By-law - OLT Amend 6579-24 Adopt Official Plan for Town of Aurora, 305 Wellington St East - 20250917 - 6726-25 The Corporation of the Town of Aurora By-law Number 6726-25 Being a By-law to amend By-law Number 6579-24, as amended, to adopt the Official Plan for the Town of Aurora. Whereas on January 30, 2024, the Council of The Corporation of the Town of Aurora (the “Town”) enacted By-law Number 6579-24, as amended, to adopt the Official Plan for the Town of Aurora; Whereas on May 23, 2024, York Region Council approved the Town of Aurora Official Plan, as amended (the “Approved Official Plan”); And whereas on September 17, 2025, the Ontario Land Tribunal (the “OLT”) issued an Order, under OLT Case No. OLT-24-000690 (the “Order”) approving an amendment to the Official Plan respecting the lands municipally known as 305 Wellington Street East following an appeal pursuant to Section 17(36) of the Planning Act, R.S.O. 1990, c. P.13, as amended (the “Planning Act”); Now therefore the Approved Official Plan is amended by the Ontario Land Tribunal as follows: 1. The amendment to the Approved Official Plan, attached and forming part of this by-law, be and is hereby approved. 2. This by-law shall come into full force subject to compliance with the provisions of the Planning Act and subject to compliance with such provisions, this by-law will take effect from the date of the Order. Introduction This part of the amendment (the “Amendment”), entitled Part I – The Preamble, explains the purpose and location of this Amendment, and provides an overview of the reasons for it. It is for explanatory purposes only and does not form part of the Amendment. 2. Purpose of the Amendment The purpose of this Amendment is to redesignate the subject lands to establish a consistent boundary line, bringing the entire parcel within the Aurora Promenade and Major Transit Station Area Secondary Plan. 3. Location The lands affected by this Amendment are located at the south side of Wellington Street East, on the east side of Mary Street, forming the south-eastern corner of these two roadways. These lands are municipally known as 305 Wellington Street East; having a lot area of approximately 4.32 acres (1.75 hectares); and are legally described as “PCL 80-11, SEC W1, PT LT 80, CON 1 (AW), PT 1, 65R7075; S/T LT247480, LT257066E (EASE LT 257066E RELEASED AS TO PTS 1, 2, 3, & 4, 65R29025 BY YR1121746) AURORA S/T EASE IN GROSS OVER PTS 1, 2, 3 & 4, 65R29025, AS IN YR1121744” (the “Subject Lands”). 4. Basis of the Amendment The basis of the Amendment is as follows: 4.1 On April 17, 2023, a submission was made to the Town’s Clerk, Mr. Michael de Rond, respecting the Town’s updated 2nd draft Official Plan and specific modifications to the updated draft Town Official Plan policies and schedules respecting the Subject Lands (“April 2023 Submission”). 4.2 On January 30, 2024, Town Council adopted the updated Official Plan, 2024 through By-law Number 6579-24 (“AOP”), without adopting the modifications requested in the April 2023 Submission. 4.3 On May 9, 2024, the AOP was considered by York Region Committee of the Whole, as York Region is the statutory approval authority of the AOP pursuant to section 17(4) of the Planning Act. 4.4 On May 9, 2024, in advance of the meeting of York Region Committee of the Whole, a submission to the Regional Clerk was made regarding requested modifications to the AOP (“May 2024 Submission”). 4.5 On May 23, 2024, the AOP was approved by Regional Council (“Approved Official Plan”). The Approved Official Plan did not address the requested modifications in the May 2024 Submission. 4.6 On June 13, 2024, Dentons LLP on behalf of the owner of the Subject Lands (“Auto Group”), appealed the Approved Official Plan (“Auto Group Appeal”) under Section 17(36) of the Planning Act to the Ontario Land Tribunal (“Tribunal”). By-law Number 6726-25 Page 4 of 5 4.7 On August 25, 2025, a settlement hearing was held by the Tribunal. The decision and order of the Tribunal was issued on September 17, 2025. 4.8 In accordance with the decision and order of the Tribunal, issued on September 17, 2025, the amendments to the Approved Official Plan are as follows: a) Schedule “A” (Town Structure) is amended to reflect a consistent boundary for the entirety of the Subject Lands to “The Aurora Promenade and Aurora GO Station Major Transit Station Area”; b) Scheduled “B” (Land Use Plan) is amended to reflect a consistent boundary for the entirety of the Subject Lands to “Aurora Promenade and Major Transit Station Area Mixed Use”; c) Schedule “C” (Secondary Plan Areas) is amended to reflect a consistent boundary for the entirety of the Subject Lands to “Aurora Promenade and Major Transit Station Area Secondary Plan”; d) Schedule “D1” (The Aurora Promenade and Major Transit Station Area Secondary Plan Area) is amended to reflect a consistent boundary for the entirety of the Subject Lands to “Promenade General”; e) Schedule “D2” (The Aurora Promenade and Major Transit Station Area Building Heights) is amended to reflect a consistent boundary for the entirety of the Subject Lands to be “Minimum 2-Storeys / Maximum 6- Storeys”; and f) Schedule “D3” (The Aurora Promenade and Major Transit Station Area Streetscapes) is amended to reflect a consistent boundary for the entirety of the Subject Lands being within the “Secondary Plan Boundary.” Part II – The Amendment 1. Introduction This part of the Amendment, entitled Part II – The Amendment, consists of the following text and attached maps, designated as Schedule “A”. The effect of this Amendment is to amend the Approved Official Plan to reflect a consistent boundary for the entirety of the Subject Lands. 2. Details of the Amendment The Approved Official Plan be and is hereby amended as follows: Item (1): Schedule “A” (Town Structure) is hereby amended by changing the portion of the land use designation for the Subject Lands municipally described as 305 Wellington Street, from “Employment Area”, to “The Aurora Promenade and Aurora GO Station Major Transit Station Area”; Item (2): Schedule “B” (Land Use Plan) is hereby amended by changing the portion of the land use designation for the Subject Lands municipally described as 305 Wellington Street, from “General Industrial”, to “Aurora Promenade and Major Transit Station Area Mixed Use”; By-law Number 6726-25 Page 5 of 5 Item (3): Schedule “C” (Secondary Plan Areas) is hereby amended by consistently designating the Subject Lands municipally described as 305 Wellington Street, to be “Aurora Promenade and Major Transit Station Area Secondary Plan (Section 9)”; Item (4): Schedule “D1” (The Aurora Promenade and Major Transit Station Area Secondary Plan Area) is hereby amended by consistently designating the Subject Lands municipally described as 305 Wellington Street, to be “Promenade General”, and consistently delineating the Subject Lands within the “Secondary Plan Boundary”; Item (5): Schedule “D2” (The Aurora Promenade and Major Transit Station Area Building Heights) is hereby amended by consistently designating the Subject Lands municipally described as 305 Wellington Street, to be “Minimum 2-Storeys / Maximum 6-Storeys”, and consistently delineating the Subject Lands within the “Secondary Plan Boundary”; and Item (6): Schedule “D3” (The Aurora Promenade and Major Transit Station Area Streetscapes) is hereby amended by consistently delineating the Subject Lands municipally described as 305 Wellington Street, to be within the “Secondary Plan Boundary”. 3. Implementation This Amendment has been considered in accordance with the provisions of the Approved Official Plan. The implementation and interpretation of this Amendment shall be in accordance with the respective policies of the Approved Official Plan.
