that the Town Solicitor and Clerk-Administrator be authorized to prepare all necessary documentation to have this matter brought before the Supreme Court of Ontario, (Divisional Court) to vary the decision of the ColDlllittee of Adjustment on Application AS/73 in relation to the conditions imposed, at Town expense and that the Seal of the Corporation be attahced hereto." Reasons for the Decision: (1) There were no objections either written or verbal to the granting of the consent. (2) The severance rationalizes an existing use of the land. (3) The Committee acknowledges and appreciates the recommendations of the South Lake Simcoe Conservation Authority, and believes they should be implemented. (4) The Committee researched, in&pth, the matter of a request from the Municipality of the Town of Aurora for ro~d widening allowance and a lot levy on: .land adjacent to that which is the subject of the application.
