MINUTES - Council - 19590921I I i I , MINUTES OF THE 19TH REGULAR MEETING OF COUNCIL HEL.D .IN THE COUNCIL CHAMBER ON MONDAY, SEPTEMBER 21ST, 1959 AT 8:00 P.M. PRESENT: MAYOR REEVE: , DEPUTY REEVE: COUNCILLORS: D.J. MURRAY (IN THE CHAIR) C.F. DAVIS O.K. NISBET ADAIR, CHILD, CORBETT, DAVIDSON, PATRICK AND STODDART. "\1.77 Deputy Reeve Nisbet requested Mayor Murray before the meeting commenced that he wished to object to a Special Meeting of Council held on Tuesday last, September 15th, 1959. Deputy Reeve Nisbet stated that in his opinion this meeting was illegal, that 48 hours notice must be given to every meeting and therefore this Special Meeting should declared illegal and void, Councillor Child stated he would like "to refute this s:katement, Councillor Child agreed with the 48 hours written notice that was necessary, however, he stated, that· the present Mayor and other Mayors had called other meetings on short notice. Councillor Child stated that the actual notice of the meeting was in error on the Clerk's part. Further Councillor Child stated that the Deputy Reeve had instructed himself to approach the Town Solicitor and draw up a suitable agreement with Sunnybrook Investments Limited. The question had arisen concerning whether the Reeve cpuld. sign said agreement and it was pointed out that he could. Deputy Reeve Nisbet stated he did not feel the other members of Council were notified properly, the Deputy Reeve stated "I asked you to draw up a specific agreement but there was no mention of anything else and ther.efore I feel that the meeting was illegal and Council that attended this meeting were leaving themselves open to criticism." Reeve Davis stated that a discussion arose out of a contract to be let re services and it was referred to Councillor Child as Chairman of the Planning Committee, Reeve Davis stated that we had the blessing of Council to call a meeting and instructed the Clerk to call such a meeting. At the meeting a quorum showed up and I, as Acting Mayor, made the aecision. to hold the meeting and went ahead with it. Mayor Murray stated that as a point of proceedure rather than carry on this discussion at the present time it might be brought up later in Unfinished Business. Councillor Patrick stated he feels we aould discuss this matter now. Councillor Patrick stated that he had attended the meeting and five were agreeable. Further that meetings had been held with shorter notice in the past and-also with no written notice but only phone calls. NISBET: DAVIDSON: "That the contract with Cities Service·Oil Company Ltd. at .1G¢ per gallon be continued till September, 1960." . . Carried. ·. Deputy.Reeve Nisbet stated that Council has no authority"to control the Arena Board in accepting delivery !Urom .Cities Service Oil Co. at this price but Council representatives on the Arena. Board should attempt to take this matter u~ with the Board at their next. meeting. Two letters from the Aurora Heights Ratepayers Association, one thanking Council for their co-operation in holding their Weiner Roast celebrating their first Anniversary and the opening of Aurora Heights Park and also a letter enclosing a copy of the new executive"of the. Association for the !J?E)riod 1959 to 1960 were read. STODDART: "That these letters be.acknowledged and filed." PATRICK: Carried, It was decided that a co;py.of the Executive of the Aurora Heights Rate:.. payers Association. be prepared for each member of Council. DELEGATIONS A 1~. Hooper and a ~. Shield, owners of homes on Lot 67. and 66 in Regency Acres appeared before Council in connection with building garages and in , ..... :-."1' .. -: ~. 19TH REGULAR I -6 -September 21, ·1959 particular with the provisions of Section 10 of Building by-law 1051, Town of Aurora, in which it is stated in part that consideration may be given in unusual circumstances. Mr. Hooper passed out drawings to C~unc~l illus~r~t~n~ ~he ~roblem they were encountering and stated that ~t was the~r w~sli to construct these garages at once. It was pointed out that the allowance of six feet together with the slope encountered at the rear of their lot made two very severe corners to ge~ in and out of the proposed garages and in addition the appearance of these garages would be yery poor. Deputy Reeve Nisbet stated that this matter should be referred to the Planning Committee for investigation and that report be brought back to Council. Mayor Murray stated that since· this would appear to be a contrave.ntion or a change of our Town 1 B~i:).dliqlg by-law Council might not handle this at the present time, however the Planning Committee wiii investigate and bring in a report. Mr. Catherwood, representing Roselawn Farms Dairy, appeared before Councii and"t:haUked"tnem for their invitation to appear in support of ·their application "for a license to distribute milk in the Town of Aurora. Mr. Catherwood stated 'that he felt Roselawn Dairies could • I ~ I · I 'i ~ , offer sav~ngs to· the citizens 6f the Town of Aurora by allowing for distribution 3' q;t;. containers in stores and 2qj>. containers for home delivery. Delivery would be made from Roselawn Dairy's Branch in Richm6nd Hill. Mr. Catherwood further stated that some of their customers have moved from