REGULAR BELL: CORBETT:. - 6 - M:ay 16th. 1960 "That the Council of the Town of Aurora endorse this resolution. Carried, A·letter frqmlVIr. &. Mrs. A. Heard 89 Ross St. Aurora regarding the situation of junk piled in the back yard of 83 Rqss St. was read. CORBETT" CHILD: "That this matter be referred to the York County Health Unit for investigation. ' ; < ' .. ' ' ' ' Carried. A letter from Mr. L, c. Lee, Q.C. regarding the issuence of a building permint to Mr. W. Thompson on Victoria St. was read. It was decided that this letter be referred to new business. A letter from Mr. J. F, Topp president Regency Acres Ratepayers Association requesting Council support to the organization of a safety council for the Town of Aurora was read. A Mr. Powell and a Mr. Egah from Regency Acres appeared before Council in support of their written request. These gentlemen stated that they felt strongly towards the setting up of a safety council in Town and that they had the full support of the Ratepayers Aeeociation together with the Police Department and Department of Transport who will go along and assist them . in setting up a work shop etc, Mr. Egan then presented to Council a copy of a by-law concerning the matter that is in existence in the Township of North York and requested that Council propruse this by-law for consideration. Councillor Child inquired if our Junior Chamber of Commerce did not look after this. Councillor Stoddart replied that in the past they had looked after this safety council and the Chief of·Po~ice stated that we did have a very good safety council. but the Junior Chamber of Commerce· had taken it over and since they felt they did not have the full support of Council it had gone down hill and eventually vanished. Reeve Davis felt that one or two Council members should be represented on the safety council. Councillor Hammond stated that the Junior Chamber of'. Commerce some time ago had gone a little way toward starting a safety councul but had found very little interest fostered by the sehools add this would appear to be the main source of interest. Councillor Hammond stated that since a number of people are interested now it may incur the interest of principals of the schools at this time and we should lend our support to it and ascertain if bringing in this by-law would improve the situation, :.. .... ;!::: ---,~ 10 REGULAR - 7 - May 16th. 1960 Councillor Child inquired if this was for sub-divisions only and Mr. Egan replied that it was definately a council for the whole Town. Gouncillor Davidson felt that this was a worth while suggestion and that we should support these people and would move that·we go along with them. Councillor Bell recommended that Counci+lor Hammond be a representative of Council on the safety council, DEputy Reeve PatriQ~ stated that a safety council is a very good thing and we must get the backing of the schools since we need the proper organization to taach safety in our schools. Councillor Stoddart stated that a few years previous our local paper had been awarded the prize for s~ety advertising and that we need the newspapers support and felt that our present Editor will go along with this organLzation. It was suggested that the by-law requires study and that this study be given, The matter was then left in abeyance the by-law being referred to Councillor Hammond, A letter from Mr. L.C. Lee, Q.C. thanking Council for the presentation of flowers while he was hospitalililesdwas read. PATRICK: "That this letter be filed.'' CORBETT: Carried Councillor Stoddard presented a report of the Police and Fire Committee in which the committee respectfully submit the following; STODDARD'f: DAVIDSON: STODDART: That the applj.eation of William :Wayne Kirk 23 Royal Road, Aurora, for taxi driver"s license be granted. "That the report of the Police and Fire Committee, re: application for Taxi driver's license be accepted and the Seal of the Corporation be attached hereto." Carried. "That the school support of the following property be amended to Separte School rather than Public School: Roll Number 4-2379 150 Temperance ST. Carried Councillor Davidson presented a report of the works Committee in which the Committee respectfully submit the following: . .,.;,_ "That the contract with Bert Huffman re new well construction be amended to include the following additional prices: 5 feet of screen @ 83.23 per ft. 5 feet of drilling @ 12.00 per ft. Setting & Developing extra 5 feet TOTAL $ 416.15 60.00 290.00 $766.15 .lOTH REGULAR DAVIDSON: PATRICK: - 8 - May 16th, 1960 "That the report of the Works Committee re additional cost·. of new well contract of $766.15 be approv~d andthe Seal· of the Corporatton be attached hereto," CarrJ.ed, Councillor Davidson presented a verbal report in which he stated the Works Committee had visited the sight of the Aurora District High School and had looked at the dra,inage