Dear Madam,
We represent All Season Homes with respect to land use matters for their property located at 14476 Yonge
Street, hereinafter referred to as the subject site. The subject site is located at the very northern part of the
Block F plan area, bound to the north by the CN Railway and directly across (on the west side of Yonge Street)
from Industrial Parkway South. With respect to the proposed block plan, we have reviewed the plan and
have some concern with respect to the nature of the development proposed on the subject site. Namely, we
have the following concerns:
1. Environmental Designation – In review of the proposed block plan the subject site is being proposed
with an Environmental Protection Area Policy. Preliminary environmental work on the subject site
by the Biologist retained by All Season Homes has identified a large area of the subject site as not
warranting an environmental designation due to the nature of tree species located along the
frontage of the subject site, extending toward the middle of the site. We have attached a copy of
the report prepared by Blythe and Associates, dated 18 October, 2011 which discusses this in more
detail.
We object to the designation of the whole of our client’s lands as Environmental Protection Area.
We respectfully request at the very least the block plan acknowledge that portions of the subject
lands are feasible for development from an environmental standpoint and not attribute the
Environmental Protection Area designation on these portions of the subject site that do not
warrant this designation.
2. Access – It has been noted that the block plan does not provide internal circulation access to the
subject lands. OPA 34 discusses that 2 access points will be provided to the Block F lands. The staff
planning report does briefly discuss that York Region has indicated that subject to exhaustive analysis
regarding access points within the block plan, the Region would consider providing more than 2
access points for lands within the Block F plan. The subject site is located at the intersection of
Yonge Street and Industrial Parkway South so conceivably access to the subject site could be via an
entrance at this existing controlled intersection.

We respectfully request that an acknowledgement be made by the Town with regard to
access to the subject site. This could be either via an interconnected road to the rest of the
Block F lands or through a separate access point to the subject site.
3. Notification – On February 14th, 2011, our office submitted a letter to the Town of Aurora requesting
notification as this application proceeds through the development approvals process (letter
attached). Our office did not receive notification of the public meeting for this application, dated
October 26th, 2011. We obtained notification of this public meeting through the property owner.
We expect that this was an error in the notification as this is the first public meeting on the
referenced application, but we would like to be included in future notifications of this development
as it proceeds through the approvals process.

All Season Homes intends to develop a portion of the lot owned
by them at 14476 Yonge Street. This lot is designated as
woodlands in the Town of Aurora Zoning Bylaw 2213‐78. Upon
site inspection, the majority of the frontage of the subject site
contains a scots pine plantation which does not warrant the
significant woodlands designation which it is currently
attributed. This report discusses the nature of the tree species
on site and recommends removal of the woodlands designation
in part.

All Season Homes Inc. is planning to develop a portion of the lands owned by them at 14476
Yonge St.— Part of Lot 75 Concession 1, Town of Aurora. The property is 1.374 ha (3.395
ac) in area. It is designated under the Town of Aurora’s OPA as “cluster residential”. It has
also been designated under the Oak Ridges Moraine Conservation Plan (ORMCP) as a
“significant woodland”. This latter designation prohibits any development on the property
and has been incorporated into the policy documents of the Town of Aurora.
All Season Homes Inc. is disputing, in part, the significant woodland designation and has
retained the planning team of: LARKIN + Associates Planning Consultants Inc. and Blythe
and Associates Field Biology Services. It is the opinion of the planning team that a
significant portion of the 1.374 ha property does not warrant this ORMCP environmental
constraint and is suitable for development. We are requesting the Lake Simcoe Conservation
Authority (LSRCA) assist us in delineating the significant woodlands area.. