Procedural Notes This meeting was held electronically as per Section 19. i) of the Town's Procedure By-law No. 6228-19, as amended, due to the COVID-19 situation. This meeting was live streamed at https://www.youtube.com/user/Townofaurora2012/videos. 2. Approval of the Agenda Moved by Michele Boyer Seconded by Daniel Lajeunesse That the Agenda as circulated by the Secretary-Treasurer be approved. Carried 2 3. Declarations of Pecuniary Interest and General Nature Thereof There were no declarations of pecuniary interest under the Municipal Conflict of Interest Act. 4. Receipt of the Minutes 4.1 Committee of Adjustment Meeting Minutes of February 11, 2020, Meeting Number 21-02 Moved by Steven D'Angeli Seconded by Michele Boyer That the Committee of Adjustment Minutes from the Meeting Number 21- 02 be adopted as printed and circulated. Carried 5. Presentation of Applications The Committee considered Item 5.2 prior to Item 5.1. 5.1 MV-2021-07 - Walker - 26 Machell Avenue The owner is requesting the following relief from the Town’s Zoning By- law 6000-17, as amended, to facilitate the construction of a new foundation for an existing dwelling within the same footprint: • Section 4.4.2 of the Zoning By-law requires a building or structure erected prior to the date of the passing of the By-law, having less than the minimum yard requirement for the zone where it is located, may be repaired or renovated, provided the repair or renovation complies with the provisions of the By-law. The applicant is proposing to rebuild the foundation wall at the existing non-compliant location of the building. • Section 7.2 of the Zoning By-law requires a minimum front yard setback of 6 m for single detached dwelling. The applicant is proposing a 0 m front yard setback. • Section 7.2 of the Zoning By-law requires a minimum interior side yard setback of 1.5 m for a two-storey building. The applicant is proposing a 0 m south side yard setback. 3 • Section 4.20 of the Zoning By-law does not allow any encroachments into interior side yard for decks. The applicant is proposing a wood frame deck with a south side yard setback of 0.7 m. • Section 4.20 of the Zoning By-law requires steps and landing to maintain minimum 0.3 m from interior side lot line. The applicant is proposing new stairs and landing with a 0 m north side yard setback. The Chair invited the Applicant or Agent to address the Committee. In attendance was the owner Hugh Walker. The owner provided a brief description of the Minor Variance Application in which was applied for. The Chair invited members of the public to provide comments. There were no live delegates present to provide comments. The Committee clarified whether to owner will comply with Section 4.0. The owner agreed. Moved by Michele Boyer Seconded by Steven D'Angeli That the Minor Variance Application MV-2021-07 applications (a),(b), (c), and (d) be APPROVED, and (e) be DENIED, subject to the conditions in Appendix “A” of the staff report. Carried 5.2 MV-2020-23 - Esrafili - 60 Fairway Drive The owner is requesting the following relief from the Town’s Zoning By- law 6000-17, as amended, to permit the construction of a two-storey single detached dwelling: • Section 24.497.3.3 of the Zoning By-law permits a maximum footprint of 235 m2. The applicant is proposing a detached dwelling with a footprint of 247.6 m2. • Section 24.497.3.3 of the Zoning By-law permits a maximum gross floor area of 370 m2. The applicant tis proposing a detached dwelling with a gross floor area of 484.3 m2. The Chair invited the Applicant or Agent to address the Committee. In attendance was the applicant, Frank D' Amico. The applicant provided a 4 brief description of the Minor Variance Application in which was applied for. The Chair invited members of the public to provide comments. There were no live delegates present to provide comments. The Committee inquired how the proposal complies with the Stable Neighbourhoods provisions, the obstacles/ limitations for the owner to comply with the provisions in place, and expressed their concerns about the storm sewers on the property. Further, the Committee inquired to the definitions of first storey, average height of two-storey home, and additional by-law requirements to staff, who provided the definitions from the Town of Aurora's Zoning By-law 6000-17, as amended. Moved by Steven D'Angeli Seconded by Daniel Lajeunesse That the Minor Variance Application MV-2020-23 be DENIED. Carried 6. New Business The Chair welcomed David Mhango and Linda Duringer to the Committee of Adjustment. 7. Adjournment Moved by Daniel Lajeunesse That the meeting be adjourned at 8:47 PM.