problem however the Committee were not in a position to make any decision at this time and recommend that the Town Engineer look at this problem and make a recommendation • It was decided that the Town,Engineer would look into this matter, Councillor Davidson stated he would like the Works Committee and Council to visit and look at the road at Choice Cvt Up Chicken Ltd, Councillor Davidson stated we must do something about this road and wondered if part of its costs might be obtained from Choice Cut Up Chicken Limited,. Town Engj.neer Mr. Murray stated that plans are in his possession regarding an 8 inch water main to go down this road and at present they are waiting on the Ontario Water Resources Commission to okay the industrial waste. Reeve Davis stated that we are faced with another culvert and require a catch basin on the north side, Councillor Hammond stated that if the crown of the road is brought down to the south could it not drain down and the Town Engineer answered that it could not, Councillor Harrunond stated that this is washing our road out and the Town Engineer replied that it is up to Choice Cut Up Chicken ~td, to provide draj.nage of their parking lot, Councillor Davidson then stated that the grader had been u:p this road and that stone had been placed on it but the stolfll has now,dissappeared, Councillor Bell br<;mght to Council:~· attention that previously he had brought forward a motion that the tradesmen and peddlers license be increased to :lnoo. a:p.d that he had felt strongly on this matter and thinks it should be followed up and this incr('Jase j_nsti tued. R.eeve Davis stated that a Committee meeting would be required to draw up the proper by-law. Councillor Bell stated he wou1d cal1 a meeting of the by-laws Committee. Councillor Hammond presented a report of lt!he Services Committee in which the Committee respectfully submit the following: That letters be sent to those industries concerned in the reduction of smok~m_raission and air po.J.lution asking for their · co-operation in bringing about a reduction of smoke nuisance, and pointing out that in the event of not being able to obtain such co-operation, steps may he necessary to involl:e legislation to control smoke abatement, Further, that any help or information to assist these industries to achieve this objective will be fo.r'thcoming from this Council'. HAlVIIVIOND :: BELL: "That the report of the Services Committee re Smoke Abatement, now before Council be accepted. Carried. I ; lOTH. REGULAR - 9 - May 16th. 1960 b Council Child presented a veral repart in which he stated that a planning Committee hufl be meeting had been held regarding the replacement of building inspector and the Committee had now established a method of payment that would be adopted and further that 3 applicants bad been selected and they would be interviewed on this coming Wednesday night, Councillor Corbett stated he had been handed a letter previousiy to investigate a matter at the Arena Restaurant on Yonge St. S regarding the erilargeing of their premises and the beautifying of the area. Councillor Crovett" stated he had talked to the owner and had witnessed a model plan of extension and beautification programme to .take place on the north side ofthe building, Councillor Child Stated that himself and Councillor Stoddart had vis:i!ted the Arena Restaurant and had seen these plans and if these plans·were fullfilled the sight would become very beautiful, Councillor Child stated they had pointed out the flood hazzard in this. area but felt it would be okay. &ouncillor Child further stated that while they were on the sight there was a great deal o:j;'Anilk flowing into the creek, Councillor Stoddart stated that the gentleman would be ppending M.s money in fixing up this sight and that he should be encouraged and further that the milky water should be cleared up, Deputy Reeve Patrick·felt that this milky water was from Anodizing. Councillor Corbett summarized that this was a verbal report and he will have a Committee meeting regarding this matter in the near future, Councillor Corbett inquired if Chairman of Property was in charge of Town.park sports. Councillor Child stated it was his understand that the Parks Board look after parks itself and Property looks after what goes in the park, Councillor Corbett stated that the back stops are the Town Property ' and it would appear that some need replaceing • Councilor Bell advised that according to the Provincial Government there are no grants on capital expenditures and a ruling he had received that all equipment·barring small equipment for children belongs to·the Parks Board, on Town Council and not recreation and this would place it in the category of Parks Board or Property of Council, Councillor Hammond stated that a soft ball league had been formed through the Youth Club and they are concef'ned with a ball diamond in the :Park and · that we should make and attempted to place the park in good condition for playing ball. Deputy Reeve Patrick stated that the Recreation Director.