THAT Council for the Corporation of the Town of Aurora authorize a 2004
Interim Tax Levy on all rateable real property in the Town, which has been
assessed according to the last revised assessment roll; and
THAT the 2004 Interim Tax Levy be set at 50% of the total 2003 taxes
payable on each property; and
THAT for new properties added to the assessment roll for the 2004
taxation year, the tax rates would be equivalent to 50% of the 2003 tax

the stated Current Value Assessment; and

THAT Council authorize staff to enter final negotiations with Vadim
Computer Management Group Limited for the supply, delivery and
installation of Financial Information Systems for the Corporation of the
Town of Aurora.
THAT Council authorize staff to enter final negotiations with RAC Software
Inc. for the supply, delivery and installation of Financial Manager's
Workbench, Capital and Salary Forecasting Software for the Corporation
of the Town of Aurora.
THAT, subject to satisfactory negotiation of final terms and conditions,
staff present to Council for approval the final Agreements for the Town to
purchase:
✓ Core Financial Information Systems and Services from Vadim
Computer Management Group Limited, and
✓ Financial Manager's Workbench, Capital and Salary Forecasting
Software from RAC Software Inc.
THAT the project implementation plan, as outlined within this staff report,
be phased in over the fiscal 2004 and 2005 periods with Phase 1 targeted
for implementation in the fourth quarter of 2004 and Phase 2 targeted for
implementation starting January 1, 2005.
THAT funding for this multi -phase Financial Information Systems and
Services project be approved in accordance with the capital project details
outlined herein.
THAT Council authorize staff to solicit proposals from qualified financial
system implementation specialists to facilitate the role of project manager
in accordance with the Town's procurement policies and procedures.

prohibtions of parking on mcleod drive.
concern I have Is that the parking restriction should be carried north on mcleod drive from 64 to 72, east and west
side of the street, not just
as noted on figure #1 sent to us by the town, showing the parking stopping at 104 and 57 mcleod drive.
presently vehicles using aurora heights dr. take a short cut south on mcleod, please note that many children cross
at the north entry of gllbank
across mdeod the go to school and to the comer store.there is also a day care centre located on the north side of
57 mcleod dr. also note that when you are at the stop sign coming off of gllbank onto mcleod dr. and there are
cars parked on the road, it obstructs your view of vehicles
entering mcleod drive off of aurora heights, which are already traveling at a high speed.
i recommend that a amendment be made to the proposed prohibitions of parking on mcleod drive to include the
above concern and extend the perking prohibition up to aurora heightsand or delay the passing of this by-law
until a more Indepth study is completed by the traffic safety advisory board regarding the above,
i been living in aurora for the past 15 years and living on mcloed for the past 9 years, so i am fully aware of the
local traffic problem we face on our street.

BACKGROUND
Section 317 of the Municipal Act, 2001 as amended authorizes the Council of a local
municipality, to pass a by-law before the adoption of the estimates for the year, to levy a
separate tax rate on the assessment in each property tax class in the municipality.
The amount levied on a property shall not exceed the prescribed percentage, or 50% if no
percentage is prescribed, of the total amount of taxes for municipal and education

purposes levied on the property for the previous year. The percentage may be different for
different property classes but shall be the same for all properties in a property class.
For the purpose of calculating the total amount of taxes for the previous year, if any taxes
for municipal and education purposes were levied on a property for only part of the year
because assessment was added to the collectors roll during the year, an amount shall be
added equal to the additional taxes that would have been levied on the property if the taxes
for municipal and education purposes had been levied for the entire year.
COMMENT
It has been the procedure in the past to set the interim tax billing rates at the maximum
allowed. The interim tax rate was calculated based on 50% of the tax rates used for the
prior year and the interim property tax bills were based on these rates multiplied by the
current value assessment (CVA). For the taxation year 2004, the CVA's were amended
under reassessment to reflect values as at June 30, 2003. As a result of the changes to
CVA, the traditional method of calculating the interim tax billing could result in interim tax
bills being produced that were more than 50% of the prior years taxes.
Bill 140, The Continued Protection for Property Taxpayers Act, 2000 mandates
municipalities to issue 2004 Interim Tax Billings based on 50% of the 2003 taxes levied on
a per property basis. The Town's 2004 Interim Property Tax Bill will comply with the intent
of Bill 140. In addition, Bill 140 provides for the continuance of specific treatments for
Commercial, Industrial and Multi -Residential properties. These classes of property are
subject to a 5% cap over the 2003 taxes levied
Consistent with prior year's interim tax levies, it is recommended that the 2004 Interim Tax
Levy be due in two instalments as follows:
First Installment Monday, February 23, 2004
Second Installment Monday, April 26, 2004
The 2004 Interim billing for all property classes is being scheduled for preparation and
mailing the week of January 19, 2004, thereby providing the mandatory minimum
requirement of 21-calendar day's notice. It should be noted the Director of Finance may
find it necessary to make adjustments to the billing process should further regulations or
new legislation be introduced following the approval of this report and related by-law.

