ADOPTION OF MINUTES Councillor Murray stated that the minutes of June 30, 1966 indicated his presence at the meeting, whereas he was absent. ACCOUNTS Mayor Davis advised this error had already been corrected. PATRICK: SIMMONS: Resolved that the minutes of the meetings of June 1 1 June 6, June 13, June 20 1 June 27, June 30 as amended, July 4 and July 12 be adopted as printed and circulated, CARRIED. All accounts passed as printed and circulated. CORRESPONDENCE AURORA PUBLIC SCHOOL BOARD Aletter f~ofu the Aurora Public School Board requesting a municipal advance of $52 1 000 for this purpose to complete :the pmrcl}nse of a school ai te. · · • Mayor Davis pointe.(} out that Council had approved an increase in the 1966 quota of $55 1 000 for this purpose and that we had obligated ourselves for this purchase. Councillor Murray disagreed. He said that Council had approved the purchase of 7~ acres but that the School Board had purchased an additional 2¥.! acres with no further reference to Council. He felt that this amount of land was not required for the number of classrooms and number of pupils involved. ~·}~:::- ,_. ___ . 13TH REGULAR -2. -July 18, 1966 CORRESPONDENCE CONTINUED AURORA PUBLIC SCHOOL BOARD Councillor Illingworth said thet tbe School Board had originally asked for ~.· acres at a cost of $42 1 000 and the ba-lance was designated for engineering and services. He said that eighteen classrooms indicated an enrolment of 540 pupils. He said that an enrolment of 600 pupils would require a minimum of 5 to 6 acres and a maximum of 7 acres, He felt that ~ acres was more than ample and that Council should have been advised if there was a need for more land. ILLING'c'!ORTH: Resolved that the request be referred back WILLIMASON: to the school board with a request that a representative of the School Board meet with Council in Committee to outline why the incl"eased acreage is required. CARRIED. D@LEGATIONS: Mayor Davis read a letter from Mr. R.C. Jansen asking permission to appear as a delegation regarding the Church St. School. Mr, Jansen presented a brief _ ... .., Your Worship and Members of Council: When I, personally, asked for permission to address this Council 1 on July 12th, 1966 ,. my reason was one of meeting deadlines re: an address to your council, & difficulty in contacting ~tt~~· members of this delegation during the day. in its o£ its Throughout the period that this delegation has been active opposition to the re-opening of Church Street School, each one members has handled a certain area of responsibility, The contents of this statement have been fully discussed by this delegation. Since the substance of this brief has been my personal concern, it was relt that I should make the presentation on behalf of our entire delegation. , I would further like to make ' it abundantly clear that we are agreed in our desire to prevent the School Board from using the Church Street School. All members of this delegation fully agree on the objectives originally given to us through the a.~ndate from the parents who met originally at Victoria Hall on April 6th, 1966. JANSEN'S BRIEF In our brief originally presented to Council, we asked you to reconsider the requested sale of the school to the School Board, hoping that a denial of this request would prevent its re-opening. Only this one point was brought to your attention, recognizing it as within the area of your jurisdiction in this matter, It has since been learned that for some reason, and nobody has been able to find out what this reason is, the School Board still intends to use this building for class acco.umodlation, even if Council refuses the sale of the building. It was further learned during the meeting of the school board of Tuesday, July 5th, that your office informed the board that 59 building permits have been issued for the first six months of this year. The Chairman of the board estimated then, that this would mean &n additional load of some 120 pupils on the school system. We understand that in the consider~t:l.on to re-activate the Church Street School build:j,ttgl t~1ese additional pupils were not considered. It was also learned that this Council approved an apartment development in the Golf Glen area, which will put an estimated 50 pupils into the public school system bY Jan. lst. 1967, Finally, at the school bom•g meeting July 5th. , the administrator was also instructed to purphase materials required in the Ontario Fire Marshal's report, Apparently, no publication of tenders was made. All the above-mentioned items are of direct and/or indirect concern to you as the tax collecting bqdy of this town. Tonight, you are being asked to lllake e decision on the disposition of the Church Street SchooL This involves one of three choices: 1. Grant' the requ:eat of the Sghool l:)otlrd., resulting in ·the sale . of this building. 2, Refuse to sell the building; in which case the school board may still use it, 3,· Disallow the school board the use of this building from now on. ~,., ··--.. --"~'~--··-~~--~-·"~'-"' 13TH REGULAR -4- DELEGATIONS CONTINUED: MR, JANSEN'S BR_!]E As landlord of the building, dismiss tenants from this property. the advantages of this third choice, JULY 18, 1966, Council has a legal right to ~'!e urge you strongly to weigh Although this delegation, as a whole, does not fevour a boy- cott of the school, it has come to our attention that certain parents will not allow their children to attend classes there. This could result in unfavourable publicity for our town. We feel that if your decision is such that this building cannot be used, no harmwill be done to the future development of Aurora. In addition, the ratepayers in this town vlill receive value for their tax dollars, rather than tax revenues being spent on temporary facilities that already at this time are proving to be inadequate. Councillor Illingworth pointed out that the apartment development in Golf Glen was doubtful since the By-Law had to be approved by the Ontario i'.runicipal Board, Councillor c?illiamson asked Mr. Jansen if he is a taxpayer, Mr. Jansen replied that he is. Mayor Davis read a letter from Rev, D• Jones esking to appear on the s~ne subject, Mr. Jones said that i\lr. Jansen was speaking for the delegation and that the delegation stood behind :l'lr, Jansen's state~Jent, Councillor Davis asked lAir. Jones if the School Board had given the delegation any indication whether another school would be built in Regency Acres. Mr. Jones said that the only indication was an innuendo that other plans might be in the wind, but the Board would not reveal these plans. 