·· advises the Town when they should grade etc. Councillor Corbett stated that a request had'been placed for the repairs of back stops, the replacement of a new top and portions tied up and that wings beiplaced on the sides about 30 feet long by 7 feet high, Councillor Corbett stated he would hesitate placing wings with regards to hard ball ~nd that we require a hard ball diamond in some other location. Deputy Reeve Patrick stated that the Horse Show held each year costs the Town money each year to fix up the park it was subsequently decided that the Town Superindent contact the Recreation Director and obtain prices on what· they need and the a Committee meeting would be called in the near future to finalize the matter. lOTH. REGULAR -10-May 16th. 1960 UNFINISHED BUSINESS Councillor Davidson stated he had received a letter in the middle of last winter from a gentJ.eme.n in Regency Acres located near the water t1;wrer and this · _ gentleman had decided to put in a driveway. Councillor Davidson ·stated that this gentleman now desires us to decide if he can put in this drive way and in what location and further that he would be willing to throw any fill on top of OQr water service. Reeve Davis stated that there should be an agreement in this connection. PATRICK: ' DAVIDSON: "That the Town Engineer visit this gentleman $ith regards to the layout of the road etc. and report back to Council. Carried The Town Engineer t~en requested the assistance of the Town Solicitor in this connection. Councillor Stoddart stated that Councillor Bell and himself would arrange a meeting soon with the Town solicitor regarding the :-, interpretatioiun of certain letters from Consolll.idated Building Corporation. Councillor Corbett stated that at the last meeting of Council a matter had been left in'the hands of the Deputy Reeve, Councillor Stoddart and Councillor Bell to meet at, the disposal_ plant last Friday evening. At this meeting they had met the enginaer and contractor and had liiuhked at the top of the digestor and further that a hose. had shoWn numerous bubbles coming from the top of the digestor roof in piJt-holes, Councillor Corbett advised that a conclusion had been reached that they are going to put oh some patch and the contractor would_experiment with other material on a. other square and on the 30th. of May they were to meet their agaj_n and ascertain what, the results are. Councillor Childj.Lnquired if the Town Engineer had progressed any further with regards to the Paving of'Town Streets and there estimated costs. Town Engineer Mr. Murray advised. that the programme concerning soil testing is approximately 60% completed and that the Engineer desired a §treet Conunittee meet'ing to go over a preliminary set of figures that are now in his possession and ready. Councillor Hammond inquired if Town Engineer could shed any light on the Sunnybrl!1ok Sub 7 division and advise if they are under way at the present time. Town Engineer Mr. Murray explained that he had a meeting wL:th their Engineer and"'dontractor and that it now rests in the their Engineer's hands to get this job finished. Mr Murray further stated that he had received a que.tation concerning the cost of removafu of trees on Wellington St. and this was now in Mr. S.J. Kelner's hand, 4' l OTH REGULAR 11 May 16th, 1960 '. Councillor Davidson stated it had been approprj.ated in the 1960 budget to re-surface Vic' tor1"and Metcalfe Streets and inquired if the Town ill going ahead or should we waite until the costs of pavj.ng streets has been ascertained, Councillor Child felt thai if the paving prograrr~e is to go ahead then the paving on a large basis should less inespensive than doing one or two small j'obs only. · \' This letter was left to be furthered at a meeting with the Town Engine:er on Wednesday evening, Councillor Davidson then referred to a letter from the John Manville Co. concerning the use of their pipe and stated that this company desire a meeting with Council. This. matter was left o"ver for a meeting to be held on Wednesday June lst. Councillor Corbett stated that several times he had brought up the subject concerning se£ety walks on Yonge St. and Councillor Bell replied that -this matter was covered in a Police by-law in his possession and that a meeting of the By-law Committee would be called shortly to deal with this matter. BY-LAW! q i The by-law to regulate and govern lading houses and the keepers of lo~ing houses and .for revoking of any license, BELL: "That the by-law now before Co'uncil ·be reas HAJYIMOND: · a second time and that. the Council resolve /d itself into a committee of the whole for . / '?'