REGULAR -5-August 15th. 1960 CORRESPONDENCE A letter from the Fire Chief, Aurora Fire Departmelllnt requesting Coundl!!i.l grant an additional sum of $150.00 in addition to.the $150. set .. in the 1960 budget Bor the .convention expenses of the .Canadian Association of Fire Chiefs was r~aad. · · Reeve Davis mentioned that this request was submitted by the fire chief who asked that it be considered. Reeve Davis stated that he had advised the Fire Chief that this additional amount wa11 not in the 1960 budget and had further advised him that the amount of money f'or travelling for the Fire Chief was the same •as the Polic'e Chief. Reeve Davis ·stated the . difference was that the Fire Convention.· is to be held out in western Canada and advised him that it must be at Councils permission if it was not in the budget. CORBETT: "That this matter be referred to new business." PATRICK: Carried. A pe.ti tion from residents of Dunning, Cameron and Wenderly c;:oncerning the matter of the. pavement of Dunning Ave.·was read. MXayor Mtirray advised that he had be.en in touch with Beamish Construction lastweek and they had k subsequently found that the road was not the right width and wereli working on this now and will be paving ve'I!y shortly. · · A letter from the Township of Whitchurch requesting the Council of J the Town of Aurora to consider entering into a utility agreement to supply the water and sewage disposal to premises that would contain a Canadian Tire Corp'n store and a Bowling Alley Adjacent to the southern boundary of the Town of Aurora was read. This letter was referred to new business. A letter from the city of St •. Catharines coneerning the motion regarding the est~blislilent.of a .. C.anadian Flag was read. Mayor. Murray stated that he did not know ·that \Ve as Council have any right to c'oncern ourse'l'f'es in t.he .mat.ter of a new flag sincll it is a national institution • Councillor Hammond felt that it did not come under the realm of Town Business. CORBETT: "That this letter be filed." PATRICK'! Carried. A letter from Regington Rand Limited regarding a new roof repairs to the old public school building was read. This letter was referred to-Committee repoarts. A letter from the Arena Restaurant, Yonge St. s., regarding improvements and changes to the property and specifically the matter of a drain across the bavk of the property was read. This letter was referred to the Property Committee for study and recommendation. 16TH. REGULAR - 6 - August 15th. 1960 A le~ter from Aurora HeightsLimited advising Council that the sale by Auora Heights to Auora Tank & Welding has been Completed. That the transaction between AuoBra Heights Limited and Scott Annan has been .. completed. That the amount ,disputed for local impa:p•ll improve!'imts will .be resolved at the. next Bozmd of. Directors meeting of Aurora Heights Limited and the purchaser willbe reimbursed of the rightful amount owing to h1m. And finally the Petlovany deal will be closed •his week was read. . ' This letter was referred to unfinished business • . A letter from the Lions Club Newmarket, Ontario requesting Council to cons.ider a grant of $1000. to assist. in their efforts to establish a school building acc.ommodation for retarded chi«ldren was read• CORBETT: BELL: "Referred to the Finance Gommittee for investigation and a report back to Council." Carried. A letter from the Ontario Department of Highways advising.the Town of Aurora that the Agreement signed in connection with the purchase of .Property at the south end of Yonge St. in Aurora was read. PATRICK". HAMMOND: "That thi.s letter be filed." Carried. REPORTS OF COMMITTEES Councillor Corbett presented a report'of.the Property Committee · regarding the roof. of the Remington Rand Building in which the Committee reppectfully submit the following: CORBETT: PATRICK: " The Property Committeemet on August. 10, 1960 to im,1pect the roof Of. the Remington Rand building and subsequently found same in need of repair. The committee therefore recommends that JacksonRoofing be au:bhorized to J:?epair the roof at a cost of $244.00." "That the·report of the Property Committee re the repairing of the roof of the Remington Rand Building be accepted at a cost of$244. and the seal of the Corporation be attached hereto." Carried Councillor Stoddart,reported to Council *hat a.letter :f received previously from a Mr. Thompson of Hampson Paper Box of Aurora concerning damages.to,his ear sustained·on aTown Street had bee:m referred to the irisurance compwiy and. a representative from this Company was coming to Aurora on Thursday of this we:lrk to investigate this claim. -~""---, .L 16TH. REGULAR -7 -August 15th. 1960 Councillor Davidson reported that the Works Comniittee had held a meeting concerning the new well at the north end of Town and that all members were present but two and further that a reasonable solution hadbeen arrived at in this matter and requested the Town Engineer to report on the new well. The Town Engineer advised that it had·been decided to put a :tpump on the new well and pump into the mains directly. The Town Engineer further stated he was to look at the job to-morrow morning and following this would ask Council to authorize the appropriate expenditures. 