BYLAW - ZBA 219 Old Yonge - 20081209 - 5093DThe Corporation of the Town of Aurora By-law Number 5093-08.0 BEING A BY-LAW to amend By- law No. 2213-78, as amended, being the Zoning By-law of the Town of Aurora. (219 Old Yonge Street, File: 014-09-07) WHEREAS Section 34 of the Planning Act, R.S.O. 1990, c.P.13, as amended provides the Council of a local Municipality may pass a Zoning By-law; AND WHEREAS the Council of the Corporation of the Town of Aurora enacted By- law 2213-78 being the Zoning By-law, as amended; AND WHEREAS the Council of the Corporation of the Town of Aurora deems it advisable to further amend By-law 2213-78, as amended; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF AURORA HERBY ENACTS AS FOLLOWS: 1. THAT the zonirig category applying to the lands shown in grey pattern on Schedule "A" attached hereto and forming part of this By-law, is hereby amended from "Holding Row Dwelling Residential (RG-52) Exception Zone" to "Special Mixed Density Residential (R5-33) Exception Zone". 2. THAT the following be added as Section 14.3.33 "Special Mixed Density Residential (R5-33) Exception Zone". Section 14.3.33 SPECIAL MIXED DENSITY RESIDENTIAL (R5-33) EXCEPTION ZONE: (5093.08.D) 14.3.33.1 Uses Permitted: In accordance with Section 10.1 and subject to the zoning provisions of Section 1 0.2, with the exception that the minimum required interior side yard setback shall be 3.0 metres. The existing building on the lands zoned R5-33 on schedule "A" may be used for business and professional offices excluding medical offices, with the exception that the basement shall only be used for accessory storage to the office use, and in accordance with the following: i) The provisions of Section 14 shall not apply. ii) Notwithstanding the provisions of Section 6.27.7 with respect to a parking area in a front yard in any Residential Zone, a parking area shall be permitted in the front yard. iii) Notwithstanding the provisions of Section 6.26, the minimum required manoeuvring space in the parking area shall be 6.5 metres. 14.3.33.2 iv) Notwithstanding any provisions to the contrary, a minimum of 12 parking spaces shall be provided and two of the required parking spaces shall be permitted within the existing garage. v) The provisions of Section 6.27 .8.f shall not apply to the lands. vi) Notwithstanding the provisions of Section 6.31.2 (i) and (ii) no earth berm or fencing shall be required. Notwithstanding any provisions to the contrary, for the purposes of the R5-33 zone, Old Yonge Street shall be deemed to be the front lot line. THAT no part of this By-law will come into force until the provisions of the Planning Act have been complied with, but subject to such provisions the By-law will take effect from the day of passing thereof. LUCILLE KIN , TOWN CLERK Explanatory Note RE: Zoning By-law No. 5093-08.0 By-law Number 5093-08.0 the following purpose and effect: To amend By-law 2213-78, as amended, the Zoning By-law in effect in the Town of Aurora, to rezone the subject lands, municipally known as 219 Old Yonge Street, from "Holding Row Dwelling Residential (H) RG-52 Exception Zone" to "Special Mixed Density Residential (R5-33) Exception Zone." The subject zoning amendment will permit the use of the lands for business and professional offices in the existing single family dwelling and provides site specific zoning provisions to implement the approved site plan on the lands.
