By-law - Assume highways on Plan 65M4433 for public use and maintenance - 20231024 - 6551-23The Corporation of the Town of Aurora By-law Number 6551-23 Being a By-law to assume highways on Plan 65M-4433 for public use and maintenance by The Corporation of the Town of Aurora. Whereas under subsection 31 (4) of the MunicipalAct, 2001, s.o. 2001, c. 25, as amended (the I€Act"), a municipality may by by-law assume the following highways for public use and section 44 of the Act does not apply to the highways until the municipality has passed the by-law: (1 ) an unopened road allowance made by the Crown surveyors; and (2) a road allowance, highway, street or lane shown on a registered plan of subdivision; And whereas The Corporation of the Town of Aurora (the "Town") entered into a Residential Subdivision Agreement with BrookfieJd Homes (Ontario) Aurora Limited (Phase 1), dated November 6, 2014, with respect to the lands contained within Plan 65M-4433, in relation to Town File No. D12-04-1 1 (the "Development"); And whereas the Council of the Town deems it necessary and expedient to assume certain highways within the Development for public use and be responsible to maintain those highways; Now therefore the Council of The Corporation of the Town of Aurora hereby enacts as follows: 1.The following highways in the Town of Aurora, Regional Municipality of York, be and are hereby assumed for public use and maintained by the Town: (a) William Graham Drive, Plan 65M-4433; (b) Hartwell Way, Plan 65M-4433; (c) Crane Street, Plan 65M-4433; (d) Roth Street, Plan 65M-4433; (e) Cobb Street, Plan 65M-4433; (f) Peter Miller Street, Plan 65M-4433; (g) Read Street, Plan 65M-4433; (h) Kashani Court, Plan 65M-4433; and (i) Boland Court, Plan 65M-4433.
