By-law - OLT Amend 6000^17 Zoning Bylaw Amendment, 252,260,272 Old Bloomington Rd (File ZBA^2023^02) - 20250923 - 6728^25The Corporation of the Town of Aurora By-law Number 6728-25 Being a By-law to amend By-law Number 6000-17, as amended, respecting the lands municipally known as 252, 260, and 272 Old Bloomington Road (File No. ZBA-2023-02). Whereas under section 34 of the Planning Act, R.S.O. 1990, c. P.13, as amended (the “Planning Act”), zoning by-laws may be passed by the councils of local municipalities to prohibit and regulate the use of land, buildings and structures; And whereas on June 27, 2017, the Council of The Corporation of the Town of Aurora (the “Town”) enacted By-law Number 6000-17 (the “Zoning By-law”), which Zoning By-law was appealed to the Ontario Municipal Board (the “OMB”); And whereas on January 29, 2018, the OMB made an order, in accordance with subsection 34(31) of the Planning Act, providing that any part of the Zoning By-law not in issue in the appeal shall be deemed to have come into force on the day the Zoning By-law was passed; And whereas the OMB and the Local Planning Appeal Tribunal (the “LPAT”) is continued under the name Ontario Land Tribunal (the “Tribunal”), and any reference to the Ontario Municipal Board or OMB or Local Planning Appeal Tribunal or LPAT is deemed to be a reference to the Tribunal; And whereas on September 23, 2025, the Tribunal issued an order, under OLT Lead Case No. OLT-24-001224 (the “Order”), approving an amendment to the Zoning By-law respecting the lands municipally known as 252, 260, and 272 Old Bloomington Road, following an appeal pursuant to Section 34 (11) of the Planning Act; Now therefore the Zoning By-law is amended by the Ontario Land Tribunal as follows: 1. The Zoning By-law be and is hereby amended to replace the “Estate Residential (ER)” zoning category applying to the lands shown in hatching on Schedule “A” attached hereto and forming part of this by-law with “Detached Third Density Residential (R3) Exception Zone (574)”, “Detached Third Density Residential (R3) Exception Zone (575)” and “Oak Ridges Moraine Environmental Protection (EP- ORM) Zone”. 2. The Zoning By-law be and is hereby amended to add the following: “24.574 Detached Third Density Residential (R3) Exception Zone (574) Parent Zone: R3 Exception No.: 574 Map: 7 Previous Zone: ER Previous By-laws: 6000-17 Municipal Address: 252, 260, and 272 Old Bloomington Road Legal Description: Lot 6 and Part of Lot 7, Registered Plan 166 24.574.3 Zoning Requirements By-law Number 6728-25 Page 2 of 6 24.574.3.1 Permitted Uses In accordance with Section 7.1.1 of Zoning By-law 6000-17 24.574.3.2 Building Standards Notwithstanding the provisions of Section 7.2, the following standards shall apply: Front Yard (minimum) 4.5 metres to the Main Building 6.0 metres to the Garage Interior Side Yard (minimum) 1.2 metres Exterior Yard (minimum) 3.0 metres Height (maximum) 12.0 metres Lot Coverage (maximum) 40% 24.574.3.3 Yard Encroachments Permitted Notwithstanding the provisions of Section 4.20, the structures listed in the following table shall be permitted to project into the minimum yards indicated for the distances specified: Structure or Feature Applicable Yard Maximum Encroachment into a Minimum Yard Covered or uncovered Porches and Terraces Front Yard 3.0 metres Exterior Side Yard 2.5 metres Covered or uncovered porches, uncovered terraces and decks (3.5 m in height or less, measured from grade to the platform, and exclusive of any roof or railings) Rear Yard 3.7 metres In no case shall be less than 3.0 metres from the rear lot line Steps, Landings All Yards 2.0 metres beyond any structures referred to above 24.574.3.4 Daylighting or Site Triangles Notwithstanding any other provisions to the contrary, on a corner lot where a daylighting triangle has been conveyed to the Municipality, the Exterior Side Lot Line and the Front Lot Line shall be deemed to be the continued projection of the Exterior Side Lot Line and the Front Lot Line to a point of intersection, for the purposes of calculating the required minimum Front Yard and the required minimum Exterior Side Yard requirements. Notwithstanding the provisions above, and any other provisions to the contrary, no building or structure shall be permitted to encroach within the daylighting triangle. 