BELL: DAVIDSON: "That this letter be referred to the Planning Committee for study and recommendation," CArried; A le-tter from-Aurora Heights Limited advising Council that on June 7th. 1960 Beamish Construction Company will commence work on the asphalt surface of Aurora Heights Drive and further that tenders with the closing date of June 17th. 1960 had been . ·· advertised• in connection. with the completetion of secondary roads within this sub-diyision was read. HAMMOND: "That the Town Engineer be instructed to watch -1 I I CORBETT: 'this situation and if found that Beamish Construction ·. Company do not commence proceedings on. June 7th 1960 as stated-'that the Town Engineer inform the Mayor .,, and that a special ~ouncil meeting be called to deal with this problem." Carried, ' ) 11th Il.EGtl'LAR 3 .Tune 6th. 1960 A letter from Regency Acres Ratepayers Association concerning the matter of a 24" dralimage pipe and tequesting the Council place griells at both ends of this pipe and further concerning the possible fencing and pa~ement of a foot path leading throught to Jones Court were read. This letter was referred to unfinished business. A letter from Mr.. Merri t the County of York Weed Inspector concerning a programme in c.onnection with we.ed control to be held on June 9th. at lO.A.M. was read. PATRICK: CORBETT: "That this l.etter .be turned ov:er to the Town. Weed Inspector." ···· .. Carried. A letter from Mr. A. Hulse, Solicitor in the Town of Aurora regarding Thompson's Funeral Service and a building permit. issued fJJr extension to lhhis service was read, HAMMOND: BELL: "That in the event.of.considerable discussion :Chis matter that this letter be referred to unfinished business." Carried. Mayor lV!urray brought. to Councils attention that a letter had bl!len received from Roselawn Farms Ltd. concerning a request to inaugerate delivery of their products in the.Town of Aurora and Mayor Murray explained that Roselawn Farms had that day · advised that they would not attend Council this evening .and further requested that. their letter be wi.tll.drawn from correspondence. ,,-;. ' DELEGlCTJCONS Mr. Glass and·a. Mr, Ward appeared befdre Council on behalf . of the Parks Board and stated that it is r.egrett(!ld that Mr. Bennett could not also attend this evening. Mr. Glass stated that he would like to present to Council 3 points for furmherance. 1. That the Parks Board have requested this delegation to obtain some clarification re their duties for 1960 and whether the Parks Board or the Parks Committee of Council. have the power and felt that two bodies working on the same· thing were not satisfactory. 2. Mr. Glass stated it was their feeling that the Parks Board or the Parks Committee of Council should work in close harmony with the Planning Board. 3, Mr.· Glass stated that this third item was of an urgent nature and concerned the land in the area of the swimming pool and felt that this land might be designed for Park purposes. ··~ 11TH REGULAR 4 J'une 6th. 1960 Mr. Glass stated that it was his understand that these parcels are now for sale and it is the general feeling that this is a desirable piece of property for Parks purposes. Mayor Murray advised Mr. Glass that this year a great deal of park work mQ.st be done and for economy sake the Town equipment should be gsed for grading and levelling. Mayor .,Murray further stated that Parks Board could not use this equipment without Councils permission and that was one reason why the Council set up the Parks Committee and they will work hand in hand with the Parks Board to get this work done. Deputy Reeve Patrick thanked Mr·.Glass for his report and advised that we must authorize the Engineer to stake out the measurements of the parks in order that we may know the exact location for grading and levelling. Deputy Reeve Patrick further · stated that rain this spring has hald up this park work and that the park location in Regency Acre sub-division is in a boggy section and further that once the land has dried it will be easy to grade and fix. Jlllr. Glass referred to the purchase of this property and inquired if he might tell the Real Estate Agent that the Town has some interest in purchasing this land. Councillor Child stated· . that under the new bill 89 ·of the Provincial Government a Municipality . might apply for financial assistance from the Department of Planning and Development and felt we should take the initiative and show it on our land use plan. Councillor Child stated that one requiste of Bill 89 requires a definate plan for parks to be prepare·d and this plan must be approved by the Planning Board and further that between the two bodies we should be able to set up excellent park areas. Mr. Bolsby inquired if the obstruction of the dam at the north end would be removed and the Town Engineer advised that the removal of this dam had been started however the wet weather had held up the progress. Mr. Ward stated that our biggest problem was