NISBET: CHILD: "That this letter be referred to the Chairman of the Finance Committee." Carried. A letter from Miss M. Andrews, Librarian, Aurora.Public Library re- ferring to a grant payable to the Library Board, 1959 and detailing the activities of the Public Library together with the request that Council consider the problem of extra space required by the Library Board due to the growth in the Town was read. NISBET: CORBETT: ·"That this letter be referred to the Chairman of the Finance Committee for study and report." 1 " ... ,j Councillor Davidson stated that he felt that this letter and its contents should be discussed thoroughly tonight. The motion was then Carried. A letter from Judge D. Webster or' the County of York Juvenile and Family Courts thanking the Aurora Town Counpil and other employees of the Town of Aurora in making their stay in Aurora a pleasant and congenial one was read. STODDART: "That this letter be filed." NISBET: Carried. ¥ A letter ,from the Secretary of the Aurora Town Planning Board recommend- ing that a motion insist on a fully ~imensioned Lot Survey, certified by an Ontario Land Surveyor be obtained prior to the issuance of a Building Permit was nead. Councillor Child advised that this matter had been brought forward due to errors occurring in various lots in the Aurora Heights Bubdivision. CHILD: - ;PATRICK: "That this matter be held over for Unfinished Business." Carried. A letter from Pearce Construction Company with respect to their with- drawal from responsibility in connection with the digester roof nepairs .at the Sewage Disposal Plant and a request that their account be paid in full was read. NISBET: . ADAIR: "That this matter be referred to the Chairman of the Works Committee for perusal and investigation." . Carried. '· A letter from Mr. R. Brooks requesting that ·a:. memb.er of the Aurora Minor Hockey be appointed to the Town of Aurora Memorial Arena Board was read. • l 4 3RD MEETING CHILD: NISBET: - 6 -January 19, 1959. "Recommend that this matter be referred to the Chairman of the Services Committee to investigate." Carried. · Mayor Murray took the Chair at this point. DELEGATIONS Mr. J. Offord appeared before Council on behalf of the Aurora Public Board and presented to Council plans of a proposed school buildings for the coming year. Mr. Of~ord stated that with approximately 500 homes completed and occupied by September in Regency Acres and also with approximately 150 at Sunnybrook Subdivision, this would mean a total of 650 homes this year and approximately 650 pupils. Mr. Offord stated that·in Aurora Heights it was actually running about .8 pupils per home.Mr. Offord further stated that at the present time we have 25 class rooms and approximately 812 pupils. In this instance we have reverted to a two storey building since the amount of land limits the size of the school allowed and the cost of a two storey is very little different ·from the cost of a one storey. Also as of October, 1958 fire regulations were increased and this increases the cest of the school since material must be acoustic tile, resist fire to a much greater degree etc. ·Mr. Offord stated that these requirements come from the Fire Marshall's office. The plans were approved by the Department of Education up to the total amount of $320,000.00, the ·· building was estimated to cost $334,000.00 and after total outlay including fences, grading landscaping etc. the cost would amount to approximately $390,000.00. It was stated that the differencez.of approximately $70,000,00 will be chargable against the Town since this amount would carry no grant from the Department of Education. Mr. Offord then presented to Council a picture of the proposed two,.. storey building and mentioned that it would be easier to hea~ and maintain this type of structure. • . ./ · j Mayor Murray stated that the debenture issue for a school' (#i.