CONCLUSIONS

The timely issuance of interim tax bills ensures the necessary cash flow to meet the
financial obligations of the Town and allows taxpayers in all the property classes to
distribute the tax liability over a greater period of time.
EFFECT ON TOWN FINANCES:
The timing of the property tax billing has a significant impact on cash flows for the Town of
Aurora. It is important that the Interim Tax Billing be issued during the first 60 days of the
new year in order to maintain revenue streams that coincide with the timing of incurring
general and capital operating costs and the Town's legislated payments by the end of
March to the Boards of Education.

THE CORPORATION OF THE TOWN OF AURORA
By-law Number 4484-04.F
BEING A BY-LAW to levy an
Interim Property Tax Rate
for the taxation year 2004.
WHEREAS Section 317 of the MunicipalAct, 2001 as amended authorizes the Council of a
local municipality to pass a by-law before the adoption of the estimates for the year, to levy
a separate tax rate on the assessment in each property tax class in the municipality;
AND WHEREAS the municipal Council of the Corporation of the Town of Aurora has not
adopted estimates for the year 2004:
AND WHEREAS the municipal Council of the Corporation of the Town of Aurora wishes to
impose an Interim Property Tax Levy as authorized by Section 317 of the Municipal Act,
2001 as amended;
NOW THEREFORE THE MUNICIPAL COUNCIL OF THE CORPORATION OF THE
TOWN OF AURORA ENACTS AS FOLLOWS:
1. THAT the Council of the Corporation of the Town of Aurora is hereby authorized to levy
in 2004 on the whole assessment of all taxable assessed property according to the last
revised assessment roll, the sum required to produce an amount not exceeding fifty
percent (50%) of the 2003 taxes levied for each property.
THAT for new properties added to the last revised assessment roll, the said interim
property tax rates for 2004 for each of the property tax classes are calculated at 50% of
the year 2003 property tax rates as summarized within Appendix "A" (attached hereto).

3. THAT the Director of Finance/Treasurer of the Corporation of the Town of Aurora be
authorized to amend in whole or in part any billing issued under this by-law to comply
with any provincial legislation which may be introduced by the Province of Ontario prior
to or after the issuance of the interim billing.
4. THAT for the purposes of calculating the total 2003 taxes as noted in paragraph 2, if
any taxes were levied in 2003 for only part of the year because assessment was added
to the assessment roll during 2003, an amount shall be added equal to the additional
taxes that would have been levied if the taxes had been levied for the entire year.
5. THAT taxes may be levied under this by-law on a property that is rateable for 2004,
even if the property was not rateable for 2003, including assessment of property that is
added to the assessment roll after the by-law is passed.
6. THAT the said interim tax levy shall become due and payable in two installments as
follows:
First Installment Monday, February 23, 2004
Second Installment Monday, April 26, 2004
7. THAT on all taxes which remain unpaid on the due date, a penalty of one and one
quarter per cent (1 1/4% per month) (15 % per annum) of the taxes remaining unpaid
shall be levied on the first day of each calendar month thereafter in which the default
continues until December 31, 2004.
8. THAT on all taxes levied pursuant to this by-law remaining unpaid as at December 31,
2004, interest at the rate of one and one quarter per cent (1 1 /4%)(15% per annum) of
the unpaid taxes shall be levied from December 31, 2004 and for eachmonth or
fraction thereof until such taxes are paid.
9. THAT penalties and interest added on all taxes of the interim tax levy in default shall
become due and payable and shall be collected forthwith as if the same had originally
been imposed and formed part of such unpaid interim tax levy.
10.THAT all taxes payable under Tax Payment.Plans, shall be due and payable on the last
business day of each calendar month, starting in January and continuing until
September in the year 2004.
11.THAT the Director of Finance/Treasurer of the Corporation of the Town of Aurora be
authorized to extend the Tax Payment Plan beyond September 2004, should the need
arise.
12.THAT the Director of Finance/Treasurer of the Corporation for the Town of Aurora mail

