By-law - Establish land on Plans 65M2391, 65M2336, 65M2243 as a highway (File SUB-2015-01) - 20250923 - 6724-25The Corporation of the Town of Aurora By-law Number 6724-25 Being a By-law to establish land on Plan 65M-2391, Plan 65M-2336, and Plan 65M-2243 as a highway (File No. SUB-2015-01). Whereas under subsection 31 (2) of the Municipal Act, 2001, s.o. 2001, c. 25, as amended (the "Act"), after January 1, 2003, land may only become a highway by virtue of a by-law establishing the highway and not by the activities of the municipality or any other person in relation to the land, including the spending of public money; Whereas under subsection 31(3) of the Act, subsection 31(2) of the Act does not apply to highways described in paragraphs 3, 4 and 5 of section 26 of the Act, which includes: (3) all highways transferred to a municipality under the Public Transportation and Highway ImprovementAct; (4) all road allowances made by a Crown surveyor located in a municipality; or (5) all road allowances, highways, streets, or lanes shown on a registered plan of subdivision; And whereas The Corporation of the Town of Aurora (the l'Town") entered into a Residential Subdivision Agreement with Aurora (HGD) Inc., dated June 27, 2019, with respect to the lands contained within Plan 65M-4644 and Plan 65M-4645, in relation to Town File No. SUB-2015-01 (the 'lAgreement"); And whereas the Town acquired certain lands for reserve(s) (0.3 metre) on adjoining lands(s) to be established by by-law as highway(s) by the Town, as set out in Schedule "G" of the Agreement (the 'lReserves"); And whereas the Council of the Town deems it necessary and expedient to establish such Reserves as a highway; Now therefore the Council of The Corporation of the Town of Aurora hereby enacts as follows: 1. The following lands,in the Town of Aurora, Regional Municipality of York, be and are hereby established as a highway by the Town: a) Part of Block 29, Plan 65M-2391, designated as Part 1 on Plan 65R-41 538, forming part of Timberline Trail; b) Part of Block 30, Plan 65M-2391, designated as Part 2 on Plan 65R-41 538, forming part of Timberline Trail; c) Part of Block 69, Plan 65M-2336, designated as Part 1 on Plan 65R-41 557, forming part of Timberline Trail; and d) Block 11, Plan 65M-2243, forming part of Murray Drive and Kennedy Street West. 2.A copy of this by-law shall be registered against the lands in the proper land registry office. , Mayor Michael de Rond, Town Clerk