-this I ' size could possibly cost $23,000,00 per year to carry for a twenty year period, Councililior Child stated that he trusted that American style'bricks and American built boilers system may not be used because of unforseen delays that might occur in obtaining these bricks and boilers. Councillor Child stated that we should make very sure of all these items prior to the final plans being OK'd. Mr. Offord stated that it was their hope that several firms bid on the construction of the school and the contractor should decide on the type of brick used. Deputy Reeve Nisbet asked if a meeting between Council and the School Board be arranged and it was decided that this meeting be heid on Monday, January 26th at 9:00 p.m. Mrs. Gibb, Councillor of Whitchurch Township, appeared before Council and presented to Council a Mr. Ken Robinson of Lake Wilcox who desired to apply this evening for a taxi license in Aurora. Mrs. Gibb stated she could recommend Mr. Robinson very highly for this business venture. Mr. Robinson spoke on his own behalf and stated that several'requests from Aurora for an additional taxi bad been received by himself. Mr. Robinson stated he would operate out of Lake Wilcox .. and have one car and a stand at Aurora. Mayor Murray advised Mr. Robinson that the taxi .; ) • L~ ~ . ' [, January 19, 1959. - 7 -3RD MEETING 15 lic.ense regulations were coming up for review very shortly and at this time it will be decided how many taxis are required in the Town. Councilior Stoddart asked Mr. Robinson how long he had operated a taxi business in Lake Wilcox and Mr. Robinson reg']:;ied that he had operated one cab for approximately 2t months. Mayor Murray advised Mr. Robinson to send a letter to the Town of Aurora stating.his offer with regards to a taxi outlet ana Mr. Robinson would be advised accordingly when the reviewal of the taxi regulations has been made. Mrs. Fielding appeared.before Council and introduced a Mr. Laughlin and stated that Mr. Laughlin was thinking of settling in Aurora and was interested in the six lots on Kennedy Street West. Mrs. Fieldling stated that Mr. Laughlin was arucious to know what Council expected him to do by way of a road and services with regards to these lots. Mr. Laughlin stated that the six lots in question are not services whatsoever and would like to know the basic cost required. Mayor Murray advised that this would be considered as a subdivision and the subdivider m~st put in all services. Councillor Child: stated that the requirements for six lots or a large subdivision are the same and he would be required to put in a road and run in a watermain from Kennedy Street. Councillor Child asked if. it was his plan to buy the whole_s~x lots and Mr. Laughlin replied Yes, including the sixteen (16 1 ) foot strip petween the lots, Councillor Child stated that the road was to be up to Department of Highways specificationsand must meet these specificat!boJ:J.S before the road would be taken over by the Town after a thirteen month period. Mr. Laughlin asked if he must obtain an outside contractor to instal the watermain. Council~or Child stated yes as we have neit,her the men nor the equipment to do this work. Also Councillor Child stated that one hydrant would be required at his expense and actually anything to develop thi,s land will be at your expense. Councillor Child also stated that he presumed .it would be to Mr. Laughlin's advantage to build ho~es to the formulae basis in other words the-assessment of .the houses would need to carry themselves at approximately $7,bOO.OO asseesment.value. · Mayor Murray stated that a $20,000.00 hom~ would possibly carry itself whereas a $15,000.00 home may be a burden on the Town. Councillor Child stated that the Capital Levy required at the present time is now $500.00 per dwelling and would like to present this matter to ac:Commi ttee. .. to ascertain the further reasoning of Council.. . . . Mrs. 'Fielii.ng stated it was her understanding· .that a minimum of 1,500 sq. ft. for a building wws required· in this area. Mr. Laughlin asked about hydro and Mayor Murray stated that the poles supporting the ~ street lights and the lights themselves are chargable to him. Mr. Laughl'in then stated that he would like to think about tonight's discussion and assess the basie cost. Counc'illor Child stated what when Mr. Laughlin reached the final stag& we will be glad to have a committee meeting and draw up a tentative sgbdivis:ton agreement. Mayor Murray suggested that Mr. Laughlin Jmgg:eE:tl!!l!ix meet with Councillor Child when they are able to and discuss this matter fully. Mrs. Fielding asked Council what his feeling was~;regarding a private road. Councillor. 