I_ -9-FEBRUARY ~' 1962 Letter from the Town Solicitor, • _ T. McPherson enclosing a letter addressed to him from Donald M, Findlay Q.C. as follows: This letter is for the purpose of reporting to you and, as may be necessary, through you to the Council of the Town of Aurora upon the result of the motion at Osgoode Hall on Wednesday of this week, This was a motion launched by Mr. James Murray seeking an order of the Supreme Court to quash the resolution of the Council of Aurora made on January 8th, 1962 which requested acounty judge's enquiry into a matter occuring during the last election for council. Provision is made in Section 241 of the Municipal Act to enable Municipal Councils to request enquireies to be made by county judges and this occurs from time to time. Precedents in the courts in previous years have established that such an enquiry can be made into election events. The resolution in the present case requested an enquiry into a sin~lP. incident during the polling at the last election. Mr. Murray's application was made on the claim that such an enquiry cannot be convened respecting a single incident. On Wednesday, the Supreme CoUrt judge agreed with this contention and quashed the resolution of council, but without awarding costs to the successful applicant. This is an entions of the existing law on the subject which, I am convinced, would not be confirmed by a higher court if it were felt practicable to take an appeal. This is not to say that I am recommending that appeal be taken. It is for the council to consider the matter from a practical point of view but two observations may be of as*istance on that aspect of the matter. As I understand the origin of this matter a few weeks ago, council felt there was a body of opinion compelling it to take steps to clarify the matter if any steps were available, 4TH BEGUT.AR AURORA ENQUIRY ,;'·':'·'<\ '•-<.._,.:.-' r~-, "'""'.;.. I <-J !9 -10-February ~ 1962 There wer other steps which were open to individuals but the only step available. to the Council was the one of making a request under Sect 241 for a judge's enquiry. The council has attempted this step but · this has now been ~ ruled out by the Supreme Court Judge and council may feel that it has fulfilled its responsibilities as a council And council may also feel ·: that the inadvertent and inmotion may have provided sufficient clarification of the incident concerned for all practical purposes, Press reports of the hearing on Wed. :nesday made some mention as to whether Mr. Murray did or did not vote in favour of the council resolution on January 8th. This question was only relevant to the point as to whether 1~. Murray was disentitled to be the applicant on the application to the Surpeme Court on the grounds of inconsistency, That was not the most important consideration on that hearing because a ruling on that point would only have been a question of procedure and not a ruling on the basic question in issue, The question of legal and other enquiry costs has been the subject of local speculation, I might be able to assist in putting this into perspective. The witnesses had been subpor:med and tne legal preparations had been . completed and everything was in re_adiness to proceed on the appointed day o:(\.:. January 30th, It was at this sta·~;,;q on the eve of the sitting that Mr. ~;•s. motion to quash was served, upon tho· · strengh of which his lawyer obtained ari adjournment at the opening of the enquiry on that date, In the result a substantial part of the anticipated costs of the enquiry have been incurred as well as the Town 1 s own costs of the proceedings at Osgoode Hall. CHILD: CORBETT: "Resolve that this letter be filed," ¢ouncillor Murray stated that one of the statements made by the Judge was that the Town may now settle down to important business. Mayor Nisbet stated he felt Council had to do something or else they would have been criticized, Councillor Child stated he did not thing everyone is satisfied and he was not satisfied and while the learned Judge may know important business he was not ina a postion to say what is important in the Town'of Aurora, Reeve Davis stated this matter was duly resolved by the 1961 and 1962 Councils and thats it. · ·· · Deputy Reeve Stoddart felt the facts have now been brought out and the public will read this expl~nation and he was loath to carry it to a higher court, The motion was then carried, Councillor Murray sted he was not quite clear in this matter and if this was the end of it, Councillor Child stated these are the only steps we can take, DAVIDSON: MURRAY: "Resolved that Council do not appeal the ruling of the Supreme Court," Carried, --·--------·----. ----·· r l"'"' " I 4TH REGULAR DELEGATIONS REPORTS.OF COMMITTEES TOWN ENGINEER AND WORKS DEPARTMENT 4 -1:!-February 19, 1962 Mrs. E. Buck appeared before Council concern- ing the matter of a local bus service and a bus shelter at. the entrance to Murray Drive. Mayor Nisbet advised Mrs. Buck that the matter of a local bus service had been referred to the Services Committee for study and further that Council would petitiOn the Grey Coach Lines for the erection of a bus shelter. Mrs. Buck stated she understood the enquiry haring was quashed because Council did not ask for the proper resolution and it should be maaeclear to the public that their consel was not misleading. Mayor Nisbet said Council took the stand they did and the type of enquiry requested was to bring out all the facts. CORBETT: '!Resolved that the Town Engineer DAVIDSON: be placed in charge of the Town Works Department, under the Works Committee and that "his office be located at the Works Building and further that this arrangement be reviewed subsequent to a six months period. Councillor Murray spoke to this motion and referred to it as double barrelled in that he felt it was proper the engineer be moved to the Works Building to be closer to the work he is engaged in but that he was not in approval of placing him in charge of all the Works Department. Reeve Davis stated one reason he is supporting the motion was because at various times there is no one at the Works Department and therefore the public are unable to get in touch with anyone and this new arrangement would relieve council and ot}).er deparmo·nts of nume-rous calls., /'~' 4th REGULAR REPORTS OF COMMITTEES TOWN ENGINEER AND WORKS DEPARTMENT SKATING RING LIGHTS RENTAL POLICE CRUISER -13-February 19, 1962 Mayor Nisbet stated there would be some problems involved but felt it could be worked out, Councillor Jones requested the Town Engineer to speak to this, The Town Engineer stated he should have been allowed to attend the committee meeting where this matter was discussed. The motion was then car~ied• Councillor Murray reported that subsequent to a request for lighting at the North end skating rink, he· ilai"d the next dfl.