L. Oliver, 81 Spruce Street, Aurora, Ontario, requesting relie~ ~rom Town o~ Aurora By-law No. 1863 (as amended) re: Part Lots 2 & 3, Plan 67, Town o~ Aurora, as described in the subject application, the Committee o~ Adjustment, Town o~ Aurora, has this day issued the ~ollowing Decision. DECISION: "THAT approval is GRANTED to this application, subject to the Conditions o~ Consent as ~ollows." CONDITIONS OF CONSENT: (1) THAT there be no change in the present side yard variance which has existed ~or approximately ~i~ty years. (2) The extent o~ the roo~ overhang as requested in the application was given serious consideration by the Committee and, in the judgement o~ the Committee, might be considered a major variance. Accordingly, Consent is given on the Condition that the east-west edge on the north side o~ the overhang not extend closer than two ~eet ~rom the northerly lot line, and the north-south line o~ the overhang extend no ~urther than the one storey level to the west side. The Committee recognizes that a good deal o~ the structural support ~or the northerly portion o~ the roo~ overhang will have to come ~rom some horizontal members attached to the ~ence posts. ---------------~--------------~---------·-· ------------~------··--------·--- REGULAR MEETING - 8 -NOVEMBER 19th. 1973 REPORTS OF COMMITTEES CONT'D (3) THAT because of the density in this, an older section of the Town of Aurora, the Committee gave cognizance to reduction of any possible fire hazard, and therefore requests as a Condition of Consent that the Applicant adhere closely to the best recommendations of the National Building Code and the Building Inspector for the Town of Aurora, in the selection of fire resistant materials for the proposed structures. Reasons for the Decision: (1) There were no objections either written or verbal to the granting of the variance and, in fact, two neighbouring residents appeared and strongly endorsed the granting of the variances. (2) The Committee agreed that the proposed changes would esthetically enhance the environment and, with the changes requested by the Committee, would reduce the variances to the point where they would be considered to be no more than minor. Herskovits and Mr. Alf Child addressed Council in Committee regarding Block "A" of their proposed subdivision and their future commercial plans. 2. Mill Street Apartment Proposal: Mr. Grossman discussed the status of the Mill Street Apartment proposal and that they \~ould hope to be finalizing a new site-plan for this site which had been given preliminary approval in principle some two years ago. Green Paper on Environmental Assessment: Council in Committee discussed this matter and wish to make no comments thereon. 4. G~ett Street Apartment Building -· Building Inspectors Letter 2 -6 Council in Committee received the Building Inspector's report and would direct that the Clerk and Building Inspector continue contact with the owner to obtain a definite commitment as to the conclusion of the required building and the reli very of steel. 5. A meeting of the South Lake Simcoe Conservation Authority and representatives of the Aurora Agricultural Society has been called for Wednesday, October 24th. 1973 at the Aurora Highlands and Councillors Davis and Henderson were requested to attend and represent Council at this meeting. 6. Letter 22-G. V. Kleinveldt Assoc. Ltd. re ardin plan of Subdivision part of lot 7 Cone. Council in Committee considerd this matter and inview of its' location, directed that the Clerk Administrator send a letter to the applicant stating that this area is premature and that no services are available for consideration of this plan. 7. Letter from Sterling Drug Ltd. -re: Industrial Waste By-law 191~ Council in Committee received this matter 22-30 and requested comments from the Engineer. · 8. Letter from Mr. Harry Ra~ond respecting Mr. Felcher's new plans for a low-rise apartment uilding Council in Committee considered this letter and would invite Mr. Felcher and Mr. Raymond to the next Council meeting to make a presentation. CARRIED Council in Committee Report # 90 Mayor Buck presented a report of Council in Committee in which the Committee respec+fully submitted the following: A meeting of Council in Committee was held on Monday, November '12th '1973 at 9:30 P.M. Present were: Mayor E. Buck Councillors: Davis; Henderson; Timpson; Trent; Miller; and Williamson. '1. Mari Construction: Council in Committee were advised that a meeting was held with the principals of Mari Construction Ltd., the Building Inspector and the Clerk-Administrator and an agreement and understanding has been signed that the serious drainage problems and any building deficiencies will be co~pleted within 30 days of the signing of this agreement and undertaking. The agreement further states any further drainage problems which may appear during the Spring will be corrected by the contractor, prior to the expiry of the one year guarantee which is on all buildings. Council eYpressed satisfaction in obtaining this commitment and time schedule now put forward by the 'builders for the completion of the deficiencies in the houses on Fairway Drive. McMahon Park Building Council in Committee directed that the Building Inspector obtain a firm price for the completion of the minor items on the McMahon Park Building, hopefully by the next meeting of Council. 3. Matjon Subdivision Council in Committee discussed the matter of parkland or cash in lieu and would recommend that cash in lieu of parkland be considered by Council and further that an agreement be reached as to value to be included in the subdivision agreement based on market value. 4. 1974 Budget considerations for consideration by the South Lake Simcoe Conservation Authority Council in Committee considered this matter and in relation to the acquisition of lands would direct the Clerk-Administrator advise Council's interest in the Conservation Authority acquiring property within the Town of Aurora and a suggested list for consideration. CARRIED Planning and Development Committee Report # 91 Councillor Davis presented a report of the Planning and Development Committee in which the Committee respectfully submitted the following: A meeting of the Planning and Development Committee was held on Thursday, November 8th. 1973 at 7:00 p.m. Present were: Councillor W. Davis, Councillor E. Henderson, Councillor J. Williamson, Councillor G. Timpson, Principal Planner G. Brush and Roy Harrington, Building Inspector. 1. F.