'Mayor 'Mur:flay inquired how much money is he talking about to place this well into the 1 system and the Town Engineer replied approximately $10,000. Reeve Davis stated that we are not in a position to talk cost until the pump has been seen and this is only a rough estimate. Reeve Davis further stated that a further meeting is required to finalize this matter. Councillor Bell requested that a By-law Committee meeting be held this coming Wednesday night and it was subsequently decided to also hold a Parks meeting and a Planning Committee meeting on the sam~ evening. · · Councillor Child reported regarding the Planning and Permits Committee regarding an application for,a bu;i.lding .to be constructed at the south end of Town and that this permit had been held over previously until the present Industryloc!'ted in this. area had made up their mind if tl.rey desired more property in this locationor no.· Councillor Child stated that he had phoned a Mr. Row and they had stated they were not interested at the present time and 4urther that he had not received a reply from Consolidated Building Corporation Limited. Councillor Child stated that on the previous Friday he had received a call lilrom 'Mayor 'Murray inquiring ifhe had seen Mr. Stulberg from Consolidated Building Corporation and then subsequently heard that Mr. Stulberg had picked up this permit and felt that something was amiss with the system since this permit had not been signed by the Permit Committee and yet they had come to the clerk's office and had got a temporary permit. CounciHor Child stated that the clerk was to fault and something was definately wrong with the system of handing e>ut permits and further since this has already been issued Councillor ehild felt he did not know what right we have to draw this permit back. 'Mayor Murray stated.that he did not·know how this had happened and that Consoll:idated Building Corporation had paid for this permit in the month of April 1960 and that any time during this period the permit could have been picked up. Mayor Murray stated a peculiar thing that the Permit Committee had not signed it and how di~ it get to the Planning Board. Ce>uncillor Child stated that it did not go to the Planning Board was only mentioned that the ·Planning Board required to okay the land deal. Councillor Child stated that the application was in his ~ox the last time he had seen it and inquired khow did it get into the issuance file in the Town Office. Further discussion took place reqarding the issuance of this permit and Councillor Child then stated that the Clerk's office be instructed that no permits be issued unless the Permit Committee sign same and further that the Clerk ascertain that all signatures of the Permit Committee are on the application before any permit is issued. 16~H. REGULAR - 8 - august 15th. 1960 Discussion followed :tk with regards.to the location of the road· and iiJ connection.with the location of .future industries in this locality. No motion was forth coming,however it wad decided that .Consolidated Building Corporation be requested to send a drawing to the Town regarding the location of this plant. UNFINISHED BUSINESS ' i ' ,·· Councillor Davidson brought forward the problem of easements concerning the :dlrainage problem on Iber. Court and Wendlerly Drive and stated that. since our solicitor is ill at the present time somedme else should look aft.er this matter. j Council then went into a Committee of the Whole and Mayor Murray stated that the Town sol.icitor Mr. L.C. Lee is crieically ill ·and cannot carry on the duties of Town solicitor at this time. Mayor Murray said that the Finance Committee shou1d look into this matter.and obtain an active solicitor and bring this recommendation into Council. Reeve Davis stated that with the letter of Mr. Sobara on hrubl we should have a temporary solicitor to advise w:t:th regards to the Petlovany Land Deal., Mayor Murray inquired if it was th,e wish of Cguncil as a Committee of the Whole that the Finance/Committee appoint a solicitor on a temporary . basis and give t~e Finance Committee the power to so act. The meeting then reverted back to Council. DAVIS: PATRICK: · 1'That a solicitor b.e appoirited temporarily for the Town of Aurora due. to the present illness of Mr. L.Lee." Carried. Councillor Davidson inquired ci:f Cguncil if we had received any of the 3/4 .of 1% monies from Cgnsolidated Building Corporation and Councillor Stoddart stated he felt the whole matter should be thrashed out' at a eommittee of the Whole meeting shortly. Councillor Child stated it was his understanding.lbhat Mr. L. Shankman of c. B.C. had advised thatthe.whole matter would be cleaned up if permits were issued at no additional cost and Councillor Stoddart advised that the Town Solicitor had writtenthem in this matter and had no word to report at this time. It was decided that the Finance Committee would look into this matter and.report back to Council. NEW BUSINESS . ''~'"'' ·Mayor Murray brought forward the letter from the To~ship of Whitchurch concerning the location of a Canadian Tire Store and. a Bowling alley in .their municipality south of Aurora. Councillor Child stated that it was his understanding that it is necessary to come up with an answer by September 3rd, 1960. Councillor Child stated he was not at a meeting held with the Township of Whitchurch however understood the~e was a bit of hesitancy by this Council to raise the ire of Whitchurch Township regarding a garbage dumping