'Ch'ild stated that with a private road must grant a t f, 3RD MEETING - 8 - January 19, 1959 -right of way and the responsibility of upkeeping the road would be Mr. Laughlins. Mrs. Fielding stated that she had heard it cost .85¢ per foot and Councillor Child asked Mr. stan Murray what is the cost for a road and Mr. Murray advised approximately $5.00 per foot including services. REPORTS OF COMMITTEES Deputy Reeve Nisbet presented a report of the Finance Committee • Subject: Electric Typewriter in which the Committee respectfully· ·-·~ submit the following: The-finance Committee met on January 14th, 1959 in connection with the purchase of an electric typewriter for the general office and the following tneders were submitted: Gross Net Underwood -20" Olivetti -21 11 Smith-Corona -21 11 Remington -'20" I.B.M. -16" $560.00 525.00 545.00 555.00 525.00 $560.00 472.50 -less 2% 10 days 490.50 471.75 525.00 The Committee recommend that the I.B.M. electric typewriter at a cost of $525• 00 be purchased. / NISBET: STODDART: "That the report of the Finance Committee re the purchase of the I.B.M. electric typewriter at a cost of $525.00 be approved and the Seal of the Corporation be attached hereto." Discussion of this motion took place and Deputy Reeve Nisbe~ said " that the general office had checked on various type~iters ~nd have tried several makes and it·was felt that since the service of the I.B.M. machine is excellant that this machine be recommended for punchase, Councillor Stoddart stated that from his experience the I.B.M, 's service was indeed exceptional and would recommend the 4 I.B.M. above all other makes. Councillor Child stated that if Sterling Drug have numerous of these machines that they are going to require one man alone to service them and felt that the Town may be left out with this situation. Councillor Child felt that the extra money involved in the purchase of the I.B.M. is not warrented, Mayor Murray stated that he was in favour of the Olivetti himself but he changed to the I.B.M. because of the service available and • also because it is Canadian made. ~ Deputy Reeve Nisbet stated that although the Committee recommended the I.B.M. he would rather we have purchased a machine in Aurora. The Motion was then Carried. .Ill __ ,, . :~, Deputy Reeve Nisbet presented a report of the Finance Committee. subject: Graphotype Machine_ in which the Committee respectfully submit the• following: The Finance Committee met on January 14th, 1959 and recommend that a graphotype machine be purchased from Addressograph-Multigraph of Canada Limited at a cost of $2,210.50 less rental paid of $210.00 being a net cost of $2,000.50 · .• J ·'' '[! ·;;!!' '•··.· ' January 19, 1959 - 9 -3RDMEETING i 1fl NISBET: STODDART: "That the report of the Finance Corrunittee re the purchase of a graphotype machine from Addressograph Multigraph of Canada Limited at a net cost of $2,000.50 be accepted."· Discussion of this motion took place and Deputy Reeve Nisbet stated that we had obtained this graphotype machine on a rental basis and the rental paid to date is deducted from the original cost. The Motion was then Carried. t: Deputy Reeve Nisbet brought to· council's attention that a·meeting had been held withthe Department of Highways and felt that the 50 m.p.h. spj:led limit on Yonge Street North would be too high and the 30 m.p.h. is too slow. Deputy Reeve Nisbet stated that on Yonge Street at the south end of Town it was decided to petition the Department/of Highways to prescribe a spj:led limit of 40 m.p.h. NISBET: .CHILD: "That application be made to the Department of Highways to prescribe a speed limit of 40 m.p.h. on both sides of Highway ll from Murray Drive to a point·parellel with the south limite of the Town of .!iurora." Discussion of this motion followed and Councillor Child advised that a survey had showed that the average mile per hour in this location i' 42 m.p.h. and this will allow a gradual increase from 30 to the 50 m.p.h. sp~ed limit. Mayor Murray advised Council that an order in Council is required since the Highway is in two Municipalit¥es and therefore we must make an application to the Department of Highways. Reeve Davis stated that this the hazaed in this location. to see the 40 m.p.h. zone at area. was a very sensible idea and should reduce Reeve Davis further stated he would like the north· end of Town prior to the built-up Councillor Davidson asked what happens to the speed limit when the' " shopping centre might go in at the south end and do we have to apply to the Department of Highways again. Mayor Murray advised that the Department of Highways will extend 40 mile speed zone over the