Procedural Notes This meeting was held electronically as per Section 19. i) of the Town's Procedure By-law No. 6228-19, as amended, due to the COVID-19 situation. This meeting was live streamed at https://www.youtube.com/c/Townofaurora/videos. 2. Approval of the Agenda Moved by Daniel Lajeunesse Seconded by Steven D'Angeli That the Agenda as circulated by the Secretary-Treasurer be approved. 2 Carried 3. Declarations of Pecuniary Interest and General Nature Thereof There were no declarations of pecuniary interest under the Municipal Conflict of Interest Act. 4. Receipt of the Minutes 4.1 Committee of Adjustment Meeting Minutes of May 13, 2021, Meeting Number 21-05 Moved by Steven D'Angeli Seconded by Linda Duringer That the Committee of Adjustment Minutes from the Meeting Number 21- 05 be adopted as printed and circulated. Carried 5. Presentation of Applications 5.1 MV-2021-11 – Bruno – 20 Spruce Street The owner/applicant is requesting relief from the requirements of the Town’s Comprehensive Zoning By-law 6000-17, as amended, to facilitate the construction of an attached garage to an existing dwelling. The following relief is being requested: a) Section 7.2 of the Zoning By-law requires a minimum interior side yard setback of 1.2 m for one storey building. The applicant is proposing a one-storey garage addition with a south side yard setback of 0.6 m. The Chair invited the Applicant or Agent to address the Committee. In attendance was the owner Robert Bruno. The owner provided a brief description of the Minor Variance Application in which was applied for. The Chair invited members of the public to provide comments. There were no live delegates present to provide comments. The Committee inquired about the heritage permit status and the location of the garage and its potential impacts on the neighbouring property. 3 Moved by Steven D'Angeli Seconded by David Mhango 1. That the Minor Variance Application MV-2021-11 be APPROVED. Carried 5.2 MV-2021-12 – Kirchmair – 3 Wellington Heights Court The owner/applicant is requesting relief from the requirements of the Town’s Comprehensive Zoning By-law 6000-17, as amended, to permit outdoor swimming lessons as a Home Occupation on the subject property, municipally known as 3 Wellington Heights Court. The following relief is being requested: a) Section 3 (Definitions) defines Land Uses and Home Occupations, and does not include ‘Outdoor Swimming Lessons’. b) Section 4.6.1 requires that Home Occupations (where permitted by the By-law) be conducted entirely within the dwelling or permitted accessory buildings. The applicant is requesting a Home Occupation be permitted outdoors for the purpose of conducting outdoor swimming lessons. The Chair invited the Applicant or Agent to address the Committee. In attendance was the owners Carey, George, and Ryland Kirchmair. The owners provided a brief description of the Minor Variance Application in which was applied for. The Chair invited members of the public to provide comments. There were no live delegates present to provide comments. The Committee inquired about the potential liability and parking concerns. Moved by Daniel Lajeunesse Seconded by Michele Boyer 1. That the Minor Variance Application MV-2021-12 be APPROVED, subject to the conditions in Appendix “A” of the staff report. Carried 4 5.3 MV-2021-13 – St. Andrew’s College – 15900 Yonge Street The owner/applicant is requesting relief from the requirements of the Town’s Comprehensive Zoning By-law 6000-17, as amended, to permit a private school use in an existing building on the property. The following relief of the Town’s Zoning By-law 6000-17, as amended, is requested: a) To permit a “School, Private” whereas, the use is not a listed permitted use in the EP (97) zone The Chair invited the Applicant or Agent to address the Committee. In attendance was the applicants Rohan Sovig, Lincoln Lo, and Beth Carter. The applicants provided a brief description of the Minor Variance Application in which was applied for. The Chair invited members of the public to provide comments. There were no live delegates present to provide comments. The Committee inquired about potential boarding facilities, access and traffic concerns, and the parking requirements. The Committee amended the second condition of approval to include "and all issues indicated in the staff report". Moved by David Mhango Seconded by Linda Duringer Carried 6.
