Procedural Notes This meeting was held electronically as per Section 19. i) of the Town's Procedure By-law No. 6228-19, as amended, due to the COVID-19 situation, and was live streamed on the Town's YouTube Channel. 2. Approval of the Agenda Moved by Daniel Lajeunesse Seconded by Steven D'Angeli That the Agenda as circulated by the Secretary-Treasurer be approved. Carried 3. Declarations of Pecuniary Interest and General Nature Thereof 2 There were no declarations of pecuniary interest under the Municipal Conflict of Interest Act. 4. Receipt of the Minutes 4.1 Committee of Adjustment Meeting Minutes of December 9, 2021 Meeting Number 21-12 Moved by Linda Duringer Seconded by David Mhango That the Committee of Adjustment Minutes from the Meeting Number 21- 12 be adopted as printed and circulated. Carried 5. Presentation of Applications 5.1 MV-2021-36 - Meyers - 152 Treegrove Circle The applicant is requesting relief from the Town’s Comprehensive Zoning By-law 6000-17, as amended, to permit an existing one-storey rear yard shed with a Gross Floor Area of approximately 144.0 ft² (13.40 m²). The following relief from the requirements of the Town’s Zoning By-law 6000- 17, as amended, is requested: a) Section 24.87.1.1 of the Zoning By-law requires a minimum interior side yard of 2.5 meters. The applicant has proposed 1.0 meter. The Chair invited the Applicant or Agent to address the Committee. In attendance was the Owner, Michael Meyers. The Owner provided a brief description of the Minor Variance Application in which was applied for. The Chair invited members of the public to provide comments. In attendance was Wes Vurma. The delegate provided comments regarding the Minor Variance Application in which was applied for. The Committee inquired about the conditions in the staff report as well as grading and drainage impacts on abutting properties. Through discussion with the Committee and the Applicant, the Committee amended the conditions of approval to accept drawings and reports as 3 deemed appropriate by the Town's Engineering Department prepared by a Qualified Professional. Moved by Steven D'Angeli Seconded by Daniel Lajeunesse 1. That the Minor Variance Application MV-2021-36 be APPROVED, subject to the amended conditions. Carried 5.2 MV-2021-01 - Popa - 91 Gilbank Drive The applicant is requesting relief from the Town’s Comprehensive Zoning By-law 6000-17, as amended, to accommodate an existing one-storey rear yard shed with a Gross Floor Area of approximately 54.0 ft² (5.0 m²). The following relief from the requirements of the Town’s Zoning By-law 6000- 17, as amended, is requested: a) Section 4.1.1 requires a minimum 1.0 m setback from the rear lot line for accessory structures. The applicant is proposing a storage shed with a 0.2 m setback from the rear property line. b) Section 7.2 requires a minimum 1.2 m side yard setback for accessory structures in the R3 (Detached Third Density Residential) Zone. The applicant is proposing a storage shed with a 0 m setback from the side property line. The Chair invited the Applicant or Agent to address the Committee. In attendance were the Owners, Melene and Lawrence Popa. The Owners provided a brief description and presentation of the Minor Variance Application in which was applied for. The Chair invited members of the public to provide comments. There were no live delegates present to provide comments. The Committee inquired about the impacts of the shed on abutting properties as well as grading and drainage impacts. The Committee also inquired about the age and condition of the existing shed and fencing on the property. 4 Through discussion with the Committee and the Applicant, the Committee amended the conditions of approval to accept drawings and reports as deemed appropriate by the Town's Engineering Department prepared by a Qualified Professional. Moved by Steven D'Angeli Seconded by Linda Duringer 1. That the Minor Variance Application MV-2021-01 be APPROVED, subject to the amended conditions. Carried 5.3 MV-2021-29 - Mody - 222 Ridge Road (*Application deferred at the request of Town Staff) The owner/applicant is requesting relief from the requirements of the Town’s Comprehensive Zoning By-law 6000-17, as amended, to facilitate the construction of a new single detached dwelling. The following relief is being requested: a) Section 14.1 states that no person shall use the land, including expanding, enlarging or otherwise altering an existing use, building or structure, for any reason other than a use legally existing as of Nov. 15, 2001, without amendment to, or relief from the Zoning By-law. The applicant is proposing to construct a two-storey detached dwelling. b) Section 14.4(i) states the net developable area of the site that is disturbed shall not exceed 25% of the total site area within a Category 1 Landform Conservation Area. The applicant is proposing a disturbed area of 34.3% c) Section 14.1.b of the Zoning By-law requires a minimum west interior side yard setback of 9.0m (30 feet). The applicant is proposing a two-storey detached dwelling, which is 2.7m to the west interior side property line. d) Section 14.1.b of the Zoning By-law requires a minimum east interior side yard setback of 4.5m (15 feet). The applicant is proposing a two-storey detached dwelling, which is 2.0m (7 feet) to the east interior side property line. 5 The applicant agreed in writing to defer the application to a future Committee of Adjustment meeting. That the Minor Variance Application MV-2021-29 be DEFERRED to a future Committee of Adjustment meeting Carried 5.4 MV-2021-20 - Dumitriu - 5 Child Drive The owner/applicant is requesting relief from the requirements of the Town’s Comprehensive Zoning By-law 6000-17, as amended, to facilitate a ground floor and 2nd storey addition to the existing dwelling. The following relief is being requested: a) Section 24.497.3.2 of the Zoning By-law requires a minimum interior side yard of 1.5 metres. The applicant is proposing a first and second storey addition, which is 1.2 meters to the interior side property line; b) Section 24.497.3.2 of the Zoning By-law requires a minimum interior side yard of 3.0m beyond the main rear wall of the adjacent dwelling. The applicant is proposing a first and second storey addition, which is 1.5 metres to the interior side property line. c) Section 24.497.3.2 of the Zoning By-law requires a minimum interior side yard of 3.0m (9.8 ft) beyond the main rear wall of the adjacent dwelling. The applicant is proposing an interior side yard setback of 2.4m (7.9 ft). The Chair invited the Applicant or Agent to address the Committee. In attendance were the owners, Val Dumitriu and Daniel Rosca, as well as the Applicant, Nick Racanelli. The Owners and Applicant provided a brief description of the Minor Variance Application in which was applied for. The Chair invited members of the public to provide comments. There were no live delegates present to provide comments. 6 The Committee inquired about the changes from the previous proposal, the impacts on abutting properties, and the efforts that are being taken to ensure sustainability. That the Minor Variance Application MV-2021-20 be APPROVED, subject to the conditions in Appendix "A" of the staff report. 5.5 MV-2021-21 - Loureiro - 26 Steeplechase Avenue The owner/applicant is requesting relief from the requirements of the Town’s Comprehensive Zoning By-law 6000-17, as amended, to construct a single detached dwelling, a cabana, a shed, and a swimming pool on the subject lands. The following relief is being requested: a) Section 14.1.2(ii) of the Zoning By-law states that no development or site alteration shall occur on that portion of said lot that is within the feature, without amendment to, or relief from the Zoning By-law. The applicant is proposing to construct a detached dwelling, cabana, shed and swimming pool on the subject property; b) Section 14.1.3(i) of the Zoning By-law states that no development or site alteration shall occur on that portion of said lot that contains a Minimum Vegetation Protection Zone, without amendment to, or relief from the Zoning By-law. The applicant is proposing to construct a detached dwelling, cabana, shed and swimming pool on the subject property; and, c) Section 14.1.4(i) of the Zoning By-law states that no development or site alteration shall occur on that portion of said lot that contains a significant woodland, without amendment to, or relief from the Zoning By-law. The applicant is proposing to construct a detached dwelling, cabana, shed and swimming pool on the subject property. The Chair invited the Applicant or Agent to address the Committee. In attendance was the Applicant and Agent, Murray Evans and Bryan Picard. The Applicant and Agent provided a brief description of the Minor Variance Application in which was applied for. 7 The Chair invited members of the public to provide comments. There were no live delegates present to provide comments. The Committee inquired about the Natural Heritage Evaluation and the impact of the proposal on the abutting woodlot. The Committee also inquired about the location of the driveway and the need for the removal of trees/replanting to accommodate for the driveway. Through discussion with the Committee and the Applicant, the Committee amended the conditions of approval, requesting that Condition #1 be revised via text-circulation to Committee members at a future date, and that the wording in Condition #3 be amended from "may" to "shall".
