It is with the de0pest regret I mention this evening the fact that
a past :nember of Council, for some fifteen years, Vic Jones,
passed away recently.
Vic served his Town well and every endeavour he entered upon was
carried out to the very ·oest of his ability. I know we will -all3
miss him and his words of wisdom greatly.
I mm sure the sympathy of all of us here this evening goes out to
his family during their beruavement.

Mayor Davis read a letter from M.H. Schultz, 130 Glass Dr.
asking to be heard by Council to protest .the allowing of
a building for boy scouts and girl guides in Regency
Acres P~~k adjacent to his residence claiming there would
be a Parking problem and probably use the walkway for
autos.

"Resolved that the 72 hour notice requirements
in bv-law no. 1468 be suspsended and a
spokesman for the Boy Scouts be heard at ·
this time.71
Carried.
Scouter J. Bristow spoke for the scouts and said there
would not be any pnrking problem except
possibly two twice a year and the building site was
chosPn for easy access to to;m services and to use a part
of the Park which was not being used.
Councillor Murray said he knew of another piece of
property which could be available.

COLLECTED TO DATE Mayor Davis presented a report of the Finance Committee

The 1965 Tax bills were mailed on April 8th and I am
pleased to report that as of this date some $101,000.00
has been received.
In addition some $28,000.00 has been collected since
January 1,1965 on outstanding tax arrears.

Mayor Davis presented a report of the Council in Committee
in which the Committee respectfully submit the following:
Chief Constable WmJ.Langman met before members of council
and discussed several items relating to the operation
of the Police Department, and also the resignation of
Police Constable T. McClenny.
It was duly reeommended that the letter of resignati.on
from constable McClenny be accepted with regret and the
Police Committee of Council arrange for placing
advertisements for the hiring of a replacement.

Council members met with Mr. Wilson of the Reliable

Council meeting on Monday, April 12,1965 pending the
submission of fUrther information requested.

This letter concerned the following three suggestions:
1. That the Jlurora Rrena Board (which included 2 members of
Council) be given sole permission to enter upon all negotiations
pertaining to the sale of land and the contents th.~rein, of
the site of the Aurora Memorial Arena, after all present
insurance claims have been finalized,

council be informed at all times of any negotiations taking
place.

the sale of the land in question, and the purchase of

Board through it's manager , E.A. Batson, for futher
negotiation.
It was recommended that a letter be forwarded to the Aurora
Memorial Arena Board thanking them for their interest anli.
Thoughtfulness but it is felt • that all business relating
to the above mattes should be channelled through town
Council via the Town Clerk.

ConnnitteC' in which the Connnittee respectfully subr.~it

The Police Cor.Jr.Jittee met to consider tend.ers roceivei
for the purchase of an electric 'J'ypevri ter for the
Police Office.
Two tenders received -Remington at a cost of $504,00
Underwood at a cost of $408.00
The committee therefore reconmends that the Undervood
Typewriter, at a cost of $408.00 be purchased.

that the C:JL>-_dttee had considered the request of
Hr. Cr·abtree under by-law 1051 sec. 7 (d) 1 (b) to req_u!.re
a buildinG on George St. to be set back to a line which Le
claimed had been established by the positon of adjacent
buildings. The co~mittee decided that as the jog in George
St. at Dodie St. has caused this problem and considering
the laws lying part of the lot and the req_mirements of by-l~w
1085 for this area, it is recom'llended that a set back line
of 25 ft. from the curb line would be reasonable.

problem if building was further back.