problem that existed. Councillor Child stated that the assessment of 2 \ 16TH. REGULAR - 9 - August 15th. 1960 stqres pmrpesewould be approximate between $8000 and $12,000 -dollars per year in taxes. Councillor Child stated it is logical to me that both Aurora and Whitchurch would come out on top and since they must obtain the services from the Town of Aurora a saw off should be possible and feel that the split should be reach · amicablely. Councillor Child stated that there is also the hope that other Industries may wish to settle here and then annexation may be possible at this time and further that strip developement in this area is not wanted and this would nip such in its bud. Councillor Child stated that he felt a meeting should be arranged with Whitchurch Township and discuss a m&KiiKg method of split in assessment. Reeve Davis inquired as to how they had arrived at these tax figures and Councillor Child stated ltle did·not know but felt that they might be on the high side. Councillor Stoddart inquired if their was any possi'Bl],.e frontage on Yonge St. in Aurora and Councillor Child answered that Mr. ease had come in with this proposal anf felt that Whitchurch tax rate mi§ht be lower~~:.then Auroras. Mayor Murray inquired if we.are going to help increase assessment 'kllxilill out side our Town and Councillor Child stated that we cannot force people.· to locate inTown if they desire not to. Reeve Davis stated-that the Canadian-Tire Corporation have been looking around the Town of Aurora the past few years and they must locate ,at the south end .. of Town. Deputy Reeve Patrick felt if the area stays in \Vhitchurch and develops and new industry comes in to this location what will we sacrifice. to obtain annexation at this time. Deputy Reeve. Patrick sta_ted that if we let the area develop we will pay a very large fee for annexation: Councillor Stoddart inquired if the Loblaws Shopping Centre contemplated building a bowling alley since this might change their plans. Councillor Bell inquired if we could go to a meeting with the thought in .mind that the split be only a certain limited time basis provided that should another industry locate then annexation BBH must be affected. Mayor Murray stated he would prefer to see Industry in this area since it helps our school tax and did not feel that we sho.uld go to a meeting with the To'wnship of Whitchurch wntil we have a C01Illl,liti;l!le meeting Jti: .first to ascertain our stand in this matter. Councillor Hammond inquired if prior to this meeting it would be possible through the Planning Commilhtee to find out the plans of Loblaws shopping Centre regarding a building of a bowling alley. · Mayor Murray advised he will find out from Toronto Industrial Leaseholds and bring :this findings to' the Committee meeting. · The matter_ of the Fire Ch,ief attending the convention in Calagary and increas.ing the travelling allowance from $150. to $300. was brought forward. PATRICK: HAMMOND: "That the Fire Chief's Allowance for attending the convention be increased from $150. to $300.00 \ ,.""' 16TH REGULAR -10-August 24th. 1960 Councillor Child stated that he felt the $150. was sufficient to attend a convention in Ontario but beyond Ontario boundaries the participant find the additional amount •. Reeve Davis stated that both the police and fire Ghief were allowed $150. each to be used for convention expenses. Councillor Corbett felt if they are going to a convention they they should be allowed in Ontario only or else at their own expense. CuUncillor Hammond stated hewould stand by the motion .and if the main purpose in conventions is to be the benefit of o.thers knowledge and ideas then fullest information is derived from attending such a convention and further.that they should not be resi:tricted to one small area. Councillor Hammond stated that the technical aspect of knowledge goes far.outside of Canada and to get the main advantage shouldbe internatio.nal, however, Councillor Hammond ·pointed out that the budget for the year 1960 must be considered. Councillor Bell stated he would suppo.rt the motion and that other municipalities send their fire chiefs to. fire conventio.ns. Councillor Child reflected that any report receive.d from any member attending conventions were only verbal·and no recommendations had come out of a convention to his knowledge and felt that if we are going·to increase this fee $150. we should obtain a complete report. C.ouncillor Child stated that invaribly all associatio.ns print what takes place at these conventions and it is a matter of reading and studying same. Councillor Child :further stated that if·we set $150. at first of year and then find it impossible to. contribute to.the retarded children's building then we should feel along these lines inthis instance. Deputy Reeve Patrick stated that the knowledge gathered at conventions is indeed marvelous and that the meetings ~take place during the full day and many items of value are obtained. The vote on the motion was then taken and the motion was defeated. · The letter from Mr. Sobara, General Manager, Aurora Heights Limited regarding the relaase of permits and the finalization of the Petlovany land and other deals was brought forward. Councillor Hammond stated that theY are requesting release unequvocally of permitts previously applied for and feel that no permits should be released until we have assurance that the petlo.vany property deal has been signed and sealed. Councillor Child stated he was 100 percent with Councillor Hammond and even if we do receive the conclusion o.f the Petlovany deal and approval by our solicitor then only release the number of lots covered by that agreement. Councillor Child stated that the letter infers the release o.f some 130 lots in all. Councillor Stoddard stated that when the petlovany transaction closed th.en carry out provision of the agreement in acco.rdence therewith. 