BYLAW - Establish land on Plan 65R39324 as highway (extension of Goulding Ave) - 20230627 - 6525-23The Corporation of the Town of Aurora By-law Number 6525-23 Being a By-law to establish land on Plan 65R-39324 as a highway (extension of Goulding Avenue). Whereas under subsection 31(2) of the MunicipalAct, 2001, s.o. 2001, c. 25, as amended (the 'lAct"), after January 1, 2003, land may only become a highway by virtue of a by-law establishing the highway and not by the activities of the municipality or any other person in relation to the land, including the spending of public money; Whereas under subsection 31 (3) of the Act, subsection 31 (2) of the Act does not apply to highways described in paragraphs 3, 4 and 5 of section 26 of the Act, which includes: (3) all highways transferred to a municipality under the Public Transportation and Highway ImprovementAct; (4) all road allowances made by a Crown surveyor located in a municipality; or (5) all road allowances, highways, streets, or lanes shown on a registered plan of subdivision; And whereas The Corporation of the Town of Aurora (the 'lTown") entered into a Development Agreement with 1623 Wellington Street Developments Limited, dated October 21, 2020, with respect to the design, construction, and dedication of the extension of Goulding Avenue, in relation to Town File No. C-2020-01 (the "Agreementl'); And whereas the Council of the Town deems it necessary and expedient to establish the extension of Goulding Avenue as a highway and name it Goulding Avenue, as set out in the Agreement; Now therefore the Council of The Corporation of the Town of Aurora hereby enacts as follows: 1. The following lands in the Town of Aurora, Regional Municipality of York, be and are hereby established as a highway by the Town: a) Part Lot 20, Concession 3, Whitchurch, designated as Part 1 on Plan 65R- 39324, forming part of Goulding Avenue (the "Lands"). 2.A copy of this by-law shall be registered against the Lands in the proper land registry office. 3.