Reeve Patrick, Councillor Illing~wrth, Clerk Johnson, and
Building Inspector Jubb, attended a 3pecial conference convened
in the Hestbury Hotel, Toronto, on the 18th March 1965, to
consider implementation of changes between J?lanning Boards
and Committee of Adjustment.
Mr. Don Taylor, Director of the Community Planning Branch of
the Department of Municipal Affairs outlined the agenda for
the meeting' and read the following quotation from the state-
ment made in the Ontario Legislature on 12th FebrualJT, 1965
by the Honourable J. W. Spooner, Minister of Municipal Affairs.
The major purpose of the amendments in question was to relieve
Planning Boards from the resronsibility of <'lealing witr.
applications fJDr consent to sales, mortgages or long term
leases of lands located within areas of subdivision control
designated under Section 26 of the Act and to transfer
authority for the granting o. such consents to the local
Committee of Adjustment, or in certain cases, the Minister. It
is ~onfi.dently believed that by relieveing Planning Boards of
what was essentially an aQministrative function, they
would be enabled to deal more effectively with their primary
resp•nsiblity which is advising their respective municipal
Cuuncils and :other local authorities on increasing pressing
and complex problems -~f planning the future development of
their communities.
The granting of such consent is in effect the granting uf a
special exemption from the subdivision co.ntrol law and
should be used only in individual cases to preVei1t
unnecessary hardship to an owner where under the circumstances
registration of a plan of subdiv~sion is not warranted.
Lm:al Committees of Adjustment, ;1hich are really local
administrative tribunals, would appear to be particularly
well qualified to handle operations of this type in substant-
ially the same way as they have been dealing with applications
for exemptions from Zoning By-laws.
In addition to putting Planning Boards in a better position to
perform their principal duties, the coming into force of the
amendments which I have referred to will correct t-r.> defects
in the ex~sting arrangements for granting these consents. The
first of these concerns the power of the consent-authority to
impose conditions when granting a consent. In order to se,fe=
guard the interest of the Municipality and its tatepayers there
should be the same power to impose reasonable and proper
condi'ions of r aprroval, dependent upon the circumstances
in each case, and subject to the same right of appeal.

The second tiefect in the existing procedure 1ms that o~:Ly the
applicant for a consent to a severance was given a right cf
appeal from a decision of che Planning Board refusing a
consent or imposing con<Utions of g,pproval to which objections
were taken. It was becoming more apparent that there were
many situations where another intPrested party, perhaps a
neighbour or even the municipal corporation itself might want
a consent decision to be revie1;ed on appeal by a higher
authority, similar to the present appeal to the Ontario
Municipal Board from decisions of the Committee of Adjustment
on Zoning matters.
During this period the government has also given careful
consideration to the objections which have been submitteti :Cl"om
various sources ~n respect of this legislation. All of the
objections had in part been presented and thonoughly discussed
during last year's session of the Municipal La;r Committee.
Many of the objections appear to have been the result of a
fundemental misunderstanding of the proper functions of
Planning Boards, and the need for a substantial revis~on of
the existing legislation.
Mr. Taylor then introduced Mr. E. Gemme, Mr. K. Bain, and
Mr. G. adams who described the role of the Committee o'" Adjust-
ment, explained the ne1f law ar.d the Pew prodcedures. It was
stated that the granting of a consent is a priviledge and
not a right. Each case must be considered on its own merit and
it was the responsibilty of the applicant to prove the nne<i.
It was also stated that it wac the responsibility of Co~~ittee
of Adjustment to bring any deficiencies noted in a by-law
to Council 1 s attention. The decision of Committee of Adjust-
ment is to be passed to Council and Buildinr; :':nspector a:1d
a time limit should be placed on decision (e.g. 6 month-
North York) A Summary of information received is as follows;
After May 3rd.l965, consent granting power passes to Committee
of Adjustment, vlhere there is ao Committee of Adjustment,
power passess to Minister of: Municipal Affairs.
Committee of Adjustment may charge up to $25.00 per application
Funds received from applications should be turned over to
Council. Council may provide for the compensation of members
of Committee of Adjustment. Committee of Adjustment must
adopt new rules of pro '.cedure and have same approved by the
Minister.

Committee of Adjustment required to send notice to owner·s
with 200 feet of land or building in a zoning adjustment,
and in consents to ·01mers within 200 feet of arry lots
separated, or any remnant 1:nder 10 acres, at ::.east 10 days
prior to hearing.
Coillffiittee of Adjustment should not
hesitate to impose condi tons on their approval.
Enforcement of Com.mittee of Adjustment conditions is t!1'
responsibility of the Council. The agreement resulting
from Committee of Adjustment conditions should be executed
between Council and Applicant. It is suggested that
condittons be registered against title to serve notice to
subsequent owners of Committee of Adjustment requiremeuts.
While a Committee of Adjustment is required to hold a hear-
ing within 30 days of ;receipt of an application, they n~ay
defer thei•c decision. They are required to give a written
decision setting out their reasons for such decisions.
It is recommended that all submissions given at a hearing be
incorpora.tred into the minutes. This procedure •·rill save
making a separate submission when forwar1ing application to
Minister.

fore recommended that until Mr. Muirhead can give us an
answer that this matter be held in abeyance.
Councillor Illingworth verbally reported that Planning

re-activate the Aurora Orchards subdivision plans anl th;o

possibility of increasing our assessment and recommend

back the earth on the west side of the ditch, for the last
two years this wall has been gradually tipping, c.nd f;.n."C.ly

time and money to repair the wall.