a;~t Regency Acres Park Area and. that the play ground equipment would be placed in the school yard temporarily. Mayor Murray stated that the entire park programme had been held up due to wet weather and Council was thanked liy Mr. Glass for their courtesy. A Mr. G. Rose appeared before Council concerning a problem at his home.on Wenderly Drive ·concerning water draining down through 'his property. Mr. Rose stated 'previously a ditch had been dug to drain this water but since it had appeared to be a definate ha.zzard and being located on his property did not want to be responsible for any mishap that he had filled this hole in with earth· and now certain neighbours are complaining because· the hole had been filled After further discussion it'waa ascertained that this matter would be taken up in Committee reports. ., Mr. Shoniker appeared before Council•and stated that he and a Mr. Bell are here this evening regardinga point in the sub-division agreement between the Town and Sunnybrook Investments Limited. Mr. Shoniker stated that we· are vitally concerned with the services being completed in the sub-division and have sold a number of houses ~ and are unable to give occupancy a:'t this time. Mr. Shoniker stated that Sunnybrook Investments Limited !ll'e required to pay the Town of Aurora on behalf of Aurora Heights Limited an amount of money regarding storm outlets and ,inquired· if this had been donw. aa of this date. REGULAR 5 June 6th. 1960 C?uncillor Ch:j.l~ Advised he has an agreement in his hand but d~d not know th~s agreement was in existence until this evening therefore had not had an opportunity to ~repruse a~though it was his understanding the Town Engineer and the Town Solicitor have g'one over it. Councillor Child further stated that he understood Mr. Kelner has a cheque ready for sig.\ning as soon as this agreement it is sighned and further that Mr. Kelner had forwarded a copy of this ag::lleement to1Aurora Heights Limited and had not reeeived any answer fvum them as yet. Councillor Child stated he had only heard f:oom Mr. Kelner this evening and had not' .been aware that such an agreement was here until the clerk had handed it to him this evening. Town Engineer Mr. Murray stated that the agreement had been passed over to Mr. Lee and he had prepared a new one and sent copies to Sunnybrook and Aurora Heights Limited and a letter had been received from Mr. Kelner suggesting s,ome changes in respect to Mr. Lee 1 s D J draft form of agreement, however Mr. Murray fe+t that the'Town might now agree with these proposed changes. Councillor Chi:i.d . felt we should hold a meeting first and have this matter finalized'.' :Further discussion followed Mr. Shoniker stated·he required a ·letter from the Town to Shon Construction Limited that. as of this date no agreement has been signed nor have any monies been paid over. STODDART: CHILD: "That the letter requested by Mr. Shoniker be forwarded." Carried · Mr. Topp preseident of Regency Acres Rate payers Association appeared before Council and stated he would like an answer with .. . regards to the question of speeding and the legality of stop signs in the south end of Town and Council Bell repied that he had a report from the by-law Committee and the items mentioned by Mr. Topp were covered in this report. REPORTS' OF COMMITTEES Councillor Davidson presented a report of the Works Committee concerning surface water d~ainage problem Case Subdivision in 'c-Which the Committee respectfully submitted the followi.ng: 1. History : After many ·Complaints from residents of ·this subdivision and theworks committee reporting to Council at the 10th regular meet.ing, it was dec!hded that the Town Engineer would look into this matter. 11. Investigation: On Friday evening May 20,1960 the Committee c~airman accompanied by the Town Engineer visited the site and observed the following conditions: 1. Surface water collecting ofi the Woods farm. property to the south due to field grades and not due to any water course, is· drained to the rear of th~ High School Property, this water augmented by storm water deposited on the school property especially at the time of spring run-off when the ground is frozen proceeds along the east property line of the school property to a point between the residences on Dunning Ave. and I 11TH REGULAR' - 6 - J'tl'N11: 6th. 1960 Iber Court.over It was reported sprin~ run-off. whose back lots it flows easterly to Wenderly Drive. that· the flow was 18 ft. across at~ the tiilte·· &f the last ,. June 6th. 0 1960 Councillor Stoddart felt we should put in the road to the water tank first~ Town Engineer Mr. Murray explained that the gentleman request permission for the driveway to go·across our walkway. Deputy Reeve Patrick suggested that we all visit this site so we might see the problem better. It was decided that a .committee of the whole of Council would visi tthis site in order to solve this ~!I'Oblem. Councillor Bell ~·· ~: :, presented a report of the By-Law Committe in which the Committee respectfully submit the following: A meeting was held in the chambers on the prosed By;;.Laws m JIIJa.y 2!