REPORTS OF COMMITTEES Planning and Development Committee Report No. 23 Councillor Harris presented a report of the Planning and Development ConmittGe in which the Committee respectfully submitte(l the following: A meeting of the Planning and Development Committee was held on Tuesday, ~~rch 2, 1971 at 9:20p.m. Present were: Councillors I. Harris, W. Trent and E. J. Henderson; also present were Councillors W. Davis and R. Simmons, J. D. Reid, c. H. Duncan and Mr. M. Pound, Director of Planning for the Region of York. 1. Del Zotto Homes Limited The Committee met with Mr. D. Seward, Mr. A. Del Zotto and his consultins engineer, to discuss their proposed development. The Committee recommends that the Council in Committee meet with the Developzr to discuss the extension of McDonald Drive and the necessary financial arrangements. 2. CARRIED Council in Co~ittee Report No. 24 Councillor Harris presented a report of the Council in Committee in which the Committee respectfully submitted the following: A meeting of the Council in Committee was held on Tuesday, March 2, 1971 at 8:00 p.m. with the members of the Committee of Adjustment present to meet "ith Mr. Pound, Regional Director of Planning, to discuss the planning facilities that will be available from the Region. Present were: Councillor I. Harris (in the Chair), Councillors W. Davis, E. Henderson, R. Simmons, W. Trent and J. Williamson; J. D. Reid, K. B. Rodger, C. H. Duncan, Mr. F.. Wims, Chairman of Committee of Adjustment and members B. Montgomery, J, Sanderson, S. Burnett, W. Dinsmore; and Mr. M. Pound, Directo~ and Mr. H. Rimon of the Region of York Planning Department. Mr. Pound advised that under Bill 102, the Region of York has been designated as the municipality for planning purposes, and that an official plan for the Region must be completed within four years. Bill 102 also provides that the Region may provide area municipalities with planning services. The Regional Planning Department is proposing an Area Services Branch in which, ·the participating municipalities will pay for its operation directly, and over and above the municipalities' share of the costs of the Planning Department as presently established, and the Branch will report directly to each municipality and not to the Regional Council. The Branch will also provide technical advisory services to the Committee of Adjustment of each partici- pating municipality. The Branch will prepare each municipality's official plan to cover the enlarged area and staff will be available to attend meetings with the Council, Committees and Staff, The· estimated cost to each participating municipality is 60 to 70 cents per capita for a full year and that for the balance of 1971, the estimated cost to Aurora would be $3,500. to $4,000. The fee would cover unlimited use of the Branch's services. Harris: Trent: "Resolved that the Report of the Council in Committee dated March 2, 1971, re Regional Planning Services, be accepted." CARRIED Councillor Harris in the Chair. SIXTH REGULAR MEETING -8-MARCH 15, 1971. Council in Committee Report No. 25 Mayor Illingworth presented a report of the Council in Committee in whic:O t'· .. Committee respectfully submitted the following: A meeting of the Council in Committee was held on Tuesday, March 9, 1971 at 8p.m. with the South Lake Simcoe Conservation Authority. Present were: Mayor R. A. Illingworth, Councillors W. Davis, I. Harris, N. Stewart, and W. Trent; Mr. D. Sterrit of the S.L.s.c.A. and Mr. R. C~nns of the Conservation Authorities Branch of the Department of Energy and Resources Management. The flood line mapping and the report prepared by James F. McLaren Limited were discussed in detail. Mr. Sterrit advised that the Conservation Authority intends to place restrictions on the development of flood plain lands and that land filling and buildings should be prohibited within the flood plains. Mr. Sterrit agreed to investigate the feasibility of commercial parking areau on flood plain lands, but stated that the Authority would be opposed to residential parking on these lands, if the report of McLaren's is adopted. A further meeting with the Authority will be held in which James F. McLaren Limited will be present. The Committee recommends that Mr. Sterrit and Mr. K. B. Rodger, Clerk, p~epare a request to the appropriate Provincial Department to undertake a study of the head waters and the source areas of Tannery Creek. Illingworth: "Resolved that the report of the Council in Committee dated Harch Stewart: 9, 1971 re Flood Line Mapping, be accepted." CARRIED Mayor's Report No. 27 Mayor Illingworth presented a report in which he respectfully submitted the following: On June 11, 1970, Mr. J. Bierman submitted plans to the Building Inspector for a 25 suite apartment on the west side of Machell Street. The area in question is zoned A-9 by by-law 1863. The letter from the Building Inspector (13-38) was referred to the Building and Development Committee as recorded in minutes of Council dated June 15, 1970. Mr. J~ Bierman appeared before Council to