first ridge after the.subway. Councillor Stoddart stated he was in favour of the 40 m.p.h. speed limit and felt that it was very sensible • [ • Councillor Corbett asked if the 40 m.p.h. speed limit at the north end would interfere with the road out of Aurora Heights Subdivision a,pd Mayor Murray stated that at this point the speed limit would be 30 m.p.h. The Motion was Carried. Deputy Reeve Nisbet brought to Council's attention a metter concerning wh¥'.two cars were towed off the hill on the roadway leading to Aurora , Heights Subdivision and advised that this read had been made impassable· due to cars stuck and one car in particular .blocked the road so no one such as the Fire Department would get in therefore the car was towed away to open this road. Deputy Reeve Nisbet stated further that the Police Chief advised that any road that can be taavelled on without ~ ·.f. t83RD l}lEETING -10 -Janaary 19, 1959 asking permission to do SJ is under police jurmsdiction. Deputy Reeve Nisbet brought to Council's attention the matter of dog control and· atated that a Mr •. Lowe had been located at Bradford and the following suggestion has been put forward whereby Mr. Lowe would be engaged by the Town as a dog catcher on a retainer fee of $20.00 per month plus $5.00 per dog caught&this $5.00 fee would be paid by · the owner on his appearance at the pound to claim the dog. However if the dog w~s destroyed then the Town would pay $4.00 per dog. Deputy Reeve Nisbet further enlarged that if the dog picked-up carried a Town tag then the dog catcher would report to the Town office and obtain the owners name and phone• him so that the owner may have the option of claiming his dog in the Town of Aurora for a fee of $5.00. Deputy:Reeve .Nisbet stated that we have beenverylenient with dog control and have been critized for this and feel that the dog catcher is the proper solution to the dog control problem. Deputy Reeve Nisbet recommended that the Town of Aurora enter into a contract with Mr. Lowe and try this procedure for awhile at leazt. Councillor Adai~ ~sked what would happen if the owner does not pay the $5.00 fee. Deputy Reeve Nisbet stated that the dog catcher has the authority to either destroy or sell since the dogs would become his property. Councillor Davidson stated that this calls for a dog control by-law and deserves a Committee meeting to line up a good ~og by-law and one ~· we might stay with. Councillor Child asked where the $5.00 fee was derived when to his knowledge the City of Toronto charge a $3.00 fee. Councillor Stoddart asked what the cost was to the Town mf a dog was unclaimed and Deputy Reeve Nisbet stated that the cost $4.00 per dog, plus $20.00 a month. retainer fee. Reeve Davis said this could be a good idea to show we are attempting to control dogs.since the owners are apparently not.& we should have a meeting and discuss this whole situation further. Councillor Davidson stated that he had received a complaint thid day and the person had remarked that their·child was knocked down and bitten and their is talk about a petition coming in to Council, NISBET: STODDART: "''' "That we enter into a contract withMr. W. Lowe to appoint him as dog catcher for the Town-of Aurora and amend our Dog-Control By-law immediately follow- ing its reviewal.·~ " Cot!ncillor Davidson stated that last year he had read in Civic Magazine where a Town up north had hired a man and paid him only $2.00. Councillor Adair stated that it would be a good idea to put -this matter into operation right away. Deputy Reeve Nisbet agreed with this statement and suggested that we could·do this and amend the by-law later. Councillor Davidson asked how many 1959 dog tags had been sold and it was stated that approximately 12 only this. year. The Motion was then Carried. ~~J • · •. l January 19, 1959 -ll: -3RD MEETING 19 Councillor Patrick presented a report of the Works Department Committee Subject: Working Conditions Re: Mr. Alex Higgins: in which the Committee respectfully submit the following: That Alex Higgins of the Waterworks Department who has been on a weekly wage and living at the Waterworks house on Yonge Street South, will; as of January 15th, 1959, be paid as an hourly rated employee under the Supervision of the Town Superintendent. He will pay rent to•the Town for the use of housing accomodations at the waterworks and his duties after 5 o'clock will be to ke.ep guard