$, 1960. . Vehicles With Lugs .are ':> " ''" covered in the Highway Traffic Act. Not necessary. 25 Miles per hour in certain sections of Town This is not applicable under Provincial Law. We would have to have a 25 mile per hour speed limit all over Town. STOP & YlELD SIGNS in the subuivisions add other parts of Twwn i ! will have to be studied by the Police Committee and the By-Laws Committee RB Police. Traffic By-Law to be agreed upon ~y We re.commend that the Council of the Town of Aurora pass a· by-law covering the protection and regulation fJf Pedestrian traffic as· a:Btached. We recommend that the Council of the Town of Aurora pass a by-law prohibiting heavy traffic except on rads designated by sample by-law attached. We would recommend that the Town Solicitor draw up thes.e by-laws in accordance with the attached copies. Discussion followed this report and Mayor Murray brought to Councils attention.that a resolution of the Ontario Municipal Mayors and Reeves Association covers the point of one city to have a 15 m. p.h speed limit in the vicinity of schools. Councillor Hammond inquired of Councillor Bell if his committee felt it was to early to instigate the one way street system and Councillor Bell repleed that.they had felt it was too early. Councillor Hammond inquired if this was due to the width of the streets and Councillor Bell replied no that mostly because the streets are notlayed out properly to handle one way traffic at.this time. Mr. Topp, President of Regency Acres Ratepayers Association stated he was not sure he understood Councillor Bell completely and asked if is calling a further meeting with the Police Committee at this time• Mr. Topp stated that this subdivision has been iri existence some time. and felt that the Committee are moving far to slowly in finalizing this matter. Councillor Bell stated that a problem is.involved in that we might have to change the spfied limit all over Town should the entire speed limit of Regency Acres Subdivision be lowered. I.lr. Topp stated tll.a~··even at 30 miles per hour the police haveno·jurisliiction to enforce and the .Police Chief advised·that we have a jurisdiction •to enforce. Mr. Topp then brought to Councils attention that we have teen agers from all over Town who drag up and -1 dowi).. our streets and that he nas not seen the Police there -c-oo ' . often. J 11TH REGULAR - 9 - Jru'NE 6th, 1960 Police Chief Langman stated that we go down oftem to patrol the streets and felt that one detriment was the Children play all over the_ streets. Deputy Reeve Patrick stated' that if any citizens sees any one c.areleesly driving and a witness is available that you can lay a charge and further_ stated that he has layen- silliilar· charges out at his establishment at Musselman's Lake, Mr. Topp then asked if the stop signs are legal at Regency Acres and Police Chief Iiangman replied no and further stated thatwe mjj.st warn citizens it is a risky business taking over police duties with regards to infractions of driving. Mayor Murray. stated he felt very badly about speeding in buil~ up areas and a further gentleman from Regency Acres Ratepayers Association ·stated that there .are certain cars-who prevail in speeding in this area and felt it would only take one or two charges to halt this spe_eding, Mr. Topp then inqu±red if thePolice have radar equipment and Mayor Murray advised we do not have radar but have a speeding trap equipment of the street ~ose variety. · BELL: . HAMMOND:· "That the Committee report of the.By-Lawa Committee be accepted." · CArried, Councillor Bell then advised Council that a meeting would be held the follQwing . week with the Police Conimi ttee and the By-Law . Committee to further this matter of by-laws. Councillor Hammond presented a verbal report and ref~rred to a letter from the York County Health Unit iegarding action taken with respect to the unsanitary conditions on Ross flltreet. Councillor Hammond then read the letter from the York County Health Unit and stated that it was his understanding that the residents in questionhave co-operated, Councillor Hammond presented"a verbal rip>port regarding_ the smoke contral and air polution matter and stated that 2 letters had been received at our request for co-operation from.certain industries. Councillor Hammond stated the Town had requested the prevention and reduction of smoke and aire polution in, the Town of Aurora and the letters received assured the Town of co-operation in stating they-are doing their utmost to control this nuisence. Councillor Child presented areport of the Planning Commitee in which the Committee respectfully submit the following: Subsequentto several meetings of the Planning and Permits Committee regarding the selec.tion of a Building Inspector,· a majority vote of committee recommend\')d