Toronto to Aurora and they would like to still serve them and further that Aurora is a growing Municipality and in his tipinion there is need for another milk distributor.CoU!lcillb.or Stoddart stated that the price in Toronto is .24¢ a quart and. what would. the price of milk from Roselawn be in Aurora and Mr. Catherwood explained that it would be .;23¢ a quart here in Town. Mayor Murray stated he did'nbt understand how it would be less than Toronto and suggested that if Aurora were further to the North then we might expect to receive a price of .22¢ a quart. Reeve Davis asked Mr• ~atherwood if they had received the approval of Milk Control Board !:i:nd was advised that the Mild Control Board had·turned Roselawn Dairy down since they had not obtained a License to distribute milk in the Town of Aurora. Deputy Reeve Nisbet stated that· if the Mild Board would give their approval then we would consider it here in Aurora and further stated that our Dairies are not allowed to go to Toronto. Deputy Reeve Nisbet asked why the Milk Control Board did not issue a blanket approval to let dairies go anywhere and Mr. Catherwood stated that the Milk Board are extending area approvals all the time. Councillor Corbett asked if Roselawn Dairy would have an outlet in · Aurora and received the reply that this would no doubt come in time due to delivery'problems. Reeve Davis stated that you·are.not interested in investing money from a commercial assessment viewpoint and that we have dairies in Town who pay taxes and felt that it was not fair to them to disturb the. market. Reeve Davis further stated that if" the Town of Aurora wasn't growing then you would not be interested. Mayor Murray stated that as a growing Town we must encourage commercial assessment and that. our dairies pay large taxes so it is not fair to them, However should you desire to Come to Aurora on the· same basis then we would encourage you. Councillor Stoddart stated that we must keep in mind that both dairies have substanmial payrolls and Councillor Davidson stated that if the . demand for the larger size milk containers was received then it could be available from our pres(;lnt dair:ief:l. Deputy Reeve Nisbet stated that should the Milk Board feel that the Town is not being served suficiently they should advise us accordingly. Mr. Catherwood September 21, 19 59 -7-19TH REGULAR asked if the Milk Control Board had anything to do with our B~-law No. 835 and Mayor Murray advised that t~ey did not that the Council makes the decisions and only rely on outside influence for guidence. Councillor Corbett stated that if Roselawn wish to come bad enough they should put up an outlet or he would not vote in their favour. Mayor Murray stated that application was made previously and t~r~ed down by Council so with no new motion then the old motion and ruling still stands, 183 Mr. Ray Hammond, representing Aurora Heights Ratepayers Association, appeared before Council in connection with the laneway through Sunnybrook Subdivision to Wellington Street for school childeen and in. addition ~ I -I with respect to culverts on Huron Court, Mayor Murray advised that he had been in touch with the Chairman of the School Board and they were endeavouring to get in touch with the Subdivider to obtain a gravel path through this area and that he would try to contact the subdivider tomorrow. Mayor Murray stated the subdivider has assured ~he Town that the sidewalk will go in very shortly and the pavement in the not too distant future. Mr. Hammond stated that a' 5' drop in the lots backing onto Sunnybrook Su9division was taking place and that two telephone po:j.es had C!Jllapsed, Mayor Murray advised that National Housing had been adviseQ.of this situation and the Town was waiting for their ruling on this grade, Mr. Hammond brought forward the question of the preparation and surfacing needed and assurance of maintenance with regards to Aurora Heights Drive. Reeve Davis stated that a letter should go to the subdivider requesting him to prepare Aurora Heights Drive and Deputy Reeve Nisbet,stated that other streets in the subdivision were developing pot hotes. It was decided that Mr. Hammond would attend at a meeting at 10:30 a.m. the next day with the Engineer for the Subdivider and the Town Engineer to discuss this and other matters with regards to this Subdivision. REPORTS OF COMMITTEES Councillor Patrick brought forward a preliminary report from Mr. Johnson of the United States who had visited the Town recently in connection with the new well' development and requested the Engineer to explain to Council the contents of this report. The Town Engineer outlined this p:[.eliminaryreport and general·discussion followed, It was decided .that Council. would await a final and complete report of Mr. Johnsons. in connection with this new well. Deputy Reeve Nisbet asked how the Town made out with regards to draining the elevated tank'and its repairs and Councillor Patrick advised that the tank had been drained and repaired in record time. Deputy Reeve Nisbet then asked why the hydrants weren't opened and mains flushed at this time and Councillor Patrick advised that this is a major job'and required quite a few men and is not like years ago when one man might do this job, Reeve Davis suggested that possibly the week-end is not the time to carry out this flushing and felt that the middle'of the week might be better when householders were not carrying out their washing as much as on the week-end.. Councillor Child stated that it was possible that many wives were working during the week and possibly might do their washing on the. week-ends. Councillor Adair stated that there was a new 14 11 main constructed in his area however they still notice rusty water. Councillor Patrick state<f that the flushing of the mains will start shortly, 1 .