By-law - Assume highways on Plan 65M4644 for public use (File SUB-2015-01) - 20250923 - 672-25The Corporation of the Town of Aurora By-law Number 6723-25 Being a By-law to assume highways on Plan 65M-4644 for public use and maintenance by The Corporation of the Town of Aurora (File No. SUB- 2015-01). Whereas under subsection 31(4) of the Municipal Act, 2001, s.o. 2001, c. 25, as amended (the "Act"), a municipality may by by-law assume the following highways for public use and section 44 of the Act does not apply to the highways until the municipality has passed the by-law: (1 ) an unopened road allowance made by the Crown surveyors; and (2) a road allowance, highway, street or lane shown on a registered plan of subdivision; And whereas The Corporation of the Town of Aurora (the l'Town") entered into a Residential Subdivision Agreement with Aurora (HGD) Inc., dated June 27, 2019, with respect to the lands contained within Plan 65M-4644 and Plan 65M-4645, in relation to Town File No. SUB-201 5-01 (the "Agreement"); And whereas the Council of the Town deems it necessary and expedient to assume certain highway(s), as set out in Schedule "G" of the Agreement, for public use and maintenance; Now therefore the Council of The Corporation of the Town of Aurora hereby enacts as follows: 1. The following highways in the Town of Aurora, Regional Municipality of York, be and are hereby assumed for public use and maintenance by the Town: (a) Mathew Lepper Court, Plan 65M-4644; and (b) Klees Crescent, Plan 65M-4644.
