Call to Order 2. Land Acknowledgement We would like to start by acknowledging that the land on which we live and work is the traditional and treaty territory of the Anishinaabe, and many other Nations, whose presence here continues to this day. As a municipality, Aurora has shared responsibility for the stewardship of this land. We further acknowledge that Aurora is part of the treaty lands of the Mississaugas of the Credit, recognized through Treaty #13 as well as the Williams Treaties of 1923. A shared understanding of how the rich cultural heritage that has existed for centuries, and of how our collective past brought us to where we are today, will help us walk together into a better future. 3. Approval of the Agenda 2 Moved by Daniel Lajeunesse Seconded by David Mhango That the Agenda as circulated by the Secretary-Treasurer be approved. Carried 4. Declarations of Pecuniary Interest and General Nature Thereof There was a conflict of interest for application MV-2022-24 as a committee member, Daniel Lajeunesse, is running for the position of Ward 2 Councilor and the application is within the Ward 2. As a result, Daniel Lajeunesse did not participate in the deliberation/decision of this application. 5. Receipt of the Minutes 5.1 Committee of Adjustment Meeting Minutes of August 11, 2022, Meeting Number 22-08 Moved by David Mhango Seconded by Steven D'Angeli That the Committee of Adjustment Minutes from Meeting Number 22-08 be adopted as circulated. Carried 6. Presentation of Applications 6.1 MV-2022-13 - 2352107 Ontario Inc - 1588 St. John's Sdrd (Block 1) (*Application deferred at the request of the applicant) The applicant has requested that the application MV-2022-13 be deferred from the meeting Moved by Steven D'Angeli Seconded by Daniel Lajeunesse That the application be deferred to a future meeting. Carried 6.2 MV-2022-24- Montoni-Dinh - 51 Lensmith Drive 3 The owner/applicant is requesting relief from the requirements of the Town’s Comprehensive Zoning By-law 6000-17, as amended, to facilitate the proposal of a 2- storey addition to the existing detached house. The following relief is being requested: a. Section 4.20 of the Zoning By-law states that, steps shall not be closer than 4.5m from front lot line. The applicant is proposing front steps 3.74m from the front lot line. The Chair invited the Applicant or Owner to address the Committee. In attendance was the agent, Deborah Alexander. The agent provided a brief presentation of the Minor Variance Application in which was applied for. The Chair invited members of the public to provide comments. There were no live delegates present to provide comments. The Committee inquired if there was any attempt to reduce the encroachment of the steps to match the existing garage line. The committee also inquired if there will be any protection in place for the tree out front during the construction. Moved by Steven D'Angeli Seconded by David Mhango That the Minor Variance Application MV-2022-24 be APPROVED, subject to the conditions in Appendix “A” of the staff report. Carried 6.3 MV-2022-31 - Kudrati- 23 Glass Drive The owner/applicant is requesting relief from the requirements of the Town’s Comprehensive Zoning By-law 6000-17, as amended, relating to a carport. The following relief is being requested: a. Section 7.5.1.1 states the minimum setback of a carport, having no habitable rooms above and attached to a semi-detached dwelling can be 1m. The applicant is proposing to construct an attached carport which is 0.5m from side property line. The Chair invited the Applicant or Owner to address the Committee. In attendance was the owner and agent, Hatim Kudrati and Ehsan Jahani. 4 The agent provided a brief presentation of the Minor Variance Application in which was applied for. The Chair invited members of the public to provide comments. There were no live delegates present to provide comments. The Committee inquired about the project timeline and when the carport was built. The committee also inquired about the size of the carport and if the owner had conversations with the impacted neighbour. Moved by David Mhango Seconded by Steven D'Angeli That the Minor Variance Application MV-2022-31 be APPROVED, subject to the conditions in Appendix “A” of the staff report. Carried 6.4 MV-2022-34 - Hamill - 310 Ivy Jay Cres The applicant is requesting relief from the Town’s Comprehensive Zoning By-law 6000-17, as amended, to facilitate the development of a garage addition, a covered deck and an uncovered deck. The following relief from the requirements of the Town’s Zoning Bylaw 6000-17, as amended, is requested: a. Section 18.1.1 of the Zoning By-law requires a minimum rear yard setback of 22.0 metres. The applicant is proposing a garage addition, which is 18.6 metres to the rear yard property line. b. Section 18.1.2(i) of the Zoning By-law states uncovered decks and minor additions including open-sided roof porches may be permitted on legally existing residential lots provided they do not exceed 50.0 square metres on the ground floor and are located outside the key natural features and hydrologically sensitive features. The applicant is proposing to construct a garage addition, covered and uncovered deck. The Chair invited the Applicant or Owner to address the Committee. In attendance was the agent, Frank Rotundo. The agent provided a brief description of the Minor Variance Application in which was applied for. 5 The Chair invited members of the public to provide comments. There were no live delegates present to provide comments. The Committee inquired about the materials and the enclosure of the proposal. The Committee also inquired about the design and shape of the covered patio. Moved by David Mhango Seconded by Steven D'Angeli That the Minor Variance Application MV-2022-34 be APPROVED, subject to the conditions in Appendix “A” of the staff report. Carried 6.5 MV-2022-33 - Mou - 10 Bovair Trail The applicant is requesting relief from the Town’s Comprehensive Zoning By-law 6000-17, as amended, to facilitate the development of a garage addition, a covered deck and an uncovered deck. The Committee also inquired about the significant woodlots on the property and the required variances made on the subject property. Members also inquired about the use of 3 car garage addition.
