By-law - Amend 6000-17 ZBA-25 Mavrinac Blvd (ZBA-2025-02) - 20251209 - 6752-25The Corporation of the Town of Aurora By-law Number 6752-25 Being a By-law to amend By-law Number 6000-17, as amended, respecting the lands municipally known as 25 Mavrinac Boulevard (File No. ZBA-2025-02). Whereas under section 34 of the Planning Act, R.S.O. 1990, c. P.13, as amended (the “Planning Act”), zoning by-laws may be passed by the councils of local municipalities to prohibit and regulate the use of land, buildings and structures; And whereas on June 27, 2017, the Council of The Corporation of the Town of Aurora (the “Town”) enacted By-law Number 6000-17 (the “Zoning By-law”), which Zoning By- law was appealed to the Ontario Municipal Board (the “OMB”); And whereas on January 29, 2018, the OMB made an order, in accordance with subsection 34(31) of the Planning Act, providing that any part of the Zoning By-law not in issue in the appeal shall be deemed to have come into force on the day the Zoning By-law was passed; And whereas the OMB and the Local Planning Appeal Tribunal (the “LPAT”) is continued under the name Ontario Land Tribunal (the “Tribunal” or “OLT”), and any reference to the Ontario Municipal Board or OMB or Local Planning Appeal Tribunal or LPAT is deemed to be a reference to the Tribunal; And whereas the Council of the Town deems it necessary and expedient to further amend the Zoning By-law; Now therefore the Council of The Corporation of the Town of Aurora hereby enacts as follows: 1. Section 24.540 of the Zoning By-law be and is hereby deleted and replaced with the following: “Parent Zone: RA2 Exception Zone: (540) Map: Schedule ‘A’, Map No. 8 Previous Zone: E-BP(313) Previous By-laws: 6374-21 Municipal Address: 25 Mavrinac Boulevard Legal Description: Block 38, Plan 65M-4731 24.540.1 Permitted Uses Only the following uses are permitted: • Apartment Dwelling Units • Retirement Home 24.540.2 Zone Requirements By-law Number 6752-25 Page 2 of 5 Apartment units (Maximum) 135 24.540.2.1 Lot Specifications Lot Area (minimum) 0.75 hectares 24.540.2.2 Siting Specifications Wellington Street East or a reserve abutting Wellington Street East, shall be deemed to be the front lot line Mavrinac Boulevard or a reserve abutting Mavrinac Boulevard, shall be deemed to be the exterior lot line Front Yard – Main Building (minimum) 6.0 metres Exterior Side Yard (minimum) 6.0 metres Interior Side Yard (minimum) 6.0 metres 24.540.2.3 Building Specifications Lot Coverage (maximum) 45% Height (maximum) 28 metres (7 storeys) 24.540.2.4 Amenity Area Notwithstanding the definition of “Floor Area, Gross” contained within Section 3, the following definition shall apply: • Enclosed rooftop amenity space of up to 100 square metres in area will not be considered Floor Area, Gross Notwithstanding the provisions of Section 7.5.2, a minimum of 18 square metres per Apartment Dwelling Unit of amenity area shall be provided through a combination of shared indoor/outdoor building amenities and/or private balconies. 24.540.2.5 Landscaping Strip A landscaping strip of 1.0 metres in width containing an opaque fence with a minimum height of 1.5 metres is required for any lot on lands zoned Multiple Residential adjacent to any Residential Zone 24.540.2.6 Parking Dwelling Unit – Apartment Building (minimum) 1 space per dwelling unit plus 0.15 visitor’s parking spaces per dwelling unit Retirement Home (minimum) 0.20 parking spaces per suite Bicycle Parking (minimum) 17 spaces” By-law Number 6752-25 Page 3 of 5 This by-law shall come into full force subject to compliance with the provisions of the Planning Act and subject to compliance with such provisions, this By-law will take effect from the date of final passage hereof. If a building permit that is appropriate for the development has not been issued under the Building Code Act, 7 992, s.o. 1992, c. 23, as amended, for any building or structure so authorized within three (3) years from enactment of this by-law, then this by-law shall automatically repeal and if so repealed, the zoning of the lands will revert to the original zoning.
