MINUTES - Special Council - 19901129MINUTES TOWN OF AURORA SPECIAL COUNCIL -PUBLIC PLANNING MEETING NO. 54-90 Boardroom York Region Board of Education Administrative Offices Thursday, November 29, 1990 COUNCIL MEMBERS IN ATTENDANCE 7:30 p.m. Mayor West in Chair; Councillors Jones, Mcintyre, McKenzie, Ochalski Pedersen, Stewart and Weller. Councillor Timpson absent due to a previous commitment. STAFF MEMBERS IN ATTENDANCE Chief Administrative Officer, Clerk, Deputy Clerk, Director of Planning and Senior Planner -Long Range. Mayor West advised that this meeting had been called as a Public Meeting with regard to the following matters: Application D14-29-90, Mannington Developments (St. John's) proposed modification to Official Plan Amendment #48, and Zoning Amendment; Inc., By-1 aw Application D14-30-90, Keystone Industria 1 Deve 1 opments Inc., proposed Zoning By-law Amendment, and; Application Dl4-31-90, L. Yermus c/o Engelhard Holdings, proposed Zoning By-law Amendment. The Pub 1 i c Meeting procedure and the opportunities avai 1 ab 1 e for concerned residents to ask questions of the proponent of the application scheduled for consideration were explained. Mayor West advised that any person who wished further notice of the passage of any of the proposed By-laws under consideration should sign the forms available before leaving the meeting. The Clerk advised that the required Notices of Meeting for these applications were posted in compliance with the Planning Act (1983), by First Class mail to the addresses within 120 metres of the areas as shown on the last revised assessment roll of the Town of Aurora, to which the proposed By-laws would apply. The necessary signs were posted on the various properties in accordance with the rules of the procedure under the Planning Act (1983). DECLARATION OF CONFLICT OF INTEREST There were no disclosures of Interest under the Municipal Conflict of Interest Act, 1983. APPROVAL OF AGENDA #744. CARRIED PLANNING APPLICATIONS Application D14-29-90 -Mannington Developments (St. John's) Inc. The Public Meeting began with the Director of Planning reviewing the contents of Report PL90-156-378, prepared concerning the subject application. Aurora Special Council -Public Planning Minutes No. 54-90 Thursday, November 29, 1990 · - 2 - Applicant's Comments Mr. Paul Bailey, of Mannington Developments (St. John's) Inc., stated that recent revisions of the application attempted to address the Town's and the adjacent landowner's concerns. Mr. Bailey indicated that the landscape buffer, fronting along Yonge Street, had been increased to an area ranging from 2.8 to 7 meters, which was the maximum buffer that could be provided, due to the restrictions against locating the structures further on the floodplain area to the east. Mr. Bailey noted that the conservation authority has given approval in principle to siting the structures partially on the floodplain. An application for the Ministry of Transportation approval of the location of an access route to Yonge Street has been submitted, and Mr. Bailey expects to have a response in early December, 1990. The Ministry has committed to providing 100% of the funding to rebuild the intersection at Yonge Street and St. John's Sideroad, which should alleviate concerns with regard to traffic safety before the project goes forward. Residents' Concerns Mrs. McKenzie expressed concerns that the seniors, who will reside in one of the new structures, will not have the necessary transit facilities or safe pedestrian access to services such as convenience outlets. In Support of the Application Mr. Martin Silver, Assistant General Manager with the Region of York Housing Corporation, indicated that his experience with seniors' housing projects suggests that seniors are retaining their vehicles and are generally able to commute to those services they require. He also noted that proposed developments adjacent to this project will contain service facilities. The Public Meeting closed, and Council's consideration began: #745. Moved by Councillor McKenzie Seconded by Councillor Stewart THAT Council approve the application in principle, subject to the applicant obtaining Ministry of Transportation approval, satisfying the concerns raised by Staff and ensuring that, when the lands relating to the two structures are severed, cross-easements are provided between the severed lands, such that an access route is maintained between the severed lands to provide the residents in each structure with ingress and egress from both Yonge Street and St. John's Sideroad. CARRIED Application D14-30-90 -Keystone Industrial Developments Inc. The Public Meeting resumed with the Senior Planner -Plans Administration, reviewing the contents of Report PL90-157-379, prepared concerning the subject application. Applicant's Comments Mr. Gary Shiffman expressed the applicant's desire for greater flexibility to respond to the needs of potential users of the site, given the current competitive market. He indicated that the building's attractive design makes it suitable for service uses, and that rezoning from M1 to M1-1 is not a significantly incompatible amendment, and is one that has occurred at several sites nearby. Mr. Shiffman took issue with the proposal that specific units might be rezoned, stating that the configuration of different units, plus the demands of the market, render it more appropriate that the applicant have the flexibility to choose which units, up to a maximum percentage of the area of the units, should fit within the proposed amendment. The public raised no concerns with the proposal. Moved by Councillor Ochalski Seconded by Councillor Weller THAT Council agree in principle with the proposal to amend the zoning by-law to permit M1-1 uses at the site up to a maximum of 20% of the total area of the structure including units 1, 2, 20 and 21, with the location of the remainder to be negotiated by Staff with the Owner and subject to assurance that the M1-1 uses permitted at the site will not be incompatible with the M1 uses presently permitted. .
