DAVIS: 'STODDART: "That the minutes of December 5th. and 19th. 1960 be adopted -·a.s .printed;" Carried, ''""\ CORRESPONDENCE ; ~· ·~· An invitation from the Mayor of Newmarket inviting Aurora Town Council to their inaugural Meeting to be held in the Town Chambers on Monday, January 9th, 1961 at l:i.OO P.lVI. was read. DAVIS: "That this letter be acknowledged and STODDART: accepted and all of Council attend that are able to do so." Carried, A letter from the Ontario Water R~sources Commission explaining that Central Mortgage and Housing'Corporation are nowprepared to loan monies at an interest rate of 5 1/e percent and to forgive 25% of this loan on work completed by March 31st. 1963 in dealing with loans for Municipal sewage treatment projects was read. CHILD: JONES: "That this letter be referred to the Finance Committee and Property Committee." for study." Carried. A letter from Collis Leather CQ.\. Ltd. regarding sewage rental cost and stating that they are compliling data which they shall.be· pleased to discuss with Council at any time was read. DAVIDSON: CORBETT: "That a meeting between Council and the Collis Leather Co. Ltd. be arranged as soon as possible to deal with this matter." Carried. H. J. Thompson, Solicitor, Town of Aurora applying for the position of Town Solieitor was read. CHILD: HAI1il1VIO ND : "That this letter be referred to the Finance Committee for st~dy and that steps be taken to advertise for.the· position of Town Solicitor." Carried A letter from the Ontario Good Roads Association regarding resolutions to be forwarded by Municipal Councils for the 1961 Convention to be held on February 20th and 22nd 1961 was read. STODDART: CHILD: UNFINISHED BUSINESS "That this letter be referred to the Works Committee for study and report back,~ Carried. Reeve Davis brought forward the matter that in the precedding month J\lf.r. S, J, Kelner had requested the release of the .. Gontractor 1 s .Bond and explained that the Contractor had become bankrupt and 1~. Kelner requires the bond back in order to force completion of work in Sunnybrook Subdivision. It was decided that a Council of the Committee of the Whole meeting with Mr. S.J. Kelner be arranged and that a legal representative attend this meeting on behhlf of the Town. In this connection the following re,port concerning Assessment Appeals by Sunnybrook Subdivision was read Suunybrook Investments Limited appealed land assessments in Sunnybrook Subdivision, Aurora in 1960 with the following results, Court of Revision, Town of Aurora -Assessments sustained, Block A -Land assessment reduced by County Judge decision a total of $2, 61/:l, 00, Block B -Land assessment reduced by Coun0y Judge decision a total of $662,00. Lots 1 to 70 and lots 201:3 to l11:l inclusive, land value reduced by the Ontario Municipal Board decision from $14.00 per foot frontage to $12.00 per foot frontage approximating a reduction in assessment of approximately $12,000.00 In ~ddition to the forgoing reduction in land assessmentsthe. On't.:;J.rio Municipal Board hearing fees charged to this municipality ~ted to $469.00. Finally the assessment for 1961 taxes was appealed and Block A land assessment was reduced by County Judge decision a total of $7' 161. 00 It is worthy of note that the County Judge allowed no further reduction • appealed in the case of lots 1 to 70 ann 201:3 to 211:l inclusive and Block, B. · · 1ST REGULAR ,-4-JANUARY 3, 1961 The appellant of course had the right of appeal from the County Judges decision to the Ontario Municipal Board as was the case in ]960; The appellant based the forgoing appeals mainly on the fact that the lands were sterile due to equalization of assessment factors : contained in a subdivision agreement and further that the appelland ·.]· .·. · had been unsucessful in attemps to produce commercial and or ' · · industrial assessment in Aurora to maintain a desired balance, ' and further that recently the appellant had offered to donate certain Blocks at no cost in order to obtain release of the balance of 'building permits. It was decided that this report was to be kepton hand to be brought forward at the meeting to be held with !VIr, Kelner, Reeve Davis stated desire to have a Police meeting with the Committee of the Whole of .Council with regards to the 40 hour week and it was decided that such a meeting would be arranged this week, Councillor Davidson brought forward the matter of the water main on Wellington St, E. and felt that Toronto York Roads Commission should be notified that they contact the people who own it rather than the Town with regard to the expense of relocat.ing· this main. DAVIDSON: STODDART: "That a letter be written to the .Toronto and York Roads Commission requesting they contact the owners of this private watermain in connection with cost of its relocation," Discussion followed this motion and the mover and seconded with;lirew the forgoing motion, CHILD: HMIITI1 OND : "That this matter be referred to the &forks Committee for study and report back," · · Carried. !VIr, S, Murray, town engineer reported on t):le pase of Regency Drive and Consolidated Building Corporation of dated December 6th, 1960 -, ; . and advised that the matter had been ka« left in the Town Engineer's hands to meet with Department of Highways representatives, subdivider, and their· engineers. !VIr. lVIurray advised that a meeting had been scheduled for December 22, 1960 arid that the Department of Highways representatives had arrived at 2 p.m. and left at J,p,m. !VIr, Thomas the Engineer for Consolidated Building Corporation arrived after 3. p.m, and advised that his ~ximi principals were not interested in meeting · with the Highway Officials until a legal requirement had been finalized, .1 . I . ),.-! 1ST REGULAR -5-JANUARY C!