· 'V' that purpose." Carried, The by-,law was then read a second time and the schedule of license fees was completed upon the second reading. All in favour of the second reading of the-by-l·aw. All, in favour of the third reading of the by-law, Carried, lOTH F.EGULAR BELL: DAVIDSON: -12-May 16th, 1960 "That leave be given to ind\roduce a by-law to provide in part the funds reguired by the Aurora Hydro Electric and that the same benow read a first time, vl 1~.} - Carried, The by-law was then'read a first time. ~TODDART: DAVIDSON: "That the by-law now before Council be read a second time and that the Council resolve itself into a committee of the whole for that purpose, Carrj_ed, The by-law was then read a second time and,carried NEW BUSINESS The letter of ~~. L.C. LEE, Q.C. regarding a building permit issued to W.J. Thompsons was brought forward, Mr. Lee appeared before Council and stated that this permit concerned a problem with him and felt it was only proper he should write this letter and advise Council of his concern in this matter. Mr. Lee advised he had written Mr. Thompson when he had leardnd the permit had been issued and felt that Council should have had all the facts on hand at the time of the issuance of said permit. Mr. Lee stated that he maintains that this area being zone_d residentially the Council has no power to issue a permit other then residential purposes and that Council should obtain an e,xpert opinion in this mattel'. Mr. JJee stated he had discussed the situation with a Municipal solicitor and his view concurs with Mr. Lees•. Mr Lee stated if it is to be a commercial area then the zoning must be changed and the Ontario Municipal Board must consent and interested parties would be allowed to attend such a hearing. Mr. Lee further stated that, Council may only act within the powers that are given to it. Mr. Lee further stated that it may be tha.t those on Victoria ,St. in other residences do not know what is meant by the issuance of this permit and stated it was the legality of the thing to which he was mostly concerned, Mr. Lee felt that if this is .to be a commercial area than anyone on the street has the same right to request a permit for commercial purposes such as a restaurant e,te. Mr. Lee stated that lilhis is definately a resddential street, He is paying $500. a year taxes and should have the privacy of a residence and not have to put up w:i.th trucks going in and out next deor. Mr. Lee stated that it was his understand- ing that embalming was to be carried on together with a showroom for caskets in this spot on Victorj.a St. and this definately would take away the p~ivacy of the area and further he did not wish to live there if this is so, Councillor Chiilld answerd mr. Lee and advised that there is no zoning by-law in the Town of Aurora, Mr. Lee. stated that there was a zoning map and that this map is registered in the registry office and there- fore is effect and bindidg, C.ouncillor Childadvised Mr. JJee that he must be referring to a Land use plan that sets out 4 classes at the present time s;uch as sewered area.nonsewered area etc. ~~ I , ' " .. )~: i_:__ ·' I L lOTH. REGULAR -13 -JV!ay 16th, 1960 Councillo~ Child stated there is no such thing as a zoning by-law Fn the Town of Aurora. ~~. Lee advised he can produce a letter rom the Department of Planning and Developement some years ago and shall communicate with fuhis department to further this matter. Councillor Child brought to JV!r, Lee's attention h this letter was incorrect since you might build up but you can 1 t build down and Mr. Lee advised he had changed his line of talk from that contained in the letter. Councillor Child then advised that the permit had been issued on the basis that we were only extending an existing funeral home and felt that funeral homeswere in the same catagory as.churches and cemetaries. Mr. Lee stated that this establishment is beyond a funeral home now and Councillor Child asked why. Since their extension is going to alleviate the parking on Victoria St, from the present condition. Mr. Lee stated that a present they have trafficwith cars other than funeral days and that the embalming had been carried on at the store on Yonge St. and is now going on Victoria ST. and the traffic w:;t·',Jhl will be heavier. Councillor Child stated that the permit was issued and in his opinion we were not doing any more than the extension of a existing funeral home and it is still going to be a funeral home and further we are not changing the land use one iota. Mr. Lee stated that this is a residential area and their is no right to grant a permit for construction or addition to a non conforming use type of building, Councillor Child stated that if we had a zoning by~law in force he would agrl'1e with Mr. Lee 100 .. per cent • Councillor Child further, stated that a. precedent had been set in civil cases of funeral homes being classified si.milar to churches and not as a commercial business.