16TH. REGULAR -11 -August 16th. 1960 CounciLlor Davidson stated that Mr. Sobara had said when the c_!etlovany land deal was finalized he wanted the release of 79 lots. Councillor Davidson stated we had released 120 lots out of 172 and held 50 lots back until the assessment has been equalized on the whole subdivision an!l now it· would appear that this has been changed. Mayor Murray ~tated that noting has been changed and. we still go by original agreement. Councillor Child stated that if the Pet&pvany deal is closed then 52 houses might be released. Councillor Davidson felt that the 52 houses were still to be held. Mayor Murray stated that he did not thingthis was so. Councillor Davidson repeated that the 52 houses were to be held until the whole subdivision had been '--equalized from an assessment standpoint. Mayor Murray stated he had investigated concerning the addition to the post office building and found that tenders were called for the last day of this month and felt now that house to.· house delivery by Christmas time is now out of the pic~e. Mayor Murray stated he felt we as Council should go after the authorities now to obtain. delivery by Christmas and ascertain if postal department might rent space in town and go ahead with delivery by Christmas. Councillo:r Child stated that the bu~get appropriation for 1960 by post office department might ~ffect the start of this addition to the building this year. g&:u&:D:ia:rxiiax BELL: DAJJIDSON: ·"That tl:).e Postal Division be contacted :to ascertain if postal delivery might be obtained in the Town of Aurora by December 1st. 1960." Carried. Mayor Murray brought to Councils attention that he had received many complaints regarding rusty water and felt that the Water ¢ommittee should make a study of this problem • · Councillor Hammond brought forward the matter of occupancies certificate• issued by the Engineer and a copy of which go to each department and upon Mayor Murray's inquiry stated· that he felt there was about 24 houses ready for occupanc~e at the end of July and felt that the asessment on these houses had not been completed at this time. General discussion followed in this matter and it was decided that the assessor should give a written report of assessment at the present time on homes in the Sunnybrook Subdivision. Councillor Hammo.nd brought forward the matter regarding lot 114 in Regency Acres Subdivision and stated he understood from two residents neighbouring this lot that a different type of building is being erected from that originally intended and the Town Building Inspector had informed these two residents that his ruling had been overruled by Council. ., 1i5TH. REGULAR :..12 -August 15th. 1960 Councillor Child-stated that lot 114 had never been built upon in the original plans of Consolidated Building Corporation and accord in®; to the original plot· plan a_ certain type was to - be placed on this lot and now Consolidated Building Corporation have decided to·put a different type of house on this particular lot and this_ might be a 2 story house. Councillor Hammond inquired that this matter had been brought in because the Building Inspector' had said that Council overruled his ruling regarding the type of building to go on this lot. Councillor Ghild advised that Council did not overrule the Building Inspector however the Building Inspector might interpret it this way since the permit issued for the 2 story building on this lot. Counc illor Hammond inquired if we had now renegged onoriginal plan and can they K8 get a permit to put onany type of a house. Councillor Child explained that the change in the architects findings occured from a tour of European architects that had stated Canadian subdivisions need something to break the monotony of the same kaK8 type of housing there~ore the lots now built upon in the original plan Consolidated Building Corporation decided to put up 2 storyhouses to break this mo:notony. Councillor Hammond inquired then if we have approved this type of change in house plans. Reeve Davis stated if a change in plan then the change should come to Council. Councillor Child that the only change was from single to· two storey and this to break the monotony of strawberry box type of house. Councillor Hammond stated we are face with 2 residents who brought property assuming next door· a house wiU be builli of a certain type and now find a change has taken place and it would f~llow that they might nave brought elsewhere had they known ~he type of building to locate next to them. Mayor Murray stated that that he saw Councillor Hammonds thinking but Consolidated Building Corporation will not build any more 1 storey -semis because they cannot sell them.. Councillor Hammond stated that the only objection is that it has happened and few of us here of Council knew of this occurence.