13TH REGULAR -5-JULY 18 1 1966. REPORTS. OF COMMITTEES Reeve Patrick in the chair Mayor Davis reintroduced the report of the Finance Committee which had been tabled from the meeting of June 27. Councillor Illingworth said he' thought most of Council had thought seriously about the problem. Therefore, in many ways th,e ,,di:;cussion that is taking place should more properly be held at .J)he meeting of the School Boarq rather than these Council Chamb~:h.s. However, this Council has certain responsibilities astQ the spending of money by the School Board, especially as :r({gards a debenture issue, I.f the municipal council does not agr,ee with a request for a debenture issue, the School Board may :reifl;i.J)St tnat the ~natter be referred to a vote of the Public School sqpp.or{cers qualified to vote on money by-,laws. If the vote is favourable, Council is required to pass the by-law. 13TH REGUUR - 6 - JULY 18 1 1966. REPORTS OF CONlMI'JL'TEE Councillor Illingworth's brief - It is important to remember that the Council merely acts as a tax-collecting agrency for the School Board. The Council cannot collect school taxes on its own initiative. It can only do so on a proper legal requisition from the School Board. The Council, however 1 must guard against being used to collect money for purposes not legally within the Boards' power. Therefore, it is justified in asking for a proper, i ter.dzed requisition. When the Board submits a legal requisition, the Council has no discretion, it cannot reduce the amount, but rather is obligated to collect and remit this to the School Board. There is the possibility as to the legality of the requisition for the costs of repairing the Church St. School. If this amount was included in the Budget which was approve(]. by this Council, then the requisition would be quite legal. However, if the 3chool Board budget did not include an amount for the repair of the Church St ,· School, it may not be a legal requisition and as such th~s Council has the ri~ht to ask for a proper, itemized account, There appears to be considerable difference of opinion regarding the costs of repairing the Church St. School, from the statement "well under $10,000 or more as estimated by the Citizens group plus the transportation costs, and I feel that this Council h.3 s every right to ask for a proper, itemized account especially when the ownership of the building is vested in the town. · As a Council other than ensuring the expenditures of the School Board are legal, we can take no action. The Courts have fiJade it quite clear that school and municipal jurisdiction are quite separate and independent of each other. V!i thin its own sphere of operations, the board or council is supreliJe, and neither is subject to the other. I feel our main concern should be the welfare and the education of our children. This is clearly the re~ponsibility of the school board, regardless of our personal feelings. As a member of this Council, I am forced toadmit tbat the problems under discussion is not 111ithin the jurisdiction of this council and that any action taken must l;Je representation to the school board or the Department of Educatton by privute citizens. Wh.ile I cannot agree with the decision of the School 3oarc1 in this matter, I feel the hands of Council are tied insofar as any action is concerned. !:3TH REGULP.R -7 -JULY 18, 1966. Councillor Illingworth's brief continued - With regard to the sale of the Church St. School to the School Board, I .cannot support the rrecom•il!ilndation of the Finance Committee until more definite information is available as to costs, but the decision whether to use the Church st. School or portables must be a decision of the School Board, and I would direct to their attention the words of the late John F. Fennedy in a speech delivered to the United States Congress February 6, 1962. ' ''The education of our people is a national investment. It is our responsibility to do whatever needs to be done to m~e this opportunity available to and to make it of the highest possible quality," He said he cannot support the report of the Finance Committee because Council does not have enough accurate information. He was surprised to learn that repairs to Church ~t. School ere already underway. Councillor :Murrey said that Council had esked a number of questions of the School Board but none of them had been answered yet. Mayor Davis said that Council had met with the School Board in the Fall and had implied that Church St. School was available to the Board as long as it was needed. Council had always supported the School Board in its use of Church St. and he could not see why tonight's discussion is taking place. He felt Council was backing away fro,,1 its duties, Coun~illor Murray said that the Mayor is misinterpreting the motion. It is not a question of Council backing the School Boord. The motion is to sell the building, and he said "no". -·--~ 13TH REGULAR -8 ~ JULY 18, 1966. Discussion re Church St. SChool continued Mayor Davis said the School Board had met with the Finance Committee. They had the Fire Marshal's report and they said it would cost $10,000 to make the required alteretions. · They said that if they owned the school they would receive grants on this expenditure. Deputy-Reeve Simmons pointed out that the building was originally a school and had been sold to the Town for $1. Councillor Davis said before a vote was taken there w~re some questions he would like answered on the future of schools in this district. 