MINUTES - Committee of the Whole - 19920302MINUTES TOWN OF AURORA COMMITTEE OF THE WHOLE MEETING NO. 10-92 Council Chambers Aurora Town Hall Monday, March 2, 1992 7:30 p.m. COUNCIL MEMBERS IN ATTENDANCE Councillor Jones in the Chair; Mayor West, Councillors Constable, Griffith, Healy, McKenzie, Pedersen, Timpson and Weller. STAFF MEMBERS IN ATTENDANCE Chief Administrative Officer, Muni ci pal Clerk, Deputy Clerk, Treasurer, Director of Planning, Director of Leisure Services, Director of Public Works, Director of Building Administration. DECLARATION OF CONFLICT OF INTEREST There were no disclosures of interest under the Municipal Conflict of Interest Act, 1983. APPROVAL OF AGENDA #1. Moved by Mayor West Seconded by Councillor Pedersen THAT the content of the Agenda as circulated by the Clerk's Department be approved as outlined herein, with the addition of correspondence from Mr. & Mrs. Gonsalves and from Coventry Manor for consideration along with Report LS92-004-077 and with the addition of Report LS92-022-080 to the New Business Section of the Age.nda. CARRIED DELEGATIONS Mr. Klaus Wehrenberg, resident re: Construction of a Pedestrian Underpass -Batson Drive to Industrial Parkway North Mr. Wehrenberg spoke on behalf of the Aurora Friends of Nature to ask Council to consider the construction of an underpass or an overpass from Batson Drive to Industrial Parkway North and to establish a Greenways Plan for the Town of Aurora. Mr. Wehrenberg noted that the Report prepared by the Director of Leisure Services offered no statistics to support the propositi on that vandalism and de vi ant behaviour are commonplace on such under or overpasses. Thus, costs and users hip are the real issues. He noted that the Town has spent no money on a Greenway System. He also noted that 90% of the residents surveyed in the northeast quadrant would use such an under or overpass. Mr. Wehrenberg showed a series of slides which illustrated successful trail locations in the Town and other locations wherein opportunities were missed to link trails and greenspace areas. #2. CARRIED Aurora Committee of the Whole Minutes No. 10-92 Monday, March 2, 1992 - 2 - Mr. William. Hall, resident re: Construction of a Pedestrian Underpass -Batson Drive to Industrial Parkway North Mr. Hall indicated that he represented the residents on Batson Drive who were opposed to the proposed under or overpass for reasons of vandal ism, noise, litter and safety. He noted that when residents originally purchased in this subdivision they thought that these two lots would be used for the construction of compatible residences. They opposed plans to construct a level crossing and were told that a final decision would be made, based upon the need for an under or overpass, three years after the leisure Complex was opened, Mr. Hall indicated that there is no such need. He presented an evaluation of Mr. Wehrenberg's survey of adjacent residents, prepared by ISl International Surveys limited, which indicated that the survey was of little va 1 ue, because it did not present those surveyed with the opportunity to express alternate viewpoints and because the person conducting the survey was interested in obtaining a certain result. Accordingly, Mr. Hall asked Council to confirm its decision not to proceed with the proposed under or overpass and to proceed instead with the sale of the lots, so that homes compatible with the neighbourhood could be constructed. #3. CARRIED Mr. Ken Molyneux, York Condominium #692 re: Garbage Pick-up at the "High-Rise" Condominiums in Aurora Mr. Molyneux spoke on behalf of residents of Highland Green, Devonshire Place and the Citadel, being 334 adult taxpayers, to take issue with the recommendations in Report PW92-014-078 that residential apartments using garbage dumpsters do so at their own cost and that present methods of tax collection for refuse and recycling be maintained. Mr. Molyneux indicated that condominiums are not apartments and that condominiums pay taxes per residential unit, which are comparable to the taxes paid per single detached dwellings. He noted Section 60(3) of the Assessment Act, requires that condominiums be assessed in the same manner as single family residences in the vicinity. For these reasons, he asked why condominium units should be treated differently from single family residences and forced to pay extra for garbage pick-up. He concluded by noting