Councillor I. Harris, K.B. Rodger, Clerk- Administrator. In accordance with the request and a notice given to Council, Monday, September 20th. the meeting was held in the Aurora Council Chambers, at 3:00 p.m. to learn of the present status of the Farm Appeal as it affects the Region of York and in particular the Town of Aurora. The York Regional Assessment Branch have in~ous stages of appeal, 883 farm appeals in the Region of York that affected the 1970 assessment roll on which the 1971 taxation is based. The Town of Aurora (new boundaries) have 73 farm properties in total. Of this number 12 properties are under appeal either to the Assessment Review Court which has been adjourned at the present time or under appeal to the Counvy Judge. This. represents 16% of the Aurora farm properties under appeal. A test case was held and the decision has been handed down by the <Jntari,o Municipal Board which based farm land valtiations on agricultural productivity and the decision stated that this particular property was to be a test case ~d is referred to and !mown. as the "Cyril Cle.rk•" . The Cyril Clark appeal case decisi·on was based on a 'IB.iue of $300o00 per acre assessment. CARRIED REPORTS OF COMMITTEES Planning and Development Committee Report No •. 107 Councillor Harris presented a report of the Planning and Development Committee in which the Committee respectfully submitted the following: A meeting of the Planning and Development Committee was held on Tuesday September 21st, 1971 at 8:00 P.M. Present were: Councillor I, Harris, Councillor w. Trent, C.H. Duncan, G. Brush and R. Hunter. 1. Bentley Subdivision -File T-22012. Mr. Bentley met with the Committee to discuss the lot design problems. He submitted two alternatives, both with the 1ots fronting on Ridge Road. He advised that, because of the topography of the land, an internal road does not appear to be feasible, Mr. Brush advised that ~he Conservation Authority are studying the area to determine source areas ahd have not reported to date. Pi<lbrock Subdivision, Mr. Henry T, Piebrock presented his brief on the proposed development of his 100 -acre propert;r.,,on the east side of the Third Concession, immediately north of the C·F·ft·B· Sideroad. ~e proposed phasing of this development would be commencing in 1974 and completion in or after 1985. The Committee recommends that the proposed development be referred to the Area Services Branch for study and a report. 3. Del Zotto Homes Ltd, The Committee met with Hr. Dennis Seward and Mr. Rafael, architect, to discuss their proposed town house development of Del Zotto Homes ltd. The technical report prepared by the Area Services Branch was considered clause by clause. ~e developer has agreed to consider the ~oints raised in the report and a further meeting will be convened to try and reach mutual agreement. The Committee recommends that a levy of $600,00 per unit be charged on town housing developments. 4. Regency Drive Development File No. T-21846 The Planning Corowittee feels .that the Council should be aware of the ~ollowing facts regarding Subdivision File No, T-21846. . a, The draft plan of subdivision has Bela Drive as a 66 ft. road. Should redesign or reconstruction of this road to an 86• collector road be desired, the curve radii are not adequate for a collector road. b. That as the blocks of land in the plan have been designated for use in the draft plan any change such as reloc~ting the apartments to another site, to comply with good planning principles, would be difficult. c. The following steps are required before any development of this site can take place. (i) Possible Official Plan amendment. (ii) Zofiing By-law amendment to permit development on private roads if rental project or if condominium. (iii)Site plan Agreement on each block. (iv) Subdivision Agreement, 5. Application Fees for Amendments to Zoning By-law and Official Plan The Committee has discussed the need for a fee schedule for applications for amendments to the Official Plan aii.d Zoning By..:law. At the present time the Town has been processing amendments at no charge to the applicant and there are adntinistrative and office expenses involved in every application. CARRIED REGULAR MEETING -13-OCTOBER 4TH, 1971 REPORTS OF COMMITTEES CONT'D Committee of Adjustment -decision re Submission B-43 In respect of application (Schedule B, Submission No. B-43) by Smith, McLean, Inch and Howden, agents for Ella Copson, Mildred H. Graham and George T. Graham, c/o 64 Centre Street, Aurora, Onterio 1 for consent to agreement of sale and purchase re: part of Lot 85, Concession 1, Town of Aurora, (Formerly Township of King) and as fully described in· the subject application, The Committee of Adjustment, Town of Aurora, has this day issued the following Decision• DECISION: "That tentative approval is granted to this application and the Committee of Adjustment, Town of Aurora, is prepared to issue a final order consenting to agreement of sale and purchase as set out in the applic~tion, upon compliance with CONDITIONS OF CONSENT as follows." CONDITIONS OF CONSENT: (1) THAT a copy of the final survey be forwarded to the Committee. (2) THAT all deeds, when prepared, be submitted to the Secretary Treasurer, Committee of Adjustment, Town of Aurora for endorsement. Committee was unanimous, but was the subject of very · aet<Sdled consideratibrt, particularly with· regard to the request of the Commissioner of Engineering, Engineering Department, Regional Municipality of York, for dedication of a 27 foot width road allowance. The Committee had requested from the. Engineering Department ari explanation for the request and was, convinced of its