or cause to be mailed to the residence or place of business of such person indicated on
the last revised assessment roll a written or printed notice specifying the amount of
taxes payable.
13.THAT the Director of Finance/Treasurer of the Corporation for the Town of Aurora be
authorized to adjust the billing schedule. and tax rate set out herewith, if required, in
order to comply with Provincial legislation or regulations which may be received
subsequent to the passing of this bylaw.
14.THAT the provisions of this By-law shall come into force and take effect upon third
reading thereof.

THAT By-law 4496-04.F be enacted at the January 13, 2004 Council meeting.
BACKGROUND
Council last reviewed and revised the Town of Aurora Fees and Services Charges on
November 19, 2002. It has been the Town's practice to review the attached schedules
annually and to make revisions as required. Approved Fee and Services increases will be
reflected in the second draft of the 2004 Operating Budget.
Staff considers CPI (Consumer Price Index) increases; rates charged by neighbouring
municipalities and cost increases/decreases when recommending changes to fees and
services. A summary of the Department fees and services proposals follows.
COMMENTS
These comments will refer only to the by-law in question that will cover the administrative
fees for the Corporation as a whole. Some of the fees and services noted in the attached
schedules are covered under other by-laws that pertain to specific parts of the Municipal
Act, such as building permits and planning applications.

Administration
No changes. Fees and Services Charges were adjusted for 2003 and remain viable.
Corporate Services
No changes.
Treasury
The charge for Tender documents has been added in 2004. This charge has been in
effect but had not been included previously in the Fees and Services Charge listing. The
charge is to help recover the cost of printing the tender documents and various maps for
distribution to bidders.
Building Department
No material changes proposed at this time. Some fees based on the recovery of costs
were increased in 2003 to reflect operational costs and the minimum basic application fee
and are still valid.
Public Works
WIMS/SIMS maps and drawing fees are new service categories for 2004. Blue bins fees
have increased to reflect their actual cost.
Leisure Services
The Leisure Department Report LS03-045 addresses the amendments to the fees and
services under By-law #4448-03.F. The attached schedule has been updated to reflect
these changes.
Planning
Fees and services have increased by 3% overall to reflect cost in living indices. A recent
survey of other municipalities in York Region indicates that Aurora's fees equate or exceed
those of the other municipalities surveyed.

CONCLUSIONS
The increases proposed primarily reflect actual cost recovery increases and a 3%
inflationary indexing for the Planning Fees. The overall change in administrative fees
corporate wide is minimal.
FINANCIAL IMPLICATIONS
The present affect of the proposed 2004 fees and service charges on corporate revenues
is minimal, as most of the changes merely offset cost increases. The fees and service
charges unchanged for 2004 remain competitive with surrounding municipalities.
LINK TO STRATEGIC PLAN
Goal "A" — To Maintain a Well Managed and Fiscally Responsible Municipality. The
objective stated is to: "Formally adopt a user pay philosophy and examine processes
where consumers of a service pay an equitable proportion of the cost of operating it."

THAT, subject to a satisfactory review by the Site Plan Committee, the Director of
Planning be authorised to execute a site plan agreement between 1268264 Ontario
Inc, and the Town of Aurora, respecting the construction of a four -storey building
with ten (10) residential dwellings units and an office commercial use on the ground
floor.
BACKGROUND
Location/Land Use:
The subject lands are located at 14961 Yonge Street and identified legally as Lot 176, Plan
246, as illustrated on the attached Figure 1. The subject site is located at Yonge Street
and Cousins Drive and has a total lot area of 889.20 mZ (0.22 acres) and a frontage of
17.83 m (58.5 ft.) along Yonge Street.

