By-law - Assume highways on Plan 65M4467 for public use and maintenance - 20240326 - 6594-24The Corporation of the Town of Aurora By-law Number 6594-24 Being a By-law to assume highways on Plan 65M-4467 for public use and maintenance by The Corporation of the Town of Aurora. Whereas under subsection 31 (4) of the Municipal Act, 2001, S.O. 2001, c . 25, as amended (the "Act"), a municipality may by by-law assume the following highways for public use and section 44 of the Act does not apply to the highways until the municipality has passed the by-law: (1) an unopened road allowance made by the Crown surveyors; and (2) a road allowance, highway, street or lane shown on a registered plan of subdivision; And whereas The Corporation of the Town of Aurora (the 'Town") entered into a Residential Subdivision Agreement with Brookfield Homes (Ontario) Aurora Limited (Phase 2), dated September 8, 2015, with respect to the lands contained within Plan 65M-4467, in relation to Town File No. SUB -2011-04 (the "Agreement"); And whereas the Council of the Town deems it necessary and expedient to assume certain highways, as set out in Schedule "G" of the Agreement, for public use and maintenance; Now therefore the Council of The Corporation of the Town of Aurora hereby enacts as follows: 1. The following highways in the Town of Aurora, Regional Municipality of York, be and are hereby assumed for public use and maintenance by the Town: (a) Radial Drive, Plan 65M-4467; (b) Capreol Avenue, Plan 65M-4467; (c) Durblee Avenue, Plan 65M-4467; (ct) Sparks Street, Plan 65M-4467; and (e) Towns Lane, Plan 65M-4467.