necessity. ~e Committee furthe;J;" checked with Mt"l. J.l~. ieiti, Solicitor, Department of Municipal Affairs, rElgarding the Committee's authority to set such a condition and for his opinion as to whether, in the circumstances, the condition was'a reasonable one. Mr. Reid responded that the Committee certainly had the necessary jurisdiction and that, in his judgement, the cpndition was not an unreasonable one. In making this condition the Committee notes the Decision given by the Ontario Municipal Board in the appeal by Wentworth County, against .the.DeQision of the Committee of Adjustment e>f East Flamborough, (O,M.B. P-747-66, 6 May, 1966), _,-__ _ "-·-~-· REGUALR MEETING -14-OCTOBER 4TH, 1971 REPORTS OF COMMITTEES CONT 1 D (4) The Committee seriously considered the possibliity of hardship suggested by the Solicitor for the applicant, and concluded that this remained only a possibility and in any event did not appear particularly undue. CARRIED Parks and ~creation Committee Report No. 110 Councillor Miller presented a report of the Parks and Recreation Committee in which the Committee respectfully submitted the following: A meeting of the Parks & Recreation Committee was held on Tuesday, September 28, 1971 at 8:00 P.M. in the Board Room of the Community Centre. Present were: Councillors Stewart, Trent; Members: M. Dawson, B. Sorely, B. Blick, B. Crump, Recreation Director B. Young, Arena Manager E. Batson and Parks Foreman, N. Weller. Also in attendance were Mayor R. Illingworth and Councillor I. Harris, and by invitation: Mr. Greg Paul of the School of Creative Art. 1. Art Show After hearing comments fro3 Mr. Paul, the committee felt it would be advisable to have the show on the main~ena floor next year, and that a sub-committee of M. Dawson, Councillor Trent, with Greg Paul co-opt, will be meeting and will bring back a report of the Committee with a format of the cost of next year's show. Council will receive a further progress report as soon as information is available. 2. Winter Youth Centre Recreation Director, B. Young, made a presentation asking that the Summer Youth Centre be extended to a Winter Youth Centre, provided a school could be obtained -, ___ , REGULAR MEETING -15-OCTC 'ER 4TH 1 1971 REPORTS OF COMMITTEES CONT'D to house same. The Committee recommends that Mr. Young be granted $50.00 from the balance of the summer programme on the understanding that the Centre will have to be self supporting. The Committee suggested that Centre operate for a trial period only, until Christmas. The Committee recommends that there should be a $1.00 registration fee and a aharge of 25¢ per attendance. The Committee also recommended that Mrs. Pauline Hutchinson be appointed supervisor. 3. Recreation Information Flyer The Committee requested Mr. Young to investigate the feasiblity and an economical way of distributing such flyers to all houses within the Town. A further report will be made to Council as soon as possible. For Information only. 4. Recreation Director's Report Mr. Young submitted a comprehensive report covering Recreation Hockey, Youth Centre and Summe~ Playground. The report was circulated separately to all members of Council. One of Mr. Young's main suggestions was that next year we should institute a Day Camp Programme, which met with the Committee's approval in principle; he was instructed to ~eport further when he had more detailed information as to operatimg costs. 5· Winter Carnival The Committee is presently discussing the detailed programme to be held on the 7th and 8th and 9th of January 1972. Finalization will be made at the next meeting of the Committee. 6. Tree Planting Programme The Committee requested that Parks Foreman, N. Weller, be instructed.to plant trees under this programme on Orchard Heights Drive, Brookland Avenu~, both sides and that 2 trees be replaced on Gurnett Street at an approximate cost of $900.00. We would also recommend that the offer of the residents of the Orchard Heights Drive area, to assist in this operation, be accepted. Council in Committee Report No. 112 Mayor Illingworth presented a report of the Council in Committee in which the Committee respectfully submitted the following. A meeting of the Council in Committee was held on Monday, September 27th, 1971 at 8:00 p.m. Present were: Mayor R.A.Illingworth, Councillors Davis, Harris, Miller, Stewart, Trent and Williamson. 1. Wimpey Homes Ltd. -Block ''M". The Committee recommends that Wimpey Homes Limited be authorized to regrade bank in Machell Memorial Park adjacent to Block "M" and p:j.ace top soil (min.611 ) and sod to the Town's specifications and that the Company be given permission to construct a storm sewer main, to the Town Engineer's specifications, from Block 1'M 11 to the outfall, subject however, that this authorization shall not be constrllad as approval of any development on Block "M". This work shall be completed by November 30th, 1971. 2. Condominium Development. The Committee recommends that the concept of Condominium development on Block "M", Plan M 1310, as a pilot project, be approved in principle subject to the report being compiled on the development of Block 11 M" by the Area Services Branch. 3. Staff Agreement. The Committee recommends that a meeting with Mr. Jack Bird of C.U.P.E. be arranged to finalize the hours of work for the Community Centre employees in order to complete the agreement. 4. McDonald Dr. Extension·. The Committee recommends that the letter of intent and permission toenter form from Del Zotto Homes Ltd., be accepted subject to the Town Solicitor negotiating with the Solicitor for Del Zotto Homes Ltd. for the deletion of the last clause of the covering letter.
