BYLAW - Part Lot Control Alcorn Gate - 20090924 - 511709D·-__ -.-' Alcorn Gate Home Builders Inc. THE CORPORATION OF THE TOWN OF AURORA By-law Number 5117-09 BEING A BY-LAW to exempt Lots 1, 2, 119, 120 and 121, 65M-4075, from the Part Lot Control provisions as provided in subsection 50(5) of the Planning Act, R.S.O. 1990, c.P.13 (as amended). (Report PL09-028, considered at GC 09-12, February 10, 2009) WHEREAS subsection 50(7) of the Planning Act, R.S.O. 1990, c.P.13 (as amended) provides that the Council of a local Municipality may by by-law provide that the part lot control provisions as provided in subsection 50(5) of the said Act do not apply to the land that is within a registered plan of subdivision; AND WHEREAS the Council of the Corporation of the Town of Aurora considers it desirable to enact a by-law pursuant to the said Act exempting the lands hereinafter described from the said part lot control provisions; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF AURORA ENACTS AS FOLLOWS: 1. THAT Subsection 50(5) of the Planning Act, R.S.O. 1990, c.P.13 (as amended) shall not apply to the following lands, all situated in the Town of Aurora, Regional Municipality of York: 2. Lots 1, 2, 119, 120 and 121, Plan 65M-4075, designated as Parts 1 to 11 inclusive, Plan 65R-31418. THAT this By-law shall take effect upon the approval of the Council of the Town of Aurora, and the registration of the By-law in the proper land registry office. No part of this By-law will come into force until the provisions of the Planning Act have been complied with, but subject to such provisions the By-law will take effect from the day of passing thereof. 3. THAT this By-law shall lapse after a period of two years from the day of passing. 4. THAT Schedule "A" hereto forms part of this By-law. READ A FIRST AND SECOND TIME THIS 24TH DAY OF MARCH, 2009.