3e would like to know if Church St. is · to be used for one, two or three years and if the Board intends to build another school in Regency Acres. Reeve Patrick said that the School Board is elected by the people and it is up to them to make these decisions. Mayor Davis asked for a recorded vote. CoQncillor Murray said he would like it on record that the School Board had not met with Council but with a Committee made up of the Mayor, the Reeve, and the Deputy-Reeve. Coun~illor Illingworth suggested that siqce the Council was meeting with the School Board regarding the school site, Church St, School should be discussed at the same time. '<''C* • .:......:-> 13TH REGULAR -9-JULY 18 1 1966, REPORT LIAISON COMDAITTEE Mayor Davis presented a report of the Liaison Committee in which the Committee respectfully submit the following - MEETING WITH REPRES, WORKS DEPT. Reference is made to minutes of Council dated June 20th, 1966, in which a letter received from employees of the Works Department was referred to the Liaison Committee. The Liaison Committee met with representatives from the Works Department on Friday July 15 1 1966 at 8:00 P.M. --------------- this. All members of committee in attendance. li.fter consideration of the points raised by the representative!' of the Works Dept. the deductions and take home pay of : the employees, and prevailing rates of pay for adjacent municipalities, your committee reco,mnends: 1. That the hourly employees of the water, sewage, and works depart1aents be authorized an increase of ten cents (,10) per hour effective, July !st. 1966. 2. That a By-Law be prepared outlining the schedule of pay for hourly rated employees and job classifications. DAVIS: ILLINGWORTH: ';Resolved that the report of the Liaison committee, dated July 18 1 1966, re meeting with representatives from ::Jorks Department, be accepted and the seal of the corporation be attached hereto." Councillor Trent asked if there was money in the budget for Mayor Davis said that the Clerk had advised that money was available for this. Councillor Davis said that this £11atter should have been discussed by Council in Committee. Mayor Davis said that Council had directed the Liaison Committee to deal with this and bring in a report. ·-··-''-----~-----_;..~. 13TH REGULAR -10 -JULY 18, 1966, Report Liaison Committee discussion continued Councillor Murray assured Council the Committee had reviewed the request very thoroughly and felt that the men should receive decent wages. Deputy-Reeve Simmons said that this was political·talk. The men have had two raises in the past year. Since then one was not budgeted it could only be granted by taking something else away. Separate report submitted to Council on July 12, 1966. 2, SALE OF OLD ARENA ?~OPERTY Mr. Riis appeared before the Committee regarding the offer of purchase of the old arena property. The offer of purchase was reviewed and it is recommended that the following changes be made: (a) Sale price increased so that the Town of Aurora will received at least $35 1 000.00 net. (b) A deposit of 10% or $3,500.00 be included. WESTEiiLY PORTION OF 3LOCK "A" -GOLF GLEN A.s outlined in Council Minutes of June 20th. 1966, your Committee recommended that the request of Golf Glen Developers to convert the westerly portion of Block "A" lying west of the creek, for a single fa!aily dwelling, be referred to the Planning Board. Councillor Murray said County Council has control over their budget. Mayor Davis said we needed full co-operation of the Commission to solve this problem. Highway traffic act states that signs cannot be closer to the pavement than 12", but does not state a maximum distance, although it should be realized that if the sign is too far away it will have little or no eff2ct. P.s the Works Dept. have the responsibility of erecting signs and also snow removal, it is recomaended that they take any action required as to the placement of the signs;. (b) By-Law 1470 desir;nates Dunning Ave. , Edward 3t., Metcalfe 3t. and Berczy St. as a truck route and Murray Drive for a distance of 600 feet, west of Yonge Street as a truck route. These str2ets are tv be used as a truck route, it is essential that parking be restricted on one side of the street for traffic safety and flow of traffic. It is Dlso essential that theno parking restriction should be on the same side of the designated truck route. It was for this reason that signs are posted on the east side of :2dward Street, which brought the letter of objection fro1a Oak-Hart Manufacturing, (c) As By-Law 1470 designate Edward St. as a truck route, it is the recommen:laticn of this Committee thet By-Law 1618 be repealed so the,t Cousins 'Jrive will be a stop street and Z:dward St. will be desiGnated a through highway as stated in By-Law 1452. Our Chief of Police has been invited to serve as a member of the National Board of Directors, which ·;ve feel is a compliment to his work, and to the Town of .Aurora. The purpose of the first meeting is to map a prograiJ and policy for the Society in their efforts to aid emotionally troubled youngsters. First meeting was held in Newmarket on June 22 1 1966 and minutes of meeting distributed to members of Council.
