"o ~ By-law Number 5085-08.0 BEING A BY-LAW to amend By-law No. 2213-78, as amended, being the Zoning By-law of the Town of Aurora. (14785 Yonge Street, File: 014-08-08) IIWHEREAS Section 34 of the Planning Act, R.S.O. 1990, c.P.13, as amended llnro"'u",""" that the Council of a local Municipality may pass a Zoning By-law; WHEREAS the Council of the Corporation of the Town of Aurora enacted by- 2213-78 being the Zoning By-law, as amended; WHEREAS the Council of the Corporation of the Town of Aurora deems it naclvis•able to further amend By-law 2213-78, as amended; IIN<)W THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN AURORA HEREBY ENACTS AS FOLLOWS: THAT the zoning category applying to the lands shown in hatching on Schedule "A" attached hereto and forming part of this By-law, is hereby amended from "Service Commercial (C3) Zone" to "Shopping Centre Commercial (C4-23) Exception Zone". THAT the following be added as Section 23.23 "Shopping Centre Commercial (C4-23) Exception Zone". 23.23 "SHOPPING CENTRE COMMERCIAL (C4-23) EXCEPTION ZONE" (5085-08.0) 23.23.1 Uses Permitted automobile service centre banks or financial establishments, including drive-thru bowling alleys business and professional offices clinics drug stores dry cleaning establishment (2597 -83) libraries, post offices and government administrative offices laundries gasoline bars and automobile washing establishments medical and dental laboratories places of entertainment, provided the use complies with the requirements of all applicable regulatory and/or licensing by-laws of the Town of Aurora personal service shops restaurants retail stores supermarkets 23. 23.1.1 23.23.2 23.23.2.1 23.23.2.2 23.23.2.3 23.23.2.4 23.23.2.5 Definitions: Notwithstanding any prov1s1ons to the contrary, for the purposes of the C4-23 zone, the following definition shall apply: Floor Area, Gross Leasable: Means the gross floor area measured between interior faces of any exterior or interior walls of the building or structure, exclusive of the following areas: i) any service room, or enclosed area that is used exclusively for the accommodation of heating, cooling, ventilation, electrical, mechanical or telecommunications equipment, or maintenance facilities that services the building or structure; ii) any part of the building or structure that is used as loading or parking area; iii) any part of the building or structure used exclusively as common areas, for the purpose of pedestrian circulation between stores or other commercial occupancies. Zone Requirements Lot Specifications In accordance with the provisions of Section 23.2.1 hereof, with the exception that the minimum lot area shall be 4300 square metres. Siting Specifications In accordance with the provisions of Section 23.2.2 hereof, with the exception that the minimum required side yard setback for the main building shall be 4.0 metres. Building Specifications Height (maximum) 15.0 metres Parking In accordance with the provisions of Section 6.26 hereof, the parking requirements for the shopping centre shall be a minimum of 4.5 spaces per 100 sq. m. of gross leasable floor area and such parking spaces may be provided either at or below grade. Loading In accordance with the provisions of Section 19.2 hereof. 3. THAT no part of this By-law will come into force until the provisions of the Planning Act have been compiled with, but subject to such provisions the By-law will take effect from the day of passing thereof. P~hWN CLERK Explanatory Note Re: Zoning By-law No. 5085-08.0 By-law Number 5085-08.0 has the following purpose and effect: To amend By-law 2213-78, the Zoning By-law in effect in the Town of Aurora, from "Service Commercial 3 (C3) Zone" to "Shopping Centre Commercial (C4-23) Exception Zone". The proposed amendment will permit the development of the subject lands for a 2 storey 3,608m 2 (38,837 fe) multi-unit commercial building comprised of a bank with a drive through, retail stores and offices on the 2"d floor.