_) 19 61 Deputy Reeve Stoddart stated he was at this meeting and had sat in with the engineers from the Department of Highways and they recommend that the road grade crossing be brought up to the proper levels. Councillor Child stated this meeting was brought about by the members of the 1960 Council and the±e was an impression that the industrial area did not come under plan 514. However the whole area was all registered as plan 514. The subdivision agreement referre to the fact that B6 foot roads shall have certain specifications and specifically outlines that Murray Drive shall be B6 foot roadway however the registered plan shows Regency Drive as an B6foot road and I maintain that it should have specifications in accordance with the·B6 foot road requirements. Councillor Child recommended that until such time as a decision has been reached on the appointment of a Town solicitor that this matter be held in abeyance. Reeve Davis stated that we must be careful to provide. proper easement crossing for Sterling Drug Company since the road levels might be established whereby an elevated crosming over the raad woul'd be necessary. Councillor Davidson stated that Regency Drive will be serving the whole area and therefore a good strong road is required, Councillor Child stated that they had aesired to construct this road with Class "A" or Class "B" gravel and the Town Engineer had recommended a stone base road. Reeve Davis stated that Consolidated Building Corporation state that the Town is holding up the building af a bowling alley and Councillor Child replied that th~ only with water and sewer services and until they know where the road and depth is to be they cannot ser~ice it. Councillor Child stated it was advertised recently that the bowling alley does not intend to be in operation until next Saptember and not immediately as suggested. Deputy Reeve Stoddart stated that the Department of Highways representatives had said this is the first time they have been called in to a municipality to approve a road before it is built as usually they are called in to approve a road after .it has been built and then may have to turn it down because of specifications and further that· the cost in the difference of the gravel requirements is very little, Town enginaer Mr. Murray asked Councils permission to hold up approval of their plan until the legal matter is settled and further that the issuance of building permits in lllhat area be held up till the services have been approved, Councillor Child explained that the location of the road is now okay since the planning acts states that a road shown on a registered plan may be relocated by motion of Cibuncil if approved by a County Judge l>!i:l!! and this approval had been carried out. ,~, 1ST REGULAR -6-JANUARY·~, 1961 Councillor Davidson asked the Town engineer if ani progress had been made regarding the payment of the ~ of 1 % Engineering fees and the approxim:ate $7,000.00 holdback with Consolidated Building Corporation. The Town engineer replied that their engine'er had prepared ax statement outlining these figures and had g~ven this statement to I~. Shankman who has not yet forwarded to him • It was decided that a letter be fo~warded to Consolidated Building Corporation Ltd. requesting that they straighten up the account _ outstanding with tP.e. Town and present their counter accounts . : "] for our approval and that :th.is letter be signed by Mayor Nisbet'. I ' -../ Councillor Hammond stated that late in 1960 it.wasrequest~d that Sand boxes be placed at the corner of Yonge and Wellington Streets so that sand may be spread at the intersections to·. assist reside~ce in Town an in crossing, Thtr. Browning, Town superintendent advised that a barrel of sand b,ad been.placed on the corner of this intersection. Councillor Davidson reqv-ested that a barrel of sand be placed at the top. of Tyler hill also,,' Mayor Nisbet brought forward the matter of residenUin the Town shovelling snow from their sidewalk in the winter time. and lYJr. Browning replied that a notice to ths effect would be.:. placed in tbll. paper. Councillor Moffat stat~d that. we appeared to~ have slipped up badly in enforcing this by-law regarding re!iloval of snow from EiliRRXk sidewalks where. it states that if not•: shovelled by the owner then the Town would clear same and charge accordingly. Councillor Moffat then inquired if it would be possible for the snow plows to clear snow from the sidewalk and Councillor Jones replied that some sidewalks ;in Town are not sui talll.e for plowing. BY-LAWS MOFFAT: JONES: "That leave be given to introduce a by-law to appoint trustees to the Aurora District ;High School Board and that the same be now read a first time." Carried, The By-Law was then read a first time, DAVIDSON:. HAMMOND : "That the by-law now before the Council be read a second time that the Council resolve itself into a Committee of the Vf.r;(:lili for that Purpose." Carried, Committee of the Whole Councillor Moffat in the chair read the by-law a second time and the name of Dr. J.L. Urquhart was inserted in Clause 1 to be appointed a trustee to serve for the years 1961 and 1962 and the name Dr. E. J. Henderson was inserted in Clause 2 to be a:ppointed a trustee to serve for the years 1961, 1962 and 1963. Carried. The Committee arises and reports progress. All in favour of the second reading of the by-law. Carried, "That the Finance Committee be authorized to arrange for the appointment of an assistant to the Clerk at the earliest date possible, such. appoint~ent to be on a trial basis." General discussion to this motion took place as follows; Reeve Davis stated they agreed with the foregoing motion and mentioned that an interview had been held with a gentleman with . ~leven years municipal experience • Mayor Nisbet stated that this .. i1 lltatter had been under discussion for some