that Newmarket includes condominiums in its garbage service and asked Council not to proceed with the recommendations in the Report. #4. CARRIED CORRESPONDENCE AND PETITIONS Mr. & Mrs. Montgomery, residents re: Parking Restrictions on Maple Street and Mr. ,Jack Dodds, resident re: Pa~king Restrictions on Maple Street #5. Moved by Mayor West Seconded by Councillor Weller THAT the correspondence be received as information; and THAT Town Staff contact the residents prior to third reading of the Maple Street parking by-law, to discuss the concerns raised in the correspondence. Moved by Mayor West THAT Council request proposed reforms to unnecessary and will economy. Seconded by Councillor Pedersen the Minister of Labour not to introduce the the Labour Relations Act, since these are have a detrimental impact on the Ontario CARRIED Mayor West, Memo re: Town By-law Governing Electronic Games (Licensing & Regulating of Amusement Machines) #7. Moved by Mayor West Seconded by Councillor Constable THAT the matter be referred to Staff for a Report to review and update the existing by-law with respect to establishments having a liquor licence; and THAT such Report shall indicate which games are currently utilized at Pals and whether such games have a payout. CARRIED STAFF REPORTS LS92-019-073 -Leisure Complex -Whirlpool #8. Moved by Councillor Pedersen Seconded by Councillor McKenzie THAT the Report prepared by the Director of Leisure Services concerning the Leisure Complex Whirpool be received as information. CARRIED PW92-018-074 -Remedial Measures for Salamander Pond #9. Moved by Mayor West Seconded by Councillor Weller THAT the Town approve in principle the remedial recommendations for silation clean-up and control for Salamander Pond and its tributary stream as outlined in the envi ronmenta 1 report by UMA Enqi neeri ng Ltd. dated December, 1991 and in the subsequent review of this report by Mr. Tony Van Oostrom dated February 4, 1992. CARRIED PW92-019-075 -Town Crossing Guard Policy and Procedure and Councillor Healy, Memo re: Town Crossing Guard Policies #10. Moved by Councillor Griffith Seconded by Councillor McKenzie THAT Co unci 1 appoint a Committee comprised of three Counci 11 ors, the Director of Public Works and the Design Services Manager to develop the Town Crossing Guard Policy and Procedure . AMENDMENT: Upon the question of the adoption of the recommendation, it was: #11. Moved by Mayor West Seconded by Councillor Weller THAT Council give first and second reading consideration to the attached Dog By-law. CARRIED LS92-004-077 -Construction of a Pedestrian Underpass - Batson Drive to Industrial Parkway North and, corres~ondence from A.N. Parkinson, M.R. Green Mr. & rs. Gonsalves and from Coventry Manor and Delegation of Mr. Klaus Wehrenberg and Mr. William Hall, residents re: Construction of a Pedestrian Underpass - Batson Drive to Industrial Parkway North #13. Moved by Councillor Pedersen Seconded by Councillor Weller THAT Council reconfirm its April 10, 1991 decision not to proceed with the construction of a pedestrian underpass or overpass from Batson Drive to Industrial Parkway North and to sell the two (2) Town owned 50 foot 1 ots adjacent to Batson Drive to a bui 1 der on the terms and conditions that the homes to be constructed shall be compatible with the adjacent neighbourhood. CARRIED PL92-018-070 -Strategic Planning Terms of Reference for Study #14. #15. Moved by Councillor Pedersen Seconded by Councillor Griffith THAT an ad hoc committee consisting of three members of Council and three staff be established to set Terms of Reference and examine the feasibility of undertaking a strategic plan for the municipality. CARRIED Moved by Mayor West Seconded by Councillor McKenzie THAT Councillor Jones be nominated to Chair the Committee and that Councillors Pedersen and Griffith be nominated to the Committee. Moved by Mayor West Seconded by Councillor Constable THAT the Report prepared by the Director of Leisure Services pertaining to the George Street Outdoor Pool be received as information. Moved by Councillor Weller CARRIED -Enquired whether the Mayor's Committee on Committees has made any determination as to the future of the Environment Committee. -Asked the Director of Leisure Services to report as to the feasibility of conducting an underpass or an overpass across the CN Tracks from the parkette adjacent to Moorcrest Drive.
