By-law - Amend 5590-14 Collection of Waste Bylaw - 20251209 - 6744-25The Corporation of the Town of Aurora By-law Number 6744-25 Being a By-law to amend By-law Number 5590-14, as amended, for the collection of solid waste in the Town of Aurora. Whereas on July 29, 2014, the Council of The Corporation of the Town of Aurora (the “Town”) enacted By-law Number 5590-14, for the collection of solid waste and recyclable materials in the Town of Aurora; And whereas on June 3, 2021, the Government of Ontario filed Ontario Regulation 391/21: Blue Box, under the Resource Recovery and Circular Economy Act, 2016, S.O. 2016, c. 12, Sched. 1, which transfers the responsibility for the collection of blue box materials from municipalities to producers, effective January 1, 2026; And whereas on December 2, 2024, the Council of the Town passed a resolution contained in Report No. OPS24-022 to cease collection from Non-Eligible Sources in the Town effective January 1, 2026, and subsequently on November 25, 2025, the Council of the Town passed a resolution contained in Report No. OPS25-023 to exempt a downtown business area from the December 2, 2024 resolution and to temporarily continue collection from Non-Eligible Sources in that area; And whereas the Council of the Town deems it necessary and expedient to amend By-law Number 5590-14, as amended, to align with Ontario Regulation 391/21 and Town resolutions; Now therefore the Council of The Corporation of the Town of Aurora hereby enacts as follows: 1. The title of By-law Number 5590-14, as amended, currently known as “the collection of solid waste and recyclable materials in the Town of Aurora” be and is hereby amended to read: “the collection of waste in the Town of Aurora”. 2. By-law Number 5590-14, as amended, be and is hereby amended by deleting the following sections: (a) Subsection 1.1(q); (b) Paragraph 4.16(c)(i); and (c) Section 5.2; 3. Section 1.1 of By-law Number 5590-14, as amended, be and is hereby amended by deleting subsection 1.1(b) and replacing it with the following: “(b) “Blue Box Material” shall have the meaning ascribed to blue box material under Ontario Regulation 391/21, as amended;” By-law Number 6744-25 Page 2 of 9 4. Section 1.1 of By-law Number 5590-14, as amended, be and is hereby amended by deleting subsection 1.1(d) and replacing it with the following: “(d) “Bundle” means a bundle of branches, twigs, brush, or related cuttings, which is securely tied with a non-metallic material and which does not exceed 1.2 meters in any physical dimension and does not exceed twenty-two (22) kilograms in weight;” 5. Section 1.1 of By-law Number 5590-14, as amended, be and is hereby amended by deleting subsection 1.1(i) and replacing it with the following: “(i) “Director” means the Director of Operations, or their designate or successor;” 6. Section 1.1 of By-law Number 5590-14, as amended, be and is hereby amended by deleting subsection 1.1(p) and replacing it with the following: “(p) “Non-Collectible Waste” means any Refuse that are not accepted for Collection by virtue of their size, weight, shape, or type, including those listed in Schedule “A” of this by-law under “Non-Collectible Waste”, or as determined by the Director to be unsuitable for Collection;” 7. Section 1.1 of By-law Number 5590-14, as amended, be and is hereby amended by adding the following subsections: “(x) “Downtown Core Businesses” means all Non-Eligible Sources within the geographical area identified in Schedule “C”; (y) “Eligible Source” shall have the meaning ascribed to eligible source under Ontario Regulation 391/21, as amended; (z) “Non-Eligible Source” means any source that is not an Eligible Source.” 8. By-law Number 5590-14, as amended, be and is hereby amended by adding the following sections: “3.2 The Town’s Collection system shall only be provided for Eligible Sources, unless otherwise set out in this by-law or as directed by the Council of the Town. 3.3 Notwithstanding anything in this by-law, the Collection of Garbage and Source Separated Organics shall continue to be provided to Downtown Core Businesses, as deemed eligible and on terms deemed appropriate by the Director, or as otherwise directed by the Council of the Town. 3.4 Notwithstanding anything in this by-law, the Director may authorize Collection from any Non-Eligible Source in special circumstances as deemed appropriate by the Director, unless otherwise directed by the Council of the Town.” 9. By-law Number 5590-14, as amended, be and is hereby amended by adding the following section: By-law Number 6744-25 Page 3 of 9 “4.2.1 Except as otherwise provided in this by-law, no person shall set out any Blue Box Material for Collection by, or on behalf of, the Town.” 10. By-law Number 5590-14, as amended, be and is hereby amended by deleting subsection 4.13(d) and replacing it with the following: “(d) Blue Box Material is separated from Refuse or other material set out for Collection by the Town, or on behalf of the Town, and that Blue Box Material is set out for collection, or otherwise disposed of, in the manner and form prescribed, and in compliance with, the Resource Recovery and Circular Economy Act, 2016, S.O. 2016, c. 12, Sched. 1, and O. Reg. 391/32: Blue Box, all as amended.” 11. By-law Number 5590-14, as amended, be and is hereby amended by deleting section 4.20 and replacing it with the following: “4.20 In the event that Refuse is set out for Collection other than in accordance with the provisions of this by-law, or the material that is put for Collection does not fall into the category of Garbage, Source Separated Organics, Bulk Item, White Goods, Yard Waste, or is otherwise a material that is not permitted or collectable under this by- law, then the Contractor and the Town may decline to collect such Refuse or material and the Contractor and the Town will be relieved of any obligation or requirement to collect or otherwise manage any such Refuse or material. Any such refusal by the Contractor or the Town to collect or manage Refuse or material is in addition to and does not limit any other remedy or penalty authorized under this by-law or any other applicable legislation.” 12. By-law Number 5590-14, as amended, be and is hereby amended by deleting section 5.6 and replacing it with the following: “5.6 Plastic bags shall not be used as a Container for Source Separated Organics or Yard Waste.” 13. By-law Number 5590-14, as amended, be and is hereby amended by adding the following section: “5.9 Notwithstanding anything in this by-law, only Downtown Core Businesses may dispose of Blue Box Material within the Town by delivering Blue Box Material directly to Town-designated Blue Box Material collection sites during hours as designated by the Director, or through any Town Blue Box Material collection programs, as established by the Director.” 14. By-law Number 5590-14, as amended, be and is hereby amended by deleting sections 6.1, 6.2, and 6.3, and replacing them with the following: “6.1 Subject to the discretion of the Director, the Town may replace damaged Green Bins, provided that any such damaged bins are delivered by the By-law Number 6744-25 Page 4 of 9 owner or occupier of a premise located within the geographical boundaries of the Town, to a Town facility as designated by the Director. 6.2 Green Bins and Composters may be purchased from the Town upon payment of the applicable fee or charge as set out in the Fees and Charges By-law, or a successor by-law, as amended from time to time, or as otherwise agreed to by the Director in their sole discretion." 15. By-law Number 5590-1 4, as amended, be and is hereby amended by adding the following section: 1'7.0.1 The Director is delegated authority to and is responsible for administering this by-law, including the authority to determine a schedule for Collection, to classify Refuse, and to determine eligibility for Collection." 16. Schedule I'A" - Waste Material Classification to By-law Number 5590-1 4, as amended, be and is hereby deleted and replaced with Schedule "A" - Waste Material Classification attached and forming part of this by-law. 17. By-law Number 5590-1 4, as amended, be and is hereby amended by adding Schedule '4C", attached and forming part of this by-law. 18. Effective Date 18.1 This by-law shall come into full force and effect on Januaryl, 2026. Enacted by Town of Aurora Council this 9th day of December, 2025.