-· following the poles were erected and were . · .. followed by the lights. Councillor Davidson presented the following report of the Police C~ittee: The Police Committee met on Frebruary 2, 1962 and discussed the subject of tenders for police cruiser ~ental in 1962, The Committee decided to accept the tender of M,S, McPherson Motors Ltd, at a monthly rental of $195.00 for one year on the ·following basis, 1. Tender for one only full size car, two door. 2. No mileage limitation, 3. All repairs and maintenance paid for by the dealer,. 4. S~cial insurance including passenger hazard paid by the dealer. 5. Car provided by dealer to police when cruiser in for service, 6, Cruiser to have automatic transmission, heavy duty springs, shocks and seats, windshield washers and heavy duty generate~. 7. DAVIBSON: CHILD: February ,9, 1962 "That the report of the Police Co:rnmtttee dated February 2nd, 1962 re Police Cruiser Rental be accepted and the SeaJ. of the Corporation be a tt'ached hereto •" Oouncillor Child stated he had one comment to make concerning thi~? matter and was afraid he was responsible for the itpm regarding the replacement of tires, Councillor Child reported a tender had been o'r'iginally, received from Macpherson Mo~ors for $186,00 monthly including all tires and tenders had then been requested from other dealers in Town and the item re tire replacement ins•rted to attempt a lower bid, Subsequently a letter was received from Macpherson Motors saying no one else is interested~ in cruiser rental and the price would now be $195.00 per month, Councillor Child stated he took exception to his raising the fee $9,00 per month and felt Mr. Macpherson should be made aware of this and that he is gough:!ng us.·· Also· that he has us over a barrel and took advantage since no other one in Town would tender, Councillor Murray felt the remarks are Councillor's Child and not hi:a, The motion was then Carried, Councillor Moffat reported that two very long by-laws are still being studied, .J. and that they are not ready for presentation as yet, Councillor Child presented a report of the Planning Committee as.follows: The P&anning Committee met on Monday, v- February 12, 1962 and considered the request of Mr. G. Ilkiw, 156 Centre Street, Aurora to construct a dwelling on the north half of lot No 107 1 Plan 246 and to divide said lot for this purpose. 4TH REGULAR -:US-February 19, 1962 The Committee recommends that this request be approved provided Mr. Ilkiw adheres strictly to the follow stiputlations: 1. When lot is divided, a survey of same will need to be registered showing lot dimensions, and that each lot has a minimum of at least 5,400 sq. feet, 2, When new house is constructed 1 it must have a minimum set back of 15 feet from the right-of-way, This to conform with the Towns land Use By-law Number 1051 1 Section 7 1 Item (d) Par, (1) a and b, just the same as if the right-of-way was a street, This will mean moving present garage bavk a minimum af 15 feet from right-of-way, 3, That new house when constructed 1 be po si tidmed on lot, so as to conform with Land Use By-law 1051 as to side ysards, Also when lot is divided that the present dwelling be left situated in full conformity with By-law 1051, as to side yards and set backs, .·.·' 4• A septic bed will not as per Town By-law 1326, property to the north has dwellings; be considered, as services are available The 1 inch water line servicing the not the capacity to supply any more Connection'to water and sewer services will have to be made at Centre St, Therefore it will be necessary to register an easement ~or these services over the south lot, when dividing, as services cannot be put up the right-of-way, 5. SESTON RESIGNATION CENTENNIAL COMlVIITTEE UNFINISHED BUSINESS TREE PROGRAMlVIE -'lLE-February 19 1 1962 Mayor Nisbet reported that subsequent to the house fire sustained by the Campsall family on Spruce Street he had taken if upon himself to call upon certain Town people to do something to help them out and that the results had proved enormous. Mayor Nisbet said he would like to commend everyone who had anything to do with it. Reeve Davis expressed thanks to the Aurora Fire Department personnel and to the neighbours who had supplied the firemen with coffee etc, during the fire on one of the coldest nights this year:. Mayor Nisbet read a letter from Mr, H, Seston 1 stating that due to doctor's orders he must resign as Chairman of the Aurora Centennial Committee, Mayor Nisbet publicly thanked Mr., Seston for a job well done and expressed Council's best wishes. Carried, Reeve Davis asked the Chairman of the Works Committee how the tree programme was coming along' and Councillor Jones replied.quite a few tre(ls l::J.ad been. done although ;there were quite a few still left to do,· A:Lso that an agreement re tree cutting and trimming had been arrived at with Aurora Hydro, Councillor Jones remarked that a large.elm on Catherine St. east of Spruce St. should be i taken down and requested Council's authority to so do, Thetree was located on town property, STODDART: DAVIS: "Resolve that'this elm tree be taken down. 11 Carried, -< 14 TH REGgLAR PARKS BOARD • ,.~,\ ! -j) , . .,. February 19, 1962, Coucillor Corbett stated that at the last meeting he had brought in the matter of discontinuing the Parks Board and set up a new arrangement~ CORBETT: DAVIDSON: "Resolved that the present Parks Board be discontinued now that a Parks Committee of Council exists."