present his proposal for the 25 suite apartment in greater detail on August 4, 1970 and the proposed project was referred to the Building and Development Committee. Some discussion took place regarding the possibility of flooding in the rear portion of the land and the Holland Valley Conservation Authority were requested to report on the proposed project. • ~. SIXTH REGULAR MEETING -9-MARCH 15, 1971. Mayor's Report No. 27 Cont'd In view of the forthcoming report by McLaren on floodline mapping no action was taken until this report was available. The floodline maps were. received during the latter part of 1970 which revealed that the proposed area was in the flood plain. The written report was not available and no action was taken until this report was available. The written report was.not available until February 1971 and it was reviewed by Council in Committee on March 4, 1971 and with representatives of the Department of Energy and Resources Management on March 9, 1971. There is no. doubt that according to the McLaren Report the entire area of Machell Street is considered to be in the flood plain. Several telephone conversations have been carried out with Nr. Bierman since the·, first of the year as he is most anxious to proceed with his development. He was advised that no action would be taken until the McLaren Report had been discussed by Council. In the most recent telephone conversation with Mr. Bierman, he advised that although he has contacted his solicitor, he would withhold any action until after the Council meeting on March 15, 1971 and that a decision must be made at that time. Members of Council are requested to consider the follm<ing factors: (a) Mr. Bierman purchased the property for development in accordance with our Zoning By-law, prior to any knowledge about the floodline mapping. (b) In accordance with present regulations, Mr. Bierman has every right to submit his application for a building permit (applicat{on submitted March 11, 1971). If such building permit is not granted, Mr. Bierman may apply for a Writ of Mandamus. (c) This matter was fully discussed with Mr. Derek Sterritt, of the South Lake Simcoe Conservation Authority on Friday, ~brch 12, 1971 and he advises that in view of the McLaren Report, the Department of Energy and Resources Management would oppose any development in the floodplain. (d) While is agreed that Mr. Bierman may have a legal right to request a permit to build in the floodplain, members of Council must make a decision as to the protection of future residents of the area, in the event of a major flood. Based on the above, the following recommendations are submitted to Com, cl f.~r consideration. Bierman Construction -Apartment Building on Machell Street, dated l'larch 15, 1971 be discussed and accepted," CARRIED Council in Committee Report No. 26 Mayor Illingworth presented a report of the Council in Committee in which the Committee respectfully submitted the following: A meeting of the Council in Committee was held on Monday, March 8, 1971 at 8 p.m. with all members present except Councillor Simmons. 1. Proposed Development Yonge & Wellington The Committee discussed the development of the north east corner of Yonge Street and Wellington Street and recommends that a letter be sent to the York County Board of Education, with a copy to Mr. L. Hennessey, advising that the Council is interested in seeing a substantial development on this corner, although the Town will not be participating in the development, and therefore suggests that Mr. Hennessey meet with the Board to determine if the Board may be interested in participating in the development. 2. !£Fe Protection to the Oak Ridges Area The Committee recommends that a registered letter be sent to the Town of Richmond Hill advising that if a letter of agreement to cost of fire calls is not received or a meeting convened by March 31, 1971, that fire protection services to the Oak Ridges area will be terminated as of that date. 3. Wimpey Homes Ltd., -Development of .Block "M" Mr. Collin Bennell of Wimpey Homes Limited met with the Committeeto present a proposal for the development of Block 11M11 .on the south side of Orchard Heights Blvd. The proposal is for conduminium town housing. Wimpey Homes Limited, based on the discussions that took place, is to make a further presentation. 5. CARRIED Mayor Illingworth in the Chair. Councillor Harris gave a verbal report on the Shade Tree Conference that he attended in Kitchener last week. He advised that a Provincial grant of one dollar per capita will be available to municipalities for the removal of diseased elm trees, under the work incentive program. Councillor Harris also advised that he submitted a Resolution at the Conference for the formation of Branch Number 1 of the Shade Tree Council, in Aurora, which was approved, and Ottawa is to form Branch Number 2. Mr. William Crump of Aurora was elected to the Board of Directors of the Shade Tree Council. Consideration of Business for Which Notice has been given: Councillor Harris in the Chair.
