Being a By-law to declare lands as surplus and complete land transfers
with respect to lands on 55 and 65 St. John's Sideroad East.
Whereas section 5(3) of the Municipal Act, 2001, s.o. 2001, c. 25, as amended (the
IlActl') states that a municipal power, including a municipality's capacity, rights, powers
and privileges under section 9 of the Act, shall be exercised by by-law unless the
municipality is specifically authorized to do otherwise;
And whereas The Corporation of the Town of Aurora (the 'lTownl') is the owner of lands
described as PT PCL 85-4, SEC W1 ; Part Lot 85, Concession 1, designated as Part 7 on
Reference Plan 65R-33504, Town of Aurora, being all of PIN 03641-3176 (LT) (the
l'Lands").
And whereas the Town reached a settlement with Medal Homes Inc. (l'Medal Homesl')
with respect to an application for the development of properties municipally known as
55 and 65 St. John's Sideroad East and which application was subsequently approved
by the Ontario Land Tribunal by order dated February 27, 2025, under Case Number OLT-
24-000252 (the I'OLT Order"), which OLT Order stipulated, as a condition of approval, the
transfer of the Lands to Medal Homes and a transfer of a portion of 65 St. John's
Sideroad East from Medal Homes to the Town (the 'lLand Transfers'l);
And whereas the Town does not require the Lands for municipal purposes and deems it
necessary to declare as surplus and sell the Lands.
Now therefore the Council of The Corporation of the Town of Aurora hereby enacts as
follows:
1.The Lands are hereby declared as surplus.
2. That no further notice is required to be provided with respect to the declaration
as surplus, the disposition of the Lands or the Land Transfers.
3.That the Land Transfers be completed.
