MINUTES - Council - 19590504I ! I~'; MINUTES OF THE lOTH REGULAR MEETING OF COUNCIL HELD IN THE COUNCIL CHAMBER ON MONDAY, MAY-4th, 1959 AT 8:00P.M. PRESENT: MAYOR: REEVE: DEPUTY REEVE: COUNCILLORS: DAVIS: NISBET: CORRESPONDENCE D,J. MURRAY (IN THE CHAIR) C.F. DAVIS C.K. NISBET ADAIR, CHILD, CORBETT, DAVIDSON, PATRICK AND STODDART. '.'That the minutes of April 6th and 20th, 1959 be adopted as printed and circulated." Carried. A letter from Roselawn Farms requesting permission of Council to distribute or sell milk products in the Town of Aurora was read. NISBET: PATRICK "That this matter be deferred until-the Town is advised of the decision of the Milk Control Board with regard to this application," Carried. A letter from the Aurora Town Planning Board with respect to an application of Mr. J. Crossland in connection with a plan of sub- division was read. - NISBET: DAVIS: "That.this'matter be referred to the Planning Committee to prepare a subdivision agreement." Carried. A letter from the Chief of the Aurora Fire Department thanking the Council for their generous co-operation shown during the recent Fire Marshall's School held in Aurora was read. DAVIS: "That this letter be filed." NISBET: Carried. Q •; ''" ""' Deputy Reeve Nisbet at this time suggested that a letter be sent to Mr. J.A. Marrese thanking him for allowing the Fire Department to burn a house on his property in conjunction with the Fire Marshall's School. A letter from Kmlborn & Associates, Engineers, regarding Sunnybrook Subdivision with more particular respect to outside services was read. It was decided that this matter be held over until the Town has heard from Town Planning Consultants Ltd. regarding the feas- ability of outside services as proposed. .,r I - 2 -38 A letter from the A~rora Lions Club requesting CouncilJs permission to use the Town Park to hold their annual May 24th Carnival and Fireworks Display. DAVIS: STODDART: "That permission be granted to the Aurora Lions Club to h9ld their.annual May 24th Carnival and Fireworks Display at.the Town Park on Friday evening, May 22nd,.l959." . ~~~e~ Deputy Reeve Nisbet stated that the Lions Club should be encouraged .~.··. in proceeding with the work in connection with the construction of a band.snell. The Motion was then Carried. DELEGATIONS Mrs. Thelma Fielding appeared before Council and introduced a Mrs. Joyce Thompson of 89 Wellington Street East. Mrs. Thompsom requested council's attention in the removal of trees in front and on the side of hercproperty and possibly including a tree in the middle of the road. Mrs. Thompson stated that branches and leaves are falling on her verandah roof and causing rot and in addition a sewage problem has occurred due to roots. It was decided that this matter be referred to the Property Committee for investigation and recommendation. A Mr. James Otten of Newmarket appeared before Council on behalf of Mr. Alan Cossar and advised that Mr. Cossar.has let his contract for the commencement of the shopping centre on.his land at the south end of Aurora. Mr. Otten. further stated taat Loblaws are committed to utilize approximately 16,000 square feet of a portion of this land set aside for a shopping centre and read a letter from Loblaws confirming this negotiation for a store. Mr. Otten said that Mr. Cossar had asked him to inform Council that he intended to commence construction this week but due to a death.in the family commencement of the work will now be postponed approximately 10 days. Mr. D.C. Vanek appeared before Council with Mr. Kelner and Mr. Sepejak with regards .to an apartment location on Wellington Street West and requested Council's permission to finalize this matter. Mr. Vanek stated that the Planning Board had recommended this site as appropriate for apartment houses. Mayor Murray advised Mr. Vanek that a committee meeting was required to bring a conclusion this matter and felt that a Council meeting was not the proper place to go into this matter at this time. It was then decided that next Monday evening, May 11th at 9:00 p.m. a Committee meet!.ng would be held with Mr. Vanek with respect to this matter. ' Mr. Robt. Case appeared before Council and requested inform~tion with regards to how far they must proceed in balancing residential assess- ment with commercial or industrial assessment in order to carry on with the balance of Mr. Cousins houses. After general discussion the following motion was proposed. DAVIS: NISBET: "That permission be granted to issue permits to Mr. Cousins for the balance of the 7 lots of the subdivision subject to an undertaking with regards to balance of assessment being signed." Shankman and Mr. Zeldon appeared before Council on behalf of Consolidated Building Copporation with the request that their application for a permit to erect a shopping centre on the commercial zoned :QrOperty on Yonge Street South be approved by Council., Mr. Shankman advised Council that they aad obtained a permit from the Depart111ent of Highways with respect to this shopping centre and that Consolidated Building Corporation were desirous of balancing their residential assessment with commercial and/or industrial assessment and would like permission to complete this shopping centre as soon as possible • Mr. Shankman stated that if they were allowed to proceed with this shopping centre they would put in Regency Drive Road and also erect two small'indi!lstrialplants on a speculative basis. Mr. Shankman further stated that if·was his understanding that there was a possibility that an industry might desire to locate in this area. Deputy Reeve Nisbet asked Mr. Shankman how long would they wait before starting the shopping centre. Mr. Shankman replied that they will certify to wait any length of time Council might decide upon •. · "Reeve Davis asked