time. €ouncillor Stoddart · felt that the trial basis with regards to hiring'of staff is proper and if they RFprove capable after the trial period the appointment may be made permanent; Councillor Corbett stated that the ~- gentleman shoUld be advised that it is on a trial basis • Councillor Hammond stated that there is no doubt that the Clerk needs EMMR an assistant but but that the position should be open for application an~ felt we should take advantageof receiving as many application as possible. Councillor Child stated he disagreed with Councillor Hammond and stated that we advertised last fall although not for this particular position and received a number of applications for Town Clerk and the individual now applying applied then. Councillor Child stated . he felt if we are able 'to attain some one from the applications we received for the Clerk's job we are obtaining one with municipal experience and felt that the man in mind would be quite an assest. Councillor Hammond Stated that so as not to create a false impression he had nothing against this particular person and it was just a ,~ principal involved and further did not see why we could not accept ' . 1 · a bid for this particular position, 1--...o ~ '. 1C '·- ,......,.,~ l L .... 1ST REGULAR -9-JANUARY 3, 1961 ·d' Deputy Reeve Stoddart stated that it was an assistant to the Clerk not for the position of Deputy Clerk. Councillor Moffat inquired if the gentleman in mind is available and Deputy Reeve Stoddart stated he would be available in one months time. Councillor lV!offat inquired if any figure had been determined and DeputyReeve Stoddart stat.ed that there was not more then $4,000 involved. · Mayor Nisbet stated he had met this gentleman and was impressed with him and his experience might be applied to ihe position immediately if he is employed and that Council must set policy and it is up to the Town staff to carry out our work. Deputy Reeve §toddart stated he· would like to see a local man appointe but don 1 t know of one that ha s had municipal experience and further that this gentleman in mind has the required experience and this is a big selling point, Councillor Jones stated he agreed with Councillor Hammond in principal but will withdraw any objections since sereral of the Council.members have interviewed the gentleman and are satisfied with his qualifications, Councillor Moffat stated that we would be obtaining a metter man this way rather than placing an advertisement for an assistant to the Clerk, The motion was then carried, Reeve Davis. stated that we have now fo::r~.ed, an Industrial Committee 'composed of three members of the 19,61 'Cpuncil and that a letter had been received in 1960 flll:x from the Board of Trade asking for ·~meeting an~ felt that a meeting should be held as soon as possible this ~ar. DAVIS: CHILD: ·' ' '"That a letter be forwarded to the Aurora Board of Trade requesting that 'they provide three members to meet with three members appointed by Council to the Industrial Commission and these members may appoint a chairman," Councillor Davidson stated that this was a fNNNmlii:N good move and that we should attempt to get it moving as fast as possible while the present subdividers depression last, Councillor Davidson further stated that he felt our late Mayor would be suitable for a member. • · The motion was then carried, Mayor Nisbet stated that every perso.n in Town should form part of an Industrial Team and if any person hears any word of prospective .Lndustry they should pass it on to this Industrial Commission, ', ;,; 1ST REGULAR -10-• JANUARY 3, 1961 Reeve Davis stated he would suggest that the Finance Co~mittee name two nights a month to go Financmal Statement and analaysis and report back to Council in this matter, Mayor Nisbet brought to Councils attention that the main office in the Town Hall is in adequate and inconvanient with no place for large tax rolls etc, to be placed, Mayor Nisbet stated . he would like to give permission to the Property Committee to study this problem. il CHILD: STODDART: I \.NJkay "That the Property Committee bring in a recommendation for this renovation." Carried, "Mayor Nisbet advised Council that a report was in front of him this evening from the Ontario Water Resources Commission being a study on the water supply and water treatment requirements of the Town of Aurora. DAVIS: ·STODDART: "That this report be referred to the Works Committee for study and report back to Council." Town Engineer Mr. Murray requested permission to issue this report out to the same committee that the report regarding. sewage treatment went to so it may be handled in the same way first. Richardson, be appointed to study this report and report back." d Carried. 1\~ayor Nisbet expressed his thanks to anydne having anything to do with the Inaugural meeting and to Councillor Mrl:!• l\Ioffat for preparing the list of guests. Councillor Jones inquired should the proceduare by-law be changed because of change in Committee set ups and was advised yea and that copies of this procadure by-law be available for each member of Council. Mayor Nisbet brought i;o Councils attention that accounts are paid the second meeting of each moll!th and felt that the accounts should pe gone over by Council members before they are brought into the Council meeting • Councillor Child stated that some time ago a purchase order system was inaugurated in the Town. Councillor · Child stated he felt we should be oonscious of the fact we have a system in force and it should be so enforced and referred to Committee Chairman for their approval. ij .r~ r j 1ST REGULAR -11-.JANUARY 3, 1961 ' Councillor Child stated if everyone was aware of the fact that purchases have been approved by Committee Chairmans then it would ~imp~ify matters when the accounts are presented at a meeting.