() 1 ,. i·1'8TH REGULAR - 8 -Septemper 21, 1959 Mayor Murray advised Council that he had attended the Planning Convention · with the ·Deputy Reeve in Montreal and will have a full report ready for Council at the next regular meeting. Councillor Patrick requested a meeting of the Committee of the Whole with regards to Works Committee problems for next Thursday night at 7:30p.m. Councillor Child reported verbally that as directed by Council he had approached Mr. Lee, the Town Solicitor, and they had drawn up an agreement between the Town and Sunnybrook Investments Limited and this agreement had been approved by those present at the Special Meeting of September 15th, 1959. UNFINISHED BUSINESS Deputy Reeve Nisbet stated that the only way which he could re-introduce the above subject is to state that the Special Meeting of Council held on Tuesday, September 15th1 1959 was·illegal. Deputy Reeve Nisbet stated --!hat he disagreed with the reason to change the agreement so that levies may be paid in lots of ten when permits are required. The Deputy Reeve stated he desired to get a ruling ori whether the meeting was illegal. Councillor Child stated that the Deputy Reeve was not objecting to the agreement since it made no mention of capital·levy·monies, that his objection should be concentrated on the resolution passed by Council that evening with regard to the payment·of these monies. Deputy Reeve Nisbet stated that if the motion with regards to the payment of capital levies be withdrawn he would be satisfied. Mayor Murray stated that he agreed that the signing of· the agreement was in order but that the motion with regard to the payment of capital levies is the contentious point. Mayor Murray. stated that onl.y four members of Council voted since the Reeve was in the Chair. Mayor Murray advised that an unwritten policy existed in the Town where .o.ne member of Co.uncil might be absent and Council would carry on, however, if two members · were absent then anything of a contentious nature should not be brought up and certainly if more than two members were absent. Council~or Patrick stated that in his opinion there was an error with regards $o the meeting and that the Reeve might have voted in that instance. - Reeve Davis stated that he was riot ignorant of the proceedure by-law. with· regards to the 48 hou;rs notice and the requirements of a written. notice. Reeve Davis further stated that he has sat under other Mayors. and have attended Special Council Meetings called on very short notice, Reeve Davis stated that we had the blessing of all Council to arrange . for this agreement to be signed and"this was don~J·in good faith and not behind anyones back. Councillor Child suggested that someone bring in a motion to rescind the contentious resolution. Deputy Reeve Nisbet stated again that the only way he could bring up this subject was to call the meeting illegal and that he can't· see·any legal reason to help the subdivider in this instance and felt that we were entering the subdivision business by so doing.· Councillor Patrick stated that we all know we have to make decisions and that we are hot entering into the subdivision business. Previous subdivisions are not paying these levies in full. Councillor Patrick further stated that . Deputy Reeve Nisbet advised that he had talked to the Clerk and to Councillor Child l'tfterwards and had explained to Councillor Child he was going to re-intro.duce this . subject and was definitely not trying to embaras13 anyone. Councillor Adair stated that should this Council meeting have occurred after the Committee meeting with Mr. Marrese then he would not have voted for, it since he .was not happy with the remarks made by Mr. Kelner after the Council meeting had .ended. Reeve Davis stated that we are not allowing Mr. Kelner anything except an extension of time with regard to the payment of these monies. Mayor Murray stated thl'tt Council had relieved him of paying in advance. Councillor Child stated that he must go along with Councillor Adair's statement and that he had called Mr. Kelner on Thursday and stated that ~~. Kelner was .more or less stretc~ing a point of law with regards to being legally or morally obligated, Councillor Child stated that the motion with regards to the payment of capital levies might be rescinded by Council. Councillor Child .. stated he would like to have the Clerk write N~. Kelner and ask him with regard to the p~yment of approximately $10,000.00 re storm sewer oversize and if the answer received is not satisfactory I will g&adly make a motion to rescind the previous resolution. Mayor Murray asked if we could not :father than claim the meeting .. illegal advise. J.'ilfh; Kelner that the motion had been rescinded. Councillor Stoddart stated he had received a notice for a Committee meeting but had he known it was a Council meeting then he would have been here on time •. Further discussion took place in connection with this matter and it was finally outlined by Mayor Murray .that one person who was at the Special Meeting might move that the Motion concerning the payment of capital levies be rescinded.: · ADAIR: DAVIDSON: "That the minutes of the Special Council meeting held on Tuesday, September 15th, 1959 be accepted with the exception that the clause relating to .the resolution regarding payment of capital levy moni.es on behalf of Sunnybrook Investments Limited be rescinded," Carried. Councillor Patrick requested members of Council to give some thought to the. problem of snow ploughing the streets in Town and the new subdivisions during the com~ng winter prior to Thursday night's meeting this week. Deputy Reeve .. Nisbet. asked regarding· a price on a sidewaik .. to be. constructed on Yonge Street at the south end of Town and mayor Murray stated that the public school at Regency Acres didn't open this day and it is ass'umed that it will not be opened until three or.four more weeks. Mayor Murray stated that these children, approximately 200, now will have to travel up Yonge Street t.o Wells Street Public School and it did not appear right to ask theiU to cross Yonge Street at mur:ray Drive to get to a sidewalk con{3tructed on the east side of Yonge Street. Mayor murray thought it better if_the children were to travel down the west side to Churoh Street where there i.s a school crossing and a guard. Deputy Reeve Nisbet ag:reed that it. will be dangerous to cross at ''this intersection but so will different spots on the west side, Deputy Reeve Nisbet felt ,., '' 186 ' . September. 21, . 19·59 ~ 10 -19TH REGULAR it may be possible to obtain a school crossing guard for Murray Drive and felt that it was easier to construct a sidewalk on the east side of Yonge Street. Reeve Davis felt that Aurora is now faced with putting in cross-walks and thought that the Police Gommittee should investigate this matter. Deputy Reeve Nisbet advised that the Ghief of Police is obtaining information on these cross-walks at the present time, Gouncillor Davidson ~elt that the entrance and possible exit from the shopping cen-tre onto Yonge Street would interfere with ·this sidewalk on the west side of Yonge Street~ Deputy Reeve Nisbet asked how this matter can be expedited in that we don't have to wait for another Gouncil meeting. Gouncillor Adair asked. if it could be considered building a sidewalk on both sides of. Yonge Street. PATRIGK: DAVIDSON: "The Works Gommittee recommend that the tender of the Miller ~aving Gompany of ,86!¢ per running foot, 4' wide for the construction_ of a sidewalk &t the south end of Town on the . West side of the highway be accepted. and the Seal of. the Gorporation be attached. her.eto, 11 Garried, ' Gouncillor Adair inquired as to.what had happened with regards to a representative visiting Aurora from. the Gonservation Branch o.f the Department of Planning and Development in regards to the springs in Regency Acres Subdivision. The Glerk was instructed to follow this matter up and write the Gonservation Branch again. ~ouncillor Ghild stated that it was his understanding,from the Ghairman of the ·Planning Board that the Town of Newmarket are procee.ding with a large development and the Department of. Planning. and Development are. contributing half towards the cost, Gouncillor Ghild wondered why the Town of Aurora could not develop on the same basis and it was decided that this matter should be followed up. Gouncillor Davidson stated that a letter had been read out at a previous-meeting withregards.to an open ditch.at Regency Acres Subdivision and stated that he was not.sati~fied with these open ditches and felt that thesubdivider should be instructed to enclose the open ·ditch in the west end. Gouncillor Davi.dson was advised that this matter had been left to their Engineer and the Town Engineer and their decision had been to have this ditch closed in. Reeve Davis brought up the matter of a letter with regards to the firm of· Proctor & Redfern lbwering a watermain on Davia Drive-, Mayor Murray advised that Mr. Proctor had phoned, the matter··had gone from there to the Town PlanningGonsultants who will pay half' the cost of lowering this watermain, however, they would like to find out firstthe new contractor so the same contracting firm can do their job and this will take a day'·or· two to organize. · Goun:ci~lor Davidson.inquired about the digester roof at the sewage treatment plant and Deputy Reeve Nisbet stated that Mr. Proctor had advised that the present ,one. should be allowed a good test. Carried, Councillor Child then introduced a further 'amendment to by-law no. 1063 and felt that this further amendment should be incorporated in the amendment that had received two readings this evening. CHILD: DAVIDSON: STODDART: PATRICK: "That a further amendment regarding investigation fees be added to the amendmemt for third reading at the next council meeting." Carried.