MI'. Shankmaa if they had been approached.bythis industry itself·and Mr, Shankman replied No, by their Consultants only. Councillor Child stated that it w.as hi·s understanding. that the industry is. now located • ln Toronto and takes up a whole·city block however they wish to move· in order that they may expand their plant. Councillor Stoddart stated that he was in favour of MI'. Shankman's idea and admired his.willingness to•wait until a stated date. Mr. ·Shankman then advised Council that it was his desire to avoid a reoccurrence ·Of last years build:l,ng•conditions in •that, houses were .built during ·the winter which proceedure was not reconilllended amd this year he desired the release of the balance of his lots namely 218 so that they may be completed, the roads paved and all tidied up before the start of next ·Winter. The following motion was then proposed: . DAVIS: CORBETT: · "That permission be grarited to Consolidated Building Corporation to complete the balance of the subdivision namely218 lots provided that Consolmdated Building Corporation post a. bo.nd satisfactory. to the Town with respect to balancing of commercial and/or industrial .assessment and that a time limit be set." Carried. Mr. J .ilL Marrese ·representing Aurora Height Subdivision appeared /~ before Couneil and presented a plot plan of a proposed neighbourhood shopping centre on Yonge Street North and requested Council's teneative approval with regards to this initial layout prior to his obt.aining final plans for this neighbourhood centre. Council discussed and viewed this plan thoroughly and allowing for certain changes approved tentatively this initial design • ... ,,. - 4 -98 Mr. Marrese then requested CouncilJs permission with regards to curbs on Aurora Heights Drive and stated that he was desirous of using a roll type curb instead of a box type as·presently being used, Mr. _ Marrese explained that the benefit derived from the roilil~ype of curb as far as he was concerned was that it eliminated:the·necess:j:ty of preparing cuts ~n the box type curb for driveways and,should these cuts be made prematurely and the houses built not in accord- ance with the? cut at a future dat.e then the driveway cut must be altered accordingly. Mr .• Marrese further stated that the uee of the roll type curb will allow him to negotiate.with.Wimpey Construction for the immediate start of completion of the curbs and the gravel roads. Council then gave approval touse the roll type curb in the Auro-ra Heights Subd:lrvi.sion ,_ REPORTS OF COMMITTEES Deputy Reeve Nisbet brought to Council's attention that Council were welcome to_attend theFire Department Mutual Aid meeting on Wednesday, To~. of :NewmarJtcet. Other Company say it is not required, The Committee recommend that the tender of Beamish Construction at $5,632.00 be accepted. PATRIC.K:. DAVIDSON: "That.the report of the Public Works Committee re accepting the tender of Beamish Construction at $5,632.00 for resurfacing certain streets in the Town of JAurora.be accepted and the Seal of the Corporation be attached hereto." Carried. Councillor Child stated that Mr. L. ::Lee and Mr. J. Cvossland' s subdivisions agreement wiJ,l be further pro.cessed at a pl~n11ing meeting to be held on Wednesday evening of this week. UNFINISHED BUSINESS General discussion took place concerning permits being held up at the present time until the situation of weeping tiles entering the Sewage System was finalized. It was finally decided to obaain an opinion of the Ontario Water Resources Commission and the following motion was passed. NISBET: DAVIS: - 5 - "That the Ontario Water Resources Commission be requested to advise if they are aware of weeping tile creating a problem of water overload in the Sewage Treatment Plant and if in their opinion if it is harmful or advisable to allow this to continue. The Clerk was then instructed to phone the Ontario Water Resources Commission on Tuesday morning and ask them to confirm their recommendations by letter." Mayor Muraay brought to Council's attention that almost 50% of the 1959 tax levy had been collected in the Municipal Offices during the month of April. It was the general feeling of Council that this situation augered well for the citizens of the Town of Aurora with regards to the payment of their taxes. NEW BUSINESS Reeve Davis advised Council that on next Monday evening the Rotary Club of Aurora have a guest speaker .. Mr. Ashworth who is the President of the Toronto-Dominion Bank and Council and their wiFes are invited to this maeting. ~ Deputy Reeve Nisbet stated that the Mayor will be attending the convention of the Mayors and Reeves Association to be held in St. Catherines this week and the following motion was Carried. NISBET: DAVIS: "That the Mayor be allowed $200.00 expenses to attend the convention of the Mayor and Reeves Association in St. Catherines." Carried. 99 Deputy Reeve Nisbet brought to Council's attention that in the past the Town has deferred action with regards to sidewalks till August in the year. However Deputy Reeve Nisbet felt that. the sidwalk on George Street at the Public School and the sidewalk at the south end of Town by Regency Acres Subdivision should be started without delay. Reeve Davis stated that he had heard nothing concerning the extension of water services across Yonge Street and was advised that permits from the Department of Highways had been received this day and it was a matter of processing these permits for Department of Highways approval. Councillor Patrick stated he would like to see a deposit paid prior to the commencement of these undertakings. Mayor Murray brought forward the question of the sale of fireworks in the Town and it was decided to request the stores in Aurora to withold the sale of fireworks till a week prior to Victoria Day.