over the pumping operations and to report anything unusual that might happen over night to the Waterworks foreman or to the Town Superintendent. PATRICK: DAVIDSON: "That the report of the·works Committee re the working conditions of Mr. Alex Higgins be aceepted and the Seal of the Corporation be attached hereto." Deputy Reeve Nisbet stated that it was felt that a fair rent for the Waterworks house would be $80.00 per month but if Mr. Higgins takes on the extra duties then the rent would be reduced to $40.00 per month. ~ The motion was then Carried. Councillor Patrick presented a report of the Works Department Committee Subject: Overtime for Works Department Employees in which the Committee respectfully submit the following: That the hourly rated employees of the Town of Aurora Works Department be granted time and on half for overtime work. The provisions of this article shall not apply to employees on a weekly salary. The regular work week shall consist of 44 hours made up as follows: Monday to Friday inclusive 8 hours per day, starting at 8:00 a.m. and finishing at ~:00 p.m., 4 hours on Saturday from 8:00a.m. to 12:00 noon, with one hour for lunch at 12:00 noon. Overtime at the rate of time and one half the employees rate for the week shall be paid for all work performed on Saturday afternoons, Sunday and for all work performed over 8 hours in any one day, over 4 hours on Saturday, or over 44 hours per week. Employees will·be·paid for the following Statutory Holidays- New Years Day, Good Friday, Victor':i:a Day, Dominion-Day, Civic· Holiday, Labour Day, Thanksgivi.ng and Christma:s; Employees requested to work on Statutory Holidays will be paid as follows: straight time for all hours worked. PATRICK: DAVIDSON: "That the report of the Works Committee re overtime for Works Department employees be accepted and the Seal of the Corporation be attached hereto." Discussion took place and Councilmor Davidson suggested that the wording of·the Committee report could be interpreted differently re Statutory Holidays worked because in the report it was referred to a special paid day. Councillors Adair and Child aggeed that you are referring to a specific day and should read up to 8 hours and anything over :!:s·overtime. It was recommended that the report be changed accordingly and a rider included that at the time the workmen go on summersschedule xu then the recommendation shall include 7:30 a.m. to 5:30 p.m. The Motion was then Carried. • 3RD MEETING 20 -12 -January'l9, 1959 Councillor Child brought to Council's attention that an application for a permit to operate a leather goods'company in Town had been received and that this application must be approved by Council because it is a change in occupancy. CHILD: DAVIDSON: "That we accept this application for a Leather Company known as Aurora Leather Goods Company that the necessary permit be granted." Good and $ Discussion followed and Councillor Adair·asked how many employees will be employed by this Company. Councillor Child stated that it was his understanding that the Company will employ between 15 and 20 in approximately one year's time. Councillor Adair stated that he was concerned who located in this area because it was across the road from his residence. The motion was then Carried. Councillor Child then saated that at last Council meeting permission was given regarding the establishment of a Hairdressing Salon at · Kitimat Cres. in Aurora Heights and it was now found that this per- mission was in direct contrevention of By-law No. 1246 of the Town of Aurora and that Council had no other recourse but to withdraw the permit and rescind last Council meetings motion. Deputy Reeve Nisbet felt that we could possibly OK this and if necessary change the by-law. Deputy Reeve Nisbet felt that this establishment was required up in Aurora Heights. Councillor Child stated that we are. trying to grow and must put some teeth in our By-laws and feel thatthe Yonge Street business section is the area in which business should locate. Mayor Murray stated that if it's established that the by-law is contravened then we have no alternative but to rescind this permit. This matter was left until 'Mr. L. Lee, Town Solicitor, might attend the meeting. Councillor Child then brought to Council's attention the matter of variations in lots in Aurora Height Subdivision. Councillor Davidson asked if this was done deliberately to