Being a By-law to establish land on Plan 65M-4485 as a highway
(File No. SUB-2012-02/D12-02-12).
Whereas under subsection 31(2) of the MunicipalAct, 2001, s.o. 2001, c. 25, as
amended (the "Act'l), after January 1, 2003, land may only become a highway by virtue
of a by-law establishing the highway and not by the activities of the municipality or any
other person in relation to the land, including the spending of public money;
Whereas under subsection 31(3) of the Act, subsection 31(2) of the Act does not apply
to highways described in paragraphs 3, 4 and 5 of section 26 of the Act, which includes:
(3) all highways transferred to a municipality under the Public Transportation and
Highway ImprovementAct; (4) all road allowances made by a Crown surveyor located in
a municipality; or (5) all road allowances, highways, streets, or lanes shown on a
registered plan of subdivision;
And whereas The Corporation of the Town of Aurora (the 'lTownl') entered into a
Residential Subdivision Agreement (Phase 2) with Shimvest Investments Limited, dated
July 20, 2016, with respect to the lands contained within Plan 65M-451 9, in relation to
Town File No. SUB-201 2-02/D12-02-12 (the IlAgreement'l);
And whereas the Town acquired certain lands for reserves (0.3 metre) on adjoining
lands to be established by by-law as highways by the Town, as set out in Schedule 'IG"
of the Agreement;
And whereas the Council of the Town deems it necessary and expedient to establish
such lands, as set out in Schedule "G" of the Agreement, as a highway;
Now therefore the Council of The Corporation of the Town of Aurora hereby enacts as
follows:
1. The following lands,in the Town of Aurora, Regional Municipality of York, be and
are hereby established as a highway by the Town:
(a) Block 171, Plan 65M-4485, forming part of Holladay Drive;
(b) Block 173, Plan 65M-4485, forming part of Holladay Drive;
(c) Block 178, Plan 65M-4485, forming part of Holladay Drive;
(d) Block 180, Plan 65M-4485, forming part of Holladay Drive; and
(e) Block 182, Plan 65M-4485, forming part of Holladay Drive.
2.A copy of this by-law shall be registered against the lands in the proper land
registry office.