Official Plan:
The subject lands are designated "Community Commercial Centre" in the Official Plan and
are located within the "Heritage Resource Area." This designation allows for the
development of the site for residential dwelling units above the ground floor and an office
commercial use on the ground floor.
The proposed residential dwelling units and commercial use is therefore in keeping with the
Official Plan.
Zoning By-law:
The lands are zoned "Central Commercial (C2) Zone", which permits business and
professional offices and dwelling units above the first floor. The applicant received
approval from the Committee of Adjustment under file D13-5-03, to permit the residential
portion of a non-residential building in a Commercial Zone to exceed 50 percent (%) of the
total of the total floor area. Therefore, the proposal conforms to the By-law.
PROPOSAL
Site Plan:
As illustrated on Figure 2, the applicant is proposing to construct a 1,561.23 m2 (16,805.50
sq. ft.) four -storey building with office commercial use on the ground floor and a total of ten
(10) dwelling units on the remaining three floors. The ground floor is 224. 50 m2 (2411.19
sq. ft.), which comprises of an office use of 109.00 m2 (1173.30 sq.ft.) as well as the
building entrance, electrical room, sprinkler room, elevator machine room and elevator.
The second and third floors have four residential units per floor, and each floor is 418 m2
(4499.46 sq. ft.) in size. The residential units range in size from 86 m2 (925.7 sq. ft.) to
145 m2 (1560.8 sq. ft.). The forth floor is a total of 174 m2 (1872.9 sq. ft.) in size and has
two units, one 75 m2 (807 sq. ft.) and 72 m2 (775.02 sq. ft.) for the other.
The site will contain two vehicular entrances off of Cousins Drive, one for residents and the
other to be used by visitors. The site will contain 19 parking spaces, including 4 for the
office use and 15 parking spaces for the residential units. The resident parking will be
covered parking spaces (with residential units above), and the visitor parking will be located
behind the building. Pedestrian access will be -via the sidewalk and entrances are at the
front and corner of the building. These entrances are for both residents and users of the
ground floor office. A resident entrance is also located at the rear of the building.

As illustrated on Figure 2, honey locusts are located along Cousins Drive, and trees are
proposed along the rear property line. A wood fence is also proposed along the rear
property line. A fence is proposed on the northeast corner of the property to screen the
hydro transformer and the garbage enclosure.
Building Elevations:
As illustrated on Figure 3, the proposed building will have varied wall treatment and
cladding with mixed finishing materials including artificial stone at the ground level, clay
brick at the upper levels and a continuous stucco band with moldings and a design pattern
at both the third and fourth floor roof lines. The building is covered by a flat roof with the
exception of the southwest area, where a small ornamental roof is proposed to emphasize
the corner and give an additional decorative element to the building structure. At the
September 8th, 2003 LACAC Meeting, the proposed building design was approved. At the
October 10th, 2003 Meeting the brick colour (cashmere colour) and window treatment (light
bronze colour) were approved. The site plan application was also reviewed and given
preliminary approval by the Town's controlling architect.
OPTIONS
The application could proceed with a report to Council, following a detailed review by the
;Site Plan Committee, for approval and authorization for the Mayor and Clerk to execute the
agreements. Alternatively, in accordance with Council policy, the Director of Planning
:;could be delegated authority to execute the agreements on behalf of the Municipality.
Given the Applicant's desire to proceed expeditiously, Staff are able to deal with the site
plan through the delegation process.
CONCLUSIONS
The subject application can be dealt with most expeditiously at the Staff level. In addition,
the applicant is looking to obtain building permits and begin construction this spring.
Accordingly, it is recommended that the matter be delegated to the Director of Planning to
execute a site plan agreement between 1268264 Ontario Limited and the Town of Aurora,
respecting the construction of a four -storey building with ten (10) residential dwellings units
and an office commercial use on the ground floor.
