"That the minutes of the meetings of March 31st, April 7th and April 22nd, 1958 be adopted as printed and circulated." -Carried. A letter from Mrs. P.D. Lloyd concerning the levelling of soil on Centre Street extension near the ne•r pump house -vras read. Reeve Davis suggested that this matter be referred to the Town Superintendent for further investigation. A letter from the Aurora Safety Council regarding painting lines on roads and intersection .and the installation of a 40 mile sp~ed limit on Yonge Street near Sterling Drugs "ias read. Reeve Davis recommended that this letter be referred to the Chairman of the Police Committee for further study. A letter from Proctor and Redfern regarding lost time experienced by lilherk Construction because they were unable"·to manoeuvre in and out of property was read, Mr. G.U. Proctor advised Council ~hat he was in agreement with this claim and further stated that the golf course had been put in excel~nt shape before any~grass cutting was required. Reeve Davis suggested that this matter, held over for L ... · further investigation. i' A letter from Choice Cut-Up Chicken Limited concerning anexation of that part of Whitchurch Township in 1•'hich they were located to the Town of Aurora ~,ras read. Deputy Reeve Nisbet recommended that this letter be handed over to the Chairman of the Planning Committee •. A letter from Mr. L.C. Lee, Solicitor, regarding easement of Colonel Dann's property and protection against any loss of trees due to installation of sewer and water mains was read. DAVIS: STODDART: 11 That the Mayor and Clerk be authorized to sign an undertaking to Colonel Dann l•Ji th respect to any loss sustained through damage to trees for a period not to exceed t-r,ro years." Carried. . .. , .. B7 BB -2-9 DELEGATIONS Murray Hodgkinson appeared before Council to enlarge on the letter from the Safety Council. He advised that it 'l'ras his understanding that Police enforce jaywalRers and this enforcement >vill be difficult•unless pedestrian lines are clearly painted on the roads. He further felt that the line£ on streets should be painted immediately and in ~ddition that the 40 mile limit bn Yonge Street near Sterling ~rug be endeavoured at once. Mayor Murray advised that there was correspondence on file and that this matter was under consideration at the present time. Mr. Lyle Sparks appeared before Council and requested consideration concerning the lot of Mr. Eli Wray on Centre Street and that Mr. Spark 1 s intended to buy. from Mr. Wray. Discussion took place concerning this matter in which Yw. L.C. Lee, Solicitor, advised Council that the difficulty lies in the amending by-law which requires a certain number of feet upon which a building may be erected. We must. conform with the re- quir·ements of this by-law illhich was approved b;y the Ontario Mun- icipal Board and unless this by-law is further amended and then approved by the Ontario Municipal Board any detour from the by- law· stipulations may n<Jt be ascertained. The solicitor felt that consideration might be given to any other lots in Town that do not donform to the amending by-law. Councillor Child stated that the Committee of Adjustment might handle specific circumstances such as this. Ho•ttever, Mr. Lee stated that this is a major matter and could not be handled by the Committee of Adjustment. Councillor Child felt that this depended on the interpretation of ma,lor and minor and although he stood to be corrected still felt that the Committee of Adjustment might properly handle. this situation. Mr. Lee still claimed that an amending.by-law was requ~red that would meet the approval of the Ontario Municipal Board. Councillor Child stated that even if the by-law was amended to include that certain area there may be other lots that fall below our minimwro. By-law No. 1051 and amendments thereto were brought into Council for perusal. DAVIS: CHILD: "That we apply for an early hearing by the Ontario Municipal Board re: amending by-lavl 10 51 as it pertains to Centre St. south side only. 11 . Following discussion on the motion Councillor Child felt that the motion should be reworded as "That Council look into the advisability of approaching the Ontario Municipal Board for such a hearing Re: amending by-laioT 1051 as it pertains to Centre St. Further discussion developed and then Councillor Child >·ri thdrew as seconder of the motion. CORBETT:. DAVIDSON: "That we have a special meeting of Committee of Council as a whole and Planning Board Chairman to designate old area of the Town and go into this matter thoroughly." Carried, ·<0.. I. -3- Councillor Stoddart asked Mr. Sparks information concerning the lot on Wellington Street West. Mr. Sparks advised that he had been granted an extension of time but at the present have only one enquiry concerning the use of this lot. He was now unable to pay the amount of monies per the agreement that were due Januray 1st, 1998, and would be only too pleased to meet with members of Council and iron out this situation in the near future. Mr.,H. Seston appeared before Council concerning the matter of the location of the swimming pool Mr. Seston read a letter to Council requesting consideration of an alternative site in which :ehe sw·imming pool might be erected on' the George Street school property notwithstanding the objection raised by Collis Leather in connection with this proposed location. Mayor Murray stated that the new proposed site may cause certain cost to the Town not previously anticipated. DAVIDSON: ADAIR: 11 That Council be in agreement with this site and support this proposed arrangement,11 Carried. Reeve Davis congratulated the swimming pool committee. and the school board for oi'fering to supply this site and felt this would blend in with the whole area. Mr. Arthur Wheelock appeared before Council and requested per- mission to attend the annual meeting of the Association of Assessing Officers this month. CHILD:. STODDART: BY-LAWS CORBETT: CHILD: 11 That the Assessor attend the annual meeting of Assessors to be held in Peterboro this month and that he be granted expenses not to exceed $7"5.00 and the Seal of the Corporation be attached hereto. ,•r Carried. 11 That leave be given to introduce a by-lfl.i'T to authorize the entering into an agreement with Dilcue Limited and that the same be. no1• read a first time.n Carried. B9 9 £:() -4-9 REPORTS OF COMMITTEES Fire and Water Committee Reell''e Davis presented a report of the Fire and Water Committee Re: Tenders -New Water Tower Base as follow·s: The Committee respectfully submit the following: That the firm of Angus Robertson Ltd. be awarded the contract for the construction of the base for the ne•r <rater tower for the sum of $29,940.00,.at mee~ing held at 5.15 PM. May 5th 1958. DAVIS: ADAIR: 11 That the report of the fire and water committee be accepted (Re contract for water tower b8se at a cost of $29,940.00) and_ the Seal of the orporation be attaehed hereto. 11 • Carried. Reeve Davis presented a recommendation of payment No. 2 Progress in favour of Sherk in the amount of $15,635.83. Proctor and Redfern for Construction Limited DAVIS: ADAIR: 11 That the account of Sherk Construction Co. for the amount of $16,115.98 be paid, dated May 2, 1958 and approved by G.U. Proctor, and the Seal of the Corporation be atta:Ched hereto." Carried. Deputy Reeve Nisbet presented to·Council a request from Proctor and Redfern that the To<m take over the Disposal Plant. It was decided that this matter be left in the hands of the Committee for further study. Deputy Reeve Nisbet presented a report of the Property Committee regarding replacing chimneys flues at Remington Rand Building, The Committee respectfully submit the following: An investigation was carried out concerning the cause of the explosion in the ~urnace of the Remington Rand Building. It was found that the condition existed which necessitated the complete rebuilding and lining of both chimneys which serve each furnace. It is therefore recommended that the tender of Ryder 1 s Complete Chimney Service Ltd. in the amount of $1,000.00 for the two flues as outlined in their tender description sheet attached hereto. DAVIS: NISBET: "That the Town Superintendent give further invest- igs.tion to this matter and bring in a report at the next Council meeting." . Carried. Councillor Stoddart thought it worthy of consideration at this time that the assessors who undertook the re-assessment of the Town before be requested to make an assessment of the Sterling Drug Manufacturing Plant when it is completed. Councillor Child brought tm Council's attention that the Planning Board and Planning Consultants had met and discussed the Town's arterial road plan and felt that Council and the Planning Board should get together so thePlanning Consultants may explain in detail what is occurring and all would be familiar with this matter. Mayor Muaray agreed Xhat this was an ex~llant idea and also stated that five year planning is a must today ~or a Municipality to base its outlook upon. Councillor Patrick stated that prices Re: streets maintenance 1•rere now forthcoming and a new· system would be undertaken this year in which tt~o streets would be done each day and the streets would be blocked off completely for a period of about six hours during this work. Deputy Reeve Nisbet brought to Council's attention that Toronto and York Roads Commission are assuming the entire cost of crossing . and .flasher maintenance. Mayor Murray reported that the Police Chief requested permission to go to Chatham for a Police Associates Convention this month. CHILD: NISBET: "That the Chief of Police be allowed leave and expenses up to $75.00 to attend the Ontario Chief Constable's Association convention at Chatham, Ontario May 21st, 22nd and 23rd and the Seal of the Corporation be attached hereto.11 Carried. Councillors Adair and Davidson desired to kno>v the reason why the To~m Police had picked up a motorcycle outside the Town limits. It was decided that the Mayor investigate this matter. Councillor Corbett asked if anything had been done regarding speeding on Wellington St. W. and was advised by the Mayor that the Police had been on duty with regards to speeding in this area. Mayor ·Murray further enlarged that due 4;o ne>v regulations that it takes two to three men to operate a speed trap and a extra man would be required during the summer months of July and August. STODDART: NISBET: 11 That the Police Committee look into the matter of hiring an extra policeman for the montl:;ts of July and August. " Carried. UNFINISHED BUSINESS Councillor Davidson enquired concerning sewers in Aurora Heights Sub-division leaking and was advised that this matter had been corrected. Mayor Murray discussed before Council the Municipal Franshise Bil 160 and suggested in his opinion there were two objections. dAti· " 9l ··• "' ~2 ·. - 6 -9 First, that this is a provincial matter and would recommend that everyone over 21 throughout the province and not by Munmcipality should be allowed to vote at Munfumipal Elections. And, secondly, that our own assessar might do the c.tnsus as ordinary assessment rather than a special enumeration prior to a ~unicipal election. Mayor Murray presented a le~ter from Proctor and Redfern Re: Aurora Heights sub-division stating it would in order for the Town to supply the sub-divider w·ith a letter certifying that thes.e underground services have been installed. The Clerk ivas in- structed to supply such a letter of release. Deputy Reeve Nisbet felt that Mr. ProctDr'should arrange for a tour of the Sewe.ge Disposal Plant with Council before the Town took over the Se"rage Disposal Plant. NEW .. BUSINESS Councillor Adair brought to Council's attention that a Mr. Ness had called him regarding a fence along his property between the McMahon Park and Craddock Farm and that children climbing thgough this fence were causing in~ury to his field crop.