the appointment 6f Mr. A. E. Jubb as Town of Aurora Building Inspector, at a retainer of $1,100.00 per year plus commission." CHILD: STODDART: "That the report of the Planning and Permit Committee re the appointment of Mr. A.E. Jubb ·as the Building In:qpector ifor;c•. the Town of Aurora be a:qcepted and the seal of the Corporation be attached hereto,_~'and the necessary by...;law be · prepared." · ' 11TH REGULAR -10 -June 6th 1960 Councillor C:tjild stated that this has been prolonged some time and is subsequent;. to several meetings held bJI" the Planning and Permits Committee· ,and finally the matter had. been resolved to the applications of two individuals and it was only at the last meeting that the se·lection had been made. Councillor Child stated. both men h!l-d excellent qualifications and it had been indeed a difficult decision to make. "' The motion was then carried. Councillor Child brought to Councils attention that at a planning board meeting held lb.ast.Tuesday night the use of topographical maps had been brought forward and understood that Mayor Murray had ovtained prices and these prices had been presented to the Planning Board. Council Child then read a letter from the·. Planning Board setting out the many advantages.iriob'taining topographical maps for the · To,wn of Aurora. Councillor Child stated 'that if we as Council have the interest of the Town -~. at heart this is definatelysomething that should be done. Mayor Murray state.d he concurred with Councillo·r Child in that we the Town. of Aurora does require a good set of maps, however Mayor Murray stated we are not able to tie down this years Councils for any amount. UNFINISHED BUSINESS Councillor :Pavidson brought up a matter of the roadways in the Sunnybrook.Subdivision and read a letter from Herbert L. Coons and Associates addressed to lV!r. Murray Town .Engineer. Mr. Murray Town Engineer advised that this_proposal is correcting a bad gravelling problem in Sunnybr~6k Subdivision and stated that the gravel ms not coming up to Department of Highways specifications •. CouncillorCorbett inquired if this will break our contract with the sub-divider and Councillor Child stated no since we should state this in no way alters any other subdivision agreement. The Town of Aurora is willing to have the final equalizationof the assessment made by the County Judge,". ~ In discussion of this motion Deputy Reeve Patrick stated he had taken this matter up with the County assessor who had stated that the Town of Aurora has obtained a goodly number of new houses and Industl';'ies in the past 3 years and this would thereby affect our assessment. Councillor Stoddar't stated the the County still have to answer to us in any hearing that may take place. Deputy Reeve Patrick suggested that Council look at'~·this sjl'te to further this matter on the coming Thursday· evening. ·· Councill SToddart took the chair and Mayor Murray presented the following motion MURRAY: PATRICK: "WHEREAS The leadership shown by the provincial authority is most appreciative by the conference delegates here ·assembled and whereas the provincial authority has been fit to convene a Civil Defence seminar between the Federal Ontario Provincial and Municipal representative at the Civil Defence College at Arnpri~r during the Month of May 1960 . AND WHEREAS the municipal delegat~s to this conference have unanimously .agreed that this type ol' conference is timely, informative, very essential and should be continues and inteasified ' . . ' . AND WHEREAS the continued and expanded emphasis on Civil Defence is in our opinion necessary for the health and· welfare of all ~. Discussion followed'this motion in which Councillor Davidson stated that this resolution calls for a meeting once a year on Civil Defence· and felt the organization was more ·or :tess draggigg their feet. Mayor Murray stated this is for Municipal representatives and that the Civil Defence Organization are certainly doing something. Deputy Reeve Patrick stated that the county are appointing a permament man for civil defence co-ordinator in the near future. Mayor Murray explained his attendance at the Arnprior ci~il Defence College and stated that Civil Defence is de:t'inately on its way and will be made more public this summer. Councillor Davidson stated he wouldlike to support it, we need municipal leadership to lead us all to proper procedure should an A bomb be dropped nearby. Councillor Stoddart said he had read press reports recently and felt better because of its progress. Mr. Lee further stated he understood it would be a show place for caskets so that ther would be the whole funeral aspect from beginning to end and it will therby be a more busy section than at the present time, Mr. Lee statetl. i.f this is a commercial area then state so if residentail then think of what. you would want next to the place where you live, and that he is satisfied no one would want it next door to his house, Mr. Lee continued further and summed up by saying that Mr. Thompson should have placed himself on enquirey on the first instance, Mayor Murray in the Chair. 11TH, REGULAR -14 -J'une 6th. 1960 Councillor Child in answer to Mr. Lee stated in his oj,'Jinion the cruK of the matter was that the Town of Aurora does not have a zoning by-law and further that it was his understanding that one objection in prior years When a zoning by-law was proposed was from Mr. Lee, Councillor Child stated this is definately prove that we need a zoning by-law since this present matter would have been non-conforming. Councillor Child brought forward one point was that although'Mr, W. Thompson had moved out of the, funeral home on Victoria St. but W, Johncox lives there at present, Further that Dan's cafe was next door to Thompsons on Yonge St, and felt that this would have to be approved by the Health Unit at this time, Mr. Lee stated he would like the people of Town of Aurora to know that-they are in a commercial district an:d any type of commercial enterprise may establish itself next door and stated he might have to carry this matter further with Mr. Thompson before this matter is over, Deputy Reeve Patrick stated that after hearing the discussion this evening although he had originally supported the permit mast now declare himself ignorant. Deputy Reeve Patrick stated it is a residential ar·ea, it is a chapel and not an undertakers parlour and wil have to oppose the release of the permit at this time. Councillor Stoddart stated he felt sympathetic with Mr. Lee but feel the Mr. Thompson has the law on his side \ and felt that maybe Mr. r,ee might proceed on his own, Councillor Stoddart stated he must go along with the release of the permit and inquired if we should nbtain further legal opinion, Mayor Murray brought to Councils attention that this permit was granted and temporary held up, Mayor Murray stated that the motion allows for the permit now lto be released and should the motion be defeated it is only defeating that the permit not-be released at this time since the permit actually already issued, The motion was. them carried. Councillor Hammond inquired if any further news had been received concerning the matter of the bank between Aurora Heights and Sunnybrook Subdivision and Town Engineer Mr. Murray stated that he has. an appointment with Mr. Shoniker this week and it is his·mnderstanding that he intends to proceed at once with this work. NEW BUSINESS DEPUTY REEVE PATRICK ( IN THE CHAIR) Mayor Murray brought to Councils attention that he would like to bring up this point the suggestion for Councils thought and consideration, Mayor Murray stated that the nomination meeting had been held in November in past years but this is not a necessary solution to a growing Town and Felt that Council should give thought to a change in the election day to a Saturday and also change the nomination date to December in order that Council might continue working as an elected Council longer, Mayor Murray also suggested that the School Board holdtheir nominations at a different date then the Council nomination. ··~-: I I I I 1 ___ , -- - 11TH REGULAR STODDART: CHILD: -15 -June 6th. 1960 " Pursuant to Section 135( 1) of the Assessment Act, R.s.o. 1950, Chapter 24, it is hereby authorized to apportion taxes that were assessed in · · ·: one block as follows: Golf Glen Terraces Ltd, James & Dortu Henry Harvey McKen~ie TOTAL Carried, $1,014.75 148.49 74.25 $1,237.49 Councillor Corbett brought to Councils attention the request of the DEpartment of Highways to purchase sufficient land to widen Highway Number 11 to 55 feet from the centre line of constnuction and surveyed and stake by the department engineers for the nominal fee of $1.00. This property is on Yonge St. adjacent to the Billing 1 s Well and would comprise a lot 32 feet deep by 66 feet wide. It was decided that a meeting would be held to further this matter. Councillor Stoddart brought to Councils attention that a cheque had been reeeived from the Aurora Memorial Areaa Board in an amount of $10,000. Councillor Stoddart advised that #3IDOO. had been set aside in the budget and together this $13,000. would almost clear the amount owing to the Town by the Aurora Memorial Arena and this would fullfml the request of the Auditor and the Department of Municipal Affairs. Councillor Stoddart further stated that the Arena now will not have any monies for improvement and must come to Council should this requirement be necessary, Councillor Hammond inquired in regards to weeds conditions on lots of unoccupied houses and inquired if the Town might go in and cut the weeds and charge it back to property owners and Mayor Murray advised that we can do this quite readily. Councillor Hammond brought forward the problem of erosion from the school property in Aurora Heights and stated that soil is falling down an_d pushing the level further into the houses, It was dec,ided that the Town contact t[U!
