MINUTES - Special Council - 19900726MINUTES TOWN OF AURORA SPECIAL COUNCIL -PUBLIC PLANNING MEETING NO. 35-90 Boardroom York Region Board of Education Administrative Offices Thursday, July 26, 1990 COUNCIL MEMBERS IN ATTENDANCE STAFF MEMBERS IN ATTENDANCE 7:30 p.m. Mayor West Mcintyre, Pedersen, Weller. in Chair; Councillors McKenzie, Ochalski, Stewart, Timpson and Councillor Jones absent due to previous commitment. Chief Administrative Officer, Director of Planning, Acting Deputy Clerk, Planning Technician, and Senior Word Processor. Municipal Clerk absent on vacation. Mayor West advised that this meeting had been called as a Public Meeting for an application for amendment to the Official Plan for D. Haworth/669730, OP-04-90, and York-Cross Incorporated, OP-08-90, and for amendments to the Zoning By-law for D. Haworth/669730, Z-17-90, York-Cross Incorporated, Z-20-90, Blayrview Plaza Ltd., Z-21-90, and Jane Fraser, Z-22-90. The Public Meeting procedure and the opportunities available for concerned residents to ask questions of the proponents of the various applications scheduled for consideration were explained. Mayor West requested that any person wishing to receive Notice of the Passage of any of the proposed amendments should sign the forms ava i1 ab 1 e before they leave the meeting. The Acting Deputy Clerk advised that the required Notices of Meeting for these applications were posted in compliance with the Planning Act (1983), by First Class mail to the addresses within 120 metres of the areas as shown on the last revised assessment roll of the Town of Aurora, to which the proposed By-1 aws wou 1 d apply. The necessary signs were posted on the various properties in accordance with the rules of the procedure under the Planning Act (1983). DECLARATION OF CONFLICT OF INTEREST There were no disclosures of Interest under the Municipal Conflict of Interest Act, 1983. APPROVAL OF AGENDA #480. CARRIED PLANNING APPLICATIONS Proposal OP-04-90 and Z-17-90 -D.Haworth/669730 Ontario Ltd. The Public Meeting began with the Director of Planning reviewing the contents of Report PL90-102-211, prepared concerning the subject application. / Aurora Special Council -Public Planning Minutes No. 35-90 Thursday, July 26, 1990 - 2 - Applicant's Comments: Mr. Peter Mcinnis, who has a minority interest in the project, addressed Council and a pol ogi zed for the way the Owners had handled the application. Mr. Mcinnis plans to live in the community and is prepared to work with the Planning Department to address the issues of concern in the report. The proposed building is a six-storey structure to be built to give the appearance of four storeys. The design is a Victorian residential look that should b 1 end well with the surrounding neighbourhood, and should enhance property va 1 ues in the area. There are 69 underground parking spaces proposed and 36 above ground. The Owners have another property on Yonge Street which could possibly be used for parking. Another alternative could be more underground parking. Any commercial development would create additional traffic, and two access points to the property are proposed. The proposed structure would be a condominium. The Owners are willing to work with all departments to address concerns and Mr. Mcinnis requested Council approve the application and refer it to the Planning Advisory Committee. Moved by Councillor Pedersen Seconded by Councillor Ochalski THAT the application be denied. CARRIED Proposal OP-08-90 and Z-20-90 -York-Cross Incorporated The Public Meeting resumed with the Director of Planning reviewing the contents of Report PL90-103-212, prepared concerning the subject application. Applicant's Comments: Mr. Frank Klees, one of the pri nci pa 1 Owners of the property, addressed Council and welcomed the opportunity to discuss the application. This proposa 1 has been ongoing for some time, so Counci 1 is familiar with the application. The original concept for the site had been a restaurant and overnight accommodation. There is already a surplus of restaurants in the area, and neighbours were concerned about late night parking. The Owners reassessed the potential development and are presenting a commercial office building with most parking underground, and 34 parking spaces proposed for the adjacent part of Craddock Park. The Park has considerable activity and no parking, and the Developers are willing to work with the Town to find a solution to the problem. The design of the building is to have a residential flavor, with green space and landscaping in the front to ensure attractiveness. Aurora Special Council -Public Planning Minutes No. 35-90 Thursday, July 26, 1990 - 3 - There will be a buffer between the soccer field and the parking, and the parking is 280 feet from the nearest residence. The building will be condominiums, so Owners will ensure it is properly cared for. The Developers intend to have their offices there. Mr. Klees requested Council to consider allowing a medical practitioner to occupy a unit. Additional parking spaces could be accommodated underground. Most of the outstanding issues could be addressed at the Site Plan stage. Councillor Stewart left the Council Chambers at 8:45 p.m. Residents' Concerns: dangerous precedent set -parking on parkland Town should pay for its own parking if required Developer should stay within bounds of his property no control over who purchases condominiums nondescript international design no local style or land form use two levels of underground parking more appropriate an abutting neighbour suggested the proposal would be an asset to the area The Public Meeting closed, and Council's consideration began: #482. Moved by Councillor Timpson Seconded by Councillor Pedersen THAT the Official Plan Amendment be prepared for Council's consideration; THAT the Zoning By-law to permit this proposal be prepared; THAT third reading of the by-law not be given until a lease satisfactory to the Town of Aurora has been entered into and a Site Plan Agreement, which addresses the issues outlined in the Planning considerations of the report, and others which may be determined upon review and entered into, and; THAT the medical practitioner use be dependent upon increasing the amount of parking within the parking garage. On a recorded vote, the resolution CARRIED. YEAS 5 NAYS 2 VOTING YEA: Mayor West; Councillors Mcintyre, McKenzie, Pedersen, and Timpson. VOTING NAY: Councillors Ochalski and Weller. Proposal Z-21-90 -Blayrview Plaza Ltd. The Public Meeting resumed with the Director of Planning reviewing the contents of Report PL90-104-213, prepared concerning the subject application. Applicant's Comments: Mr. Paul Austin, representing the Owners, addressed Council. The Owners had assured Council that the tenants of the small plaza would be compatible with the surrounding neighbourhood, and felt confident a day care centre would achieve this aim. When traffic issues were raised, Marshall, Macklin Monaghan were contacted to address the issue. The report showed there were no real concerns. The day care centre would generate less traffic than a commercial venture. Mr. Austin requested Council to approve the application. Moved by Councillor McKenzie Seconded by Councillor Mcintyre THAT the application be approved and the appropriate by-law be prepared for three (3) readings. CARRIED Proposal Z-22-90 -Jane Fraser The Pub 1 i c Meeting resumed with the Director of Planning reviewing briefly the contents of Report PL90-105-214, prepared concerning the subject application. Applicant's Comments: Jane Fraser addressed Council regarding the moving of their personnel agency from Yonge Street to this site. The parking for five spaces would be repositioned to straight across the back -easier to park that way. The required curbing would also be completed. There were no concerns with the proposal. The Public Meeting closed, and Council's consideration began: #484. Moved by Councillor McKenzie Seconded by Councillor Weller i) THAT the obligations to the original Site Plan respecting curbing and line painting are required to be fulfilled; ii) THAT if required, an amendment be made to the Site Plan Agreement to allow for the existing employee parking space or for repositioning of the existing parking alignment; THAT medical offices are excluded as a permitted use, and; iii) THAT the application be approved and the appropriate by-law be prepared.