give more lots and Councillor Child stated he did not think so, and did not think it.feasible .to be out so little by two different'Land Surveyors. Deputy Reeve Nisbet asked why the Committee of Adjustment 'would not handle this matter of the smaller lot differences. Councillor Child, in reply, stated that the majority feeling of the Committee of Adjustment was that it's the principal involved and if it is the result of faulty workmanship or layout they should not be considered by the Committee of Adjustment. Mayor Murray then outlined to Council the history of this application made by Aurora Heights for relief frmm By-law 1051 and its amendments. Councillor Child stated. that the motion of the Planning Board is the only way we are going to control these lots in future also that C.M.H.C. require lots be surveyed on application for mortgage 'and then if the building was on the lot in the wrdmg place very little, can be done at that time. Councillor Child further stated that Mr. Thompson of Reycraft, McDonald ~ Thompson, solicitors for Aurora Heights, had a talk this day and it was felt that 40 m&~ 10ts out of 208 was a large percentage however Mr. l ,• \ I L..~-~·.' Mayor Murray stated that this should not be since this is the last of Stage-1 and hopes· thatvvery stringent control obtains.in.Stage 2 when it is undertaken. "That the Council approve the recommendation made by· the Aurora Planning Board on Januaryl4th, 1959 covering the issuance of.a Building Permit in that a fully dimensional lot survey certified by an Ontario Land Surveyor be presented prior to the issuance of a peDlllit and that the location of the house be shown by stakes and batter boards on the lot itself and be examined by the BuildJhng Inspector." Carrfued. It was stated that Mr. King, Building Inspector, should stamp this requirement on every buil~ing permit to the effect that the builder is responsible for any errors that occur. The Clerk was instructed to forward a l.etter to the Planning Board stating that Council approve their motion. Mayor Murray stated that he had been1n touch w1th the Department of Highways.and they have stated that they have approved of the lower1ng of the grade on Yonge Street South and it was just a matter now of approving plans etc. Councillor Child stated that a letter be sent to the Planning Board stating that the above approval had been obta1ned and asking the Plann1ng Board if they would reconsider amending the Land-Use correspond- 1ngly. Also in the same l·etter ask what progress 1s being made re Mr. Cossar' s shopping centre·, that was ,prev1ously deferred. Mayor Murray brought to Counc1l's attention that on Wednesday afternoon January 21st, 1959 between 4:00' and 6:00 p.m. Town of Aurora w1ll hold their annual party at the County·build1ngs and Councillors andtheir wives are inv1ted along with Town staff and the sol1citor, Mr. Lee. Mr. Lee, Town Solic1tor, appeared before Council concerning the matter of a Ha1rdressing Salon perm1t authorized to be .issued to a resident in ·Aurora Heights to.carry on a hairdressing business in her residents and 1n this connection Mr. Lee said that he bel1evesa contraventionof the by-law had occurred and.that only a med1cal doctor may operate from his, home. Mr.} Lee then read By-law No. 1246 and agreed that Council were 'in error ingranting permiilsion. and that Counc11 m1ght rescind afJ passed.· ,p. 3RD MEETING 2. ~! -13 -January 19, 1959 Councillor Davidson asked_ what if the woman involved purchased a great deal of equipment and Mayor Murray advised that the permit has not yet been granted. Councillor Corbett asked if this same by-law will apply to other hairdressing establishments in homes in all parts of Town. Councillor Child .stated that we are not able to make a by-law rectro- active. Deputy Reeve Nisbet felt that the by-law should be amended in this instance. Carried. because Mayor Murray asked Council if they would peruse prior months Council minutes between now and the next meeting of Council. Councillor Patrick referred to the matter of Pearce Construction and the dome on the digester at the Sewage Treatment Plant and stated that a Committee meeting would be required. It was decided to hold a Works Committee meeting Monday, January 26th at 7:00 p.m. Mr. S.T. Murray, Town Engineer, thanked Council for it's approval of his previous work andhoped that he would be able to do bettwr as a Town employee.