24.574.3.5 Landscaping Requirements By-law Number 6728-25 Page 3 of 6 Notwithstanding any other provisions to the contrary, a minimum of 40.0% of the lot area shall be preserved in an open landscaped or natural condition. This 40.0% shall not include accessory buildings or structures, swimming pools or any other covered area with impervious material, but shall include decks, porches, terraces, or patios regardless of material. 24.574.3.6 Swimming Pools Notwithstanding the provisions of Section 4.12. a swimming pool may be located in any yard, provided it is set back a minimum of 1.2 metres from any Lot Line. A deck for an above ground pool shall be set back a minimum of 0.6 metres from any Lot Line.” 3. The Zoning By-law be and is hereby amended to add the following: “24.575 Detached Third Density Residential (R3) Exception Zone (575) Parent Zone: R3 Exception No.: 575 Map: 7 Previous Zone: ER Previous By-laws: 6000-17 Municipal Address: 252, 260, and 272 Old Bloomington Road Legal Description: Lot 6 and Part of Lot 7, Registered Plan 166 24.575.3 Zoning Requirements 24.575.3.1 Permitted Uses In accordance with Section 7.1.1 of Zoning By-law 6000-17 24.575.3.2 Building Standards Notwithstanding the provisions of Section 7.2, the following standards shall apply: Front Yard (minimum) 5.0 metres Interior Side Yard (minimum) 1.2 metres Rear Yard (minimum) 1.2 metres Exterior Yard (minimum) 3.0 metres Height (maximum) 12.0 metres Lot Coverage (maximum) 40% 24.575.3.3 Yard Encroachments Permitted Notwithstanding the provisions of Section 4.20, the structures listed in the following table shall be permitted to project into the minimum yards indicated for the distances specified: Structure or Feature Applicable Yard Maximum Encroachment into a Minimum Yard Covered or uncovered Front Yard 3.0 metres By-law Number 6728-25 Page 4 of 6 Porches and Terraces Side Yard Not less than 1.0 metres from a side lot line Covered or uncovered porches, uncovered terraces and decks (3.5 m in height or less, measured from grade to the platform, and exclusive of any roof or railings) Interior Side Yard 3.7 metres In no case shall be less than 1.2 metres from the rear lot line Steps, Landings All Yards except the Rear Yard 2.0 metres beyond any structures referred to above 24.575.3.4 Daylighting or Site Triangles Notwithstanding any other provisions to the contrary, on a corner lot where a daylighting triangle has been conveyed to the Municipality, the Exterior Side Lot Line and the Front Lot Line shall be deemed to be the continued projection of the Exterior Side Lot Line and the Front Lot Line to a point of intersection, for the purposes of calculating the required minimum Front Yard and the required minimum Exterior Side Yard requirements. Notwithstanding the provisions above, and any other provisions to the contrary, no building or structure shall be permitted to encroach within the daylighting triangle. 24.575.3.5 Landscaping Requirements Notwithstanding any other provisions to the contrary, a minimum of 40.0% of the lot area shall be preserved in an open landscaped or natural condition. This by-law shall come into full force subject to compliance with the provisions of the Planning Act and subject to compliance with such provisions, this by-law will take effect from the date of the Order. Pursuant to the Order of the Ontario Land Tribunal issued on the 23rd day of September, 2025, under OLT Lead Case No. OLT-24-001224. By-law Number 6728-25 Page 5 of 6 Explanatory Note Re: By-law Number 6728-25 By-law Number 6728-25 has the following purpose and effect: To amend By-law number 6000-17, as amended, being the Zoning By-law in effect in the Town of Aurora, By-law Number 6728-25 affects lands described as Lot 6 and Part of Lot 7, Registered Plan 166, and municipally known as 252, 260, and 272 Old Bloomington Road, in order to re-zone the lands from “Estate Residential (ER) Zone” to “Detached Third Density Residential (R3) Exception Zone (574)”, “Detached Third Density Residential (R3) Exception Zone (575)”, and “Oak Ridges Moraine Environmental Protection (EP-ORM) Zone”. The rezoning will permit a draft plan of subdivision of 30 residential lots, the extension of a new public right-of-way, the future extension of a public right-of-way to the adjacent lands to the east and west of the subject property, and the conveyance of a block of land containing environmental features and associated buffer area to public ownership.
