Approval of the Agenda Moved by David Mhango Seconded by Steven D'Angeli That the Agenda as circulated by the Secretary-Treasurer be approved. 2 Carried 3. Declarations of Pecuniary Interest and General Nature Thereof There were no declarations of pecuniary interest under the Municipal Conflict of Interest Act. 4. Receipt of the Minutes 4.1 Committee of Adjustment Meeting Minutes of March 11, 2021, Meeting Number 21-03 Moved by Michele Boyer Seconded by Steven D'Angeli That the Committee of Adjustment Minutes from the Meeting Number 21- 03 be adopted as printed and circulated. Carried 5. Presentation of Applications 5.1 C-2021-07 - Whitwell Developments Inc. - 40 First Commerce Drive The applicant is seeking provisional consent to establish a lease for a period of time exceeding twenty-one (21) years on the subject property. The Chair invited the Applicant or Agent to address the Committee. In attendance was the applicant, Raphael Romeral from Dillon Consulting Ltd. The applicant provided a brief description of the Consent Application in which was applied for. The Chair invited members of the public to provide comments. There were no live delegates present to provide comments. Moved by Steven D'Angeli Seconded by Daniel Lajeunesse 1. That the Consent Application C-2021-07 be APPROVED, subject to the conditions in Appendix “A” of the staff report. Carried 5.2 C-2021-08 - 36 Victoria Aurora Inc. - 36 Victoria Street 3 The purpose of the proposed consent application is to sever a portion of the subject lands to facilitate a lot addition for the abutting property at 16 Mosley Street. The applicant is requesting provisional consent to: a) Sever a portion of 36 Victoria Street (Part 2) to be added to 16 Mosley Street (Part 3). The Chair invited the Applicant or Agent to address the Committee. In attendance was the Applicant Claudio Balbinot. The applicant provided a brief description of the Consent Application in which was applied for. The Chair invited members of the public to provide comments. That the Consent Application C-2021-08 be APPROVED, subject to the conditions in Appendix “A” of the staff report. Carried 5.3 MV-2020-25 - Ahmad - 45 Steeplechase Avenue The owner is requesting relief from the requirements of the Town’s Comprehensive Zoning By-law 6000-17, as amended, to permit the development of a detached garage, and two building additions to the existing two-storey single detached dwelling. The following relief is being requested: a) Section 14.1.2(ii) of the Zoning By-law states that no development or site alteration shall occur on that portion of said lot that is within a Key Natural Heritage Feature (KNHF), without an amendment to, or relief from the Zoning By-law. The applicant is proposing to construct two (2) two-storey additions and a detached garage on the lot; b) Section 14.1.3(i) of the Zoning By-law states that no development or site alteration shall occur on that portion of said lot that contains a Minimum Vegetation Protection Zone (MVPZ), without an amendment to, or relief from the Zoning 4 By-law. The applicant is proposing to construct two (2) two- storey additions and a detached garage on the lot; and, c) Section 14.1.4(i) of the Zoning By-law states that no development or site alteration shall occur on that portion of said lot that contains a Significant Woodland, without an amendment to, or relief from the Zoning By-law. The applicant is proposing to construct two (2) two-storey additions and a detached garage on the lot. The Chair invited the Applicant or Agent to address the Committee. In attendance was the owners Farid and Kim Ahmad, and the applicant Mike Frenette. The Chair invited members of the public to provide comments. There were no live delegates present to provide comments. The Committee confirmed with the owners that the proposed works will be within the disturbed area of the property. Moved by David Mhango Seconded by Linda Duringer 1. That the Minor Variance Application MV-2020-25 be APPROVED, subject to the conditions in Appendix “A” of the staff report. Carried 5.4 MV-2021-08 - Zheng - 6 Aurora Heights Drive The owner/applicant is requesting relief from the requirements of the Town’s Comprehensive Zoning By-law 6000-17, as amended, to facilitate the development of a two (2) storey detached dwelling. The following relief is being requested: a) Section 24.497.3.2 of the Zoning By-law requires a minimum interior side yard setback of 3.0 metres beyond the main rear wall of the adjacent dwelling. The applicant is proposing an interior side yard setback of 1.5 metres; b) Section 497.3.2 of the Zoning By-law requires a minimum interior side yard setback of 3.0 metres beyond the main rear 5 wall of the adjacent dwelling. The applicant is proposing an interior side yard setback of 1.6 metres; c) Section 24.497.3.3 of the Zoning By-law permits a maximum lot coverage of 35.0%. The applicant is proposing a lot coverage of 35.4%; and d) Section 24.497.3.3 of the Zoning By-law permits a maximum gross floor area of 370.0 square metres. The applicant is proposing a gross floor area of 387.4 square metres. The Chair invited the Applicant or Agent to address the Committee. In attendance was the owner Wenqi Zheng. The owner provided a brief description of the Minor Variance Application in which was applied for. The Chair invited members of the public to provide comments. There were no live delegates present to provide comments. The Committee inquired whether the owner was aware of the Stable Neighbourhood Study, if the proposal is compatible, and if it fits within the existing neighbourhood in terms of scale. The Committee further inquired about the existing and proposed grading of the property, and how the owner intends on providing adequate space for swale(s), if required. Moved by Steven D'Angeli Seconded by David Mhango 1. That the Minor Variance Application MV-2021-08 be DENIED. Carried 6.
