By-law - Amend 5285-10 OPA No. 41-25 Mavrinac Blvd (OPA-2025-01) - 20251209 - 6750-25The Corporation of the Town of Aurora By-law Number 6750-25 Being a By-law to amend By-law Number 5285-10, as amended, to adopt Official Plan Amendment No. 41 (File No. OPA-2025-01). Whereas on September 28, 201 0, the Council of The Corporation of the Town of Aurora (the 4'Town") enacted By-law Number 5285-1 0, as amended, to adopt the Official Plan for the Town of Aurora (the JlOfficial Plan"); And whereas authority is given to Council pursuant to the PlanningAct, R,S.0. 1990, c. P.13, as amended (the 'lPlanning Act") to pass a by-law amending the Official Plan; And whereas the Council of the Town deems it necessary and expedient to further amend the Official Plan. Now therefore the Council of The Corporation of the Town of Aurora hereby enacts as follows: 1.Official Plan Amendment No. 41 to the Official Plan, attached and forming part of this by-law, be and is hereby approved. 2.This by-law shall come into full force subject to compliance with the provisions of the Planning Act and subject to compliance with such provisions, this by-law will take effect from the date of final passage hereof. Introduction This part of the Official Plan Amendment No. 41 (the “Amendment”), entitled Part I – The Preamble, explains the purpose and location of this Amendment, and provides an overview of the reasons for it. It is for explanatory purposes only and does not form part of the Amendment. 2. Purpose of the Amendment The purpose of this Amendment is to amend the Site-Specific Policy Area (55) to increase the maximum building height to 7 storeys. 3. Location The lands affected by this Amendment are located on the northeast corner of the Wellington Street West and Mavrinac Boulevard intersection. They are municipally known as 25 Mavrinac Boulevard; having a total area of approximately 0.78 hectares (1.93 acres); and are legally described as Block 38 on Registered Plan 65M-4731, Town of Aurora, Regional Municipality of York (the “Subject Lands”). 4. Basis of the Amendment The basis of the Amendment is as follows: 4.1 The Amendment is privately initiated and is intended to facilitate an ongoing Site Plan application SP-2022-07 to permit the building height increase from 6- storeys to 7-storeys for the previously approved Supportive Housing Building (Senior Citizen/Retirement Residence). 4.2 Applications for Official Plan Amendment and Zoning By-law Amendment were submitted to the Town of Aurora for consideration. 4.3 The Official Plan Amendment was submitted to enact site-specific policies related to the maximum building height on the seniors parcel only. 4.4 A Statutory Public Planning Meeting was held on June 3, 2025, to obtain input from the public and Council. 4.5 The full basis for this Amendment has been set out in the Planning Justification Report and related supplementary reports submitted in support of this Amendment and the related Zoning by-law Amendment. 4.6 The Amendment is considered to be compatible and appropriate with the existing surrounding community and will result in a complementary built form. 4.7 The Amendment is consistent with Provincial and Municipal Policies and Plans. 4.8 The Town of Aurora is the approval authority for the Amendment. Part II – The Amendment By-law Number 6750-25 Page 4 of 5 1. Introduction This part of the Amendment, entitled Part II – The Amendment, consisting of the following text and attached map, designated as Schedule “A” constitutes Amendment No. 41 to the Official Plan. 2. Details of the Amendment The Official Plan be and is hereby amended as follows: Item (1): Section 20.55 a) of the Town of Aurora Official Plan be and is hereby deleted and replaced by the following: “In addition to the permitted uses in the “Medium-High Density Residential" designation, as provided in Policy 3.2.2 b) a. of the Town of Aurora Bayview Northeast Area 2B Secondary Plan - Official Plan Amendment No. 30, a seven-storey Supportive Housing Building (Senior Citizen/Retirement Residence) is permitted.” 3. Implementation This Amendment has been considered in accordance with the provisions of the Official Plan. The implementation and interpretation of this Amendment shall be in accordance with the respective policies of the Official Plan.
