Being a By-law to amend By-law Number 6579-24, as amended, to adopt
Official Plan Amendment No. 9 (File No. OPA-2024-03).
Whereas on January 30, 2024, the Council of The Corporation of the Town of Aurora
(the llTown") enacted By-law Number 6579-24, as amended, to adopt the Official Plan
dated January 2024 as the Official Plan for the Town of Aurora (the "Official Plan");
And whereas appeals were filed with the Ontario Land Tribunal (the 'lTribunal" or
IIOLT"), under OLT Case No. OLT-24-000690, pursuant to Section 17(36) of the Planning
Act, R.S.O. 1990, c. P.13, as amended (the 'JPlanning Act");
Now therefore the Council of The Corporation of the Town of Aurora hereby enacts as
follows:
1. Official Plan Amendment No. 9 to the Official Plan, attached and forming part of
this by-law, be and is hereby adopted.
This by-law shall come into full force subject to compliance with the provisions
of the Planning Act and subject to compliance with such provisions, this by-law
will take effect from the date of the order, issued by the Tribunal.

Part I – The Preamble
1. Introduction
This part of the Official Plan Amendment No. 9 (the “Amendment”), entitled Part I –
The Preamble, explains the purpose and location of this Amendment, and provides an
overview of the reasons for it. It is for explanatory purposes only and does not form
part of the Amendment.
2. Purpose of the Amendment
The purpose of this Amendment is to change the land use designation from “Suburban
Residential” and “Major Institutional” to “Suburban Residential” and “Environmental
Protection”. The provision of this Amendment will allow for the proposed residential
development including 93 townhouse units – 57 street townhouse units and 36 back-
to-back townhouse units. The limits of the Environmental Protection designation will
also be expanded by amending the exiting designations. Furthermore, this Amendment
will remove the existing Site Specific Policy Area 41 and replace it with Site Specific
Policy Area 72.
3. Location
The lands affected by this Amendment are located at the southwest corner of Yonge
Street and Elderberry Trail, north of Bloomington Road. The subject lands have an
approximate total area of 3.6 hectares (8.9 acres); and are legally described as Part
Blocks A, B and G, Plan M42, Part 3, 65R-5870 and Parts 3, 6, 7 and 8, 65R-33710, in
Town of Aurora, Regional Municipality of York (the “Subject Lands”).
4. Basis of the Amendment
The basis of the Amendment is as follows:
4.1 Official Plan Amendment and Zoning By-law Amendment applications were
submitted to the Town for consideration intended to facilitate the development
of 93 townhouse units (57 street townhouse units and 36 back-to-back
townhouse units). The proposed development is supported by technical studies
submitted by the applicant, as reviewed by the Town, which establishes that the
portions of the subject lands can be developed for the residential use, with other
portions of the subject lands maintained for environmental protection.
4.2 The Amendment is privately initiated and follows general provisions of the
Aurora Official Plan including those policies and directives pertaining to
“Regional Corridors” and “Strategic Growth Areas” of the 2024 Aurora Official
Plan.
4.3 The Amendment incorporates the lands into the “Suburban Residential”
designation which, through the policies of the applicable “Regional Corridors”
policies, permits the proposed height and density of the development as of
right. This is outlined in the Planning Justification Report and supporting
materials submitted in support of this Amendment and related Zoning By-law
Amendment.

4.4 The Amendment expands the existing “Environmental Protection” designation
to protect and enhance the natural area surrounding the development limits.
4.5 Development of the site presents an opportunity for moderate intensification
along within the Yonge Street South Regional Corridor and helps achieve the
Town of Aurora’s pledge to build 8,000 units by 2031.
4.6 The Amendment facilitates the vision for development in Aurora as per the
policies and directives of the approved and in-force 2024 Town of Aurora
Official Plan.
4.7 The Town of Aurora is the approval authority for the Amendment.
Part II – The Amendment
1. Introduction
This part of the Amendment, entitled Part II – The Amendment, consisting of the
following text and attached maps, designated as Schedule “A” and Schedule “B”
constitutes Amendment No. 9 to the Official Plan.
2. Details of the Amendment
The Official Plan be and is hereby amended as follows:
Item (1): Schedule “B” – Land Use Plan, being part of the Town of Aurora Official Plan,
be and is hereby amended by changing the designation for the Subject
Lands described as 14070 Yonge Street, Town of Aurora in the Regional
Municipality of York, from “Suburban Residential” and “Major Institutional”
to “Suburban Residential” and “Environmental Protection”, as shown on
Schedule “A” - Land Use Plan, attached hereto and forming part of this
Amendment.
Item (2): Schedule “H”, Site Specific Policy Areas, being part of the Town of Aurora
Official Plan, be and is hereby amended by removing Site Specific Policy
Area 41 on the Subject Lands, designated a portion of the Subject Lands on
Schedule “A” attached hereto, and known as 14070 Yonge Street as “Site
Specific Policy Area 72.
Item (3): Section 20 of the Town of Aurora Official Plan be and is hereby amended by
adding the following:
“20.72
The following policies apply to the lands shown on Schedule “H” as Site
Specific Policy Area 72, which are designated “Suburban Residential”:
1. The maximum density of 93 townhouse dwelling units or 25.80 units
per gross hectare shall be permitted;
2. A maximum building coverage of 18% of the total lot area shall be
permitted;

3. A minimum soft landscaping area of 53% of the total site area shall be
permitted;
4. A maximum developable area of 62% of the total site area shall be
permitted;
5. A minimum lot area of 80 square metres shall be permitted for
individual townhouse lots; and
6. No buildings or structures shall be permitted within the portion of the
Subject Lands designated as “Environmental Protection”.”
3. Implementation
This Amendment has been considered in accordance with the provisions of the Official
Plan. The implementation and interpretation of this Amendment shall be in
accordance with the respective policies of the Official Plan.
