Call to Order 2. Land Acknowledgement The Town of Aurora acknowledges that the Anishinaabe lands on which we live and work are the traditional and treaty territory of the Chippewas of Georgina Island, as well as many other Nations whose presence here continues to this day. As the closest First Nation community to Aurora, we recognize the special relationship the Chippewas have with the lands and waters of this territory. They are the water protectors and environmental stewards of these lands, and as a municipality we join them in these responsibilities. We further acknowledge that Aurora is part of the treaty lands of the Mississaugas and Chippewas, recognized through Treaty #13 as well as the Williams Treaties of 1923. 2 A shared understanding of the rich cultural heritage that has existed for centuries, and how our collective past brought us to where we are today, will help us walk together into a better future. 3. Receipt of the Minutes 5.1 Committee of Adjustment Meeting Minutes of January 12, 2023, Meeting Number 23-01 Moved by Linda Duringer Seconded by Steven D'Angeli That the Committee of Adjustment Minutes from Meeting Number 23-01 be adopted as circulated. Carried 6. Presentation of Applications 6.1 C-2023-01 - 1623 Wellington Street Developments Limited - 1623 Wellington Street E The purpose of the proposed consent application is to sever 1.15 hectares (2.85 acres) of the subject property to facilitate the creation of one new lot along Wellington Street East. The new lot will have a frontage of 107.07 metres (344.73 feet) and is currently designated for employment and commercial purposes. Any future development on the subject lot will also be subject to future site plan application approval. Specific details of the consent are as follows (see Appendix ‘B’ and ‘C’): 3 1. Portion of Part 11 is retained while the remaining portion of Part 11 is to be severed as shown in the appendixes. The Chair invited the Applicant or Owner to address the Committee. In attendance was the applicants, Daniel Orellana and Daniel Zhang. The applicant gave a brief introduction and presentation to their application. The Chair invited members of the public to provide comments. There were no live delegates present to provide comments. The Committee provided comments in regards to the access, municipal servicing, traffic generation on site, and that the Ministry of Transportation Ontario had provided no objections to the proposed. Moved by Steven D'Angeli Seconded by Linda Duringer That the Consent Application C-2023-01 be APPROVED Carried 6.2 MV-2023-02 - Sedghi - 480 Stone Road The applicant is requesting relief from the requirements of the Town’s Comprehensive Zoning By-law 6000-17, as amended, to facilitate a sunroom addition to an existing single-storey detached dwelling. The proposed addition has a height of 2.7 metres (9 feet), and a gross floor area of 16.7 square metres (180 square feet). The sunroom addition is located at the rear portion of the property, but as a corner-lot it is subject to the exterior lot line variance. The following relief is being requested: 1. Section 24.142.1.2 of the Zoning By-law requires a minimum exterior side yard setback of 4.5 metres for the main building. The applicant is proposing an addition that is 3.02 metres from the exterior side lot line, thereby requiring a variance of 1.48 metres. The Chair invited the Applicant or Owner to address the Committee. In attendance was the owner, Kianoosh Sedghi. The owner gave a brief introduction and presentation to their application. The Chair invited members of the public to provide comments. There were no live delegates present to provide comments. 4 The Committee provided comments in regards to their concerns to trees on site, the depth of the foundation of the structure, and what was previously existing structure prior to the construction of the sun room. The committee also inquired if the owner is aware of the proposed conditions as provided by staff. Moved by David Mhango Seconded by Daniel Lajeunesse That the Minor Variance Application MV-2023-02 be APPROVED as amended. Carried as amended 6.3 MV-2023-01 Khalili - 17 Hawthorne Lane The applicant is requesting relief from the requirements of the Town’s Comprehensive Zoning By-law 6000-17, as amended, to facilitate the construction of a new two-storey single detached dwelling on an existing vacant lot. The applicant previously received minor variance approval from the Committee of Adjustment in October of 2017, but the approval has since expired, thereby requiring the applicant to re-apply. The following relief is being requested for the proposed two-storey detached dwelling: 1. Section 7.2 of the Zoning By-law requires a minimum front yard setback of 9.0 metres. The applicant is requesting a front yard setback of 8.7 metres, thereby requiring a variance of 0.3 metres. 2. Section 7.2 of the Zoning By-law requires a minimum interior side yard setback of 3.0 metres. The applicant is requesting an interior side yard setback of 2.3 metres (west side), thereby requiring a variance of 0.7 metres. 3. Section 7.2 of the Zoning By-law requires a minimum interior side yard setback of 3.0 metres. The applicant is requesting an interior side yard setback of 2.2 metres (east side), thereby requiring a variance of 0.8 metres. 4. Section 5.61(iii) of the Zoning By-law allows a maximum driveway width of 10.0 metres if the lot frontage is 18.0 metres or greater, with the exception that the maximum driveway at the street line 5 shall not exceed 6.0 metres. The applicant is requesting a driveway width of 7.0 metres at the street line, thereby requiring a variance of 1 metre. The Chair invited the Applicant or Owner to address the Committee. In attendance was the owners, Nicholas and Sara Khalili, and agent Peter Giordano. The agent gave a brief introduction and presentation to their application. The Chair invited members of the public to provide comments. There were no live delegates present to provide comments. The Committee began by asking the applicants if had seen the letters of support and oppositions submitted by residents of the community. The committee inquired to see if the applicants had any comments to provide regarding the communities' concerns. The committee also inquired about the design of the proposed dwelling, in specifically the bow window that caused the zoning infractions. Town staff was then called upon to confirm if the Zoning By-Law had in-fact been amended and passed since the owner's previous application dated October 2017. Staff has confirmed that on June 27th, 2017, Council has passed the currently enforced by-law 6000-17. Town staff was also asked to confirm proposed setbacks of previous application on the street to determine if the proposed dwelling is consistent with the neighbourhood. The Committee continued to inquire about the possible impacts of the proposed development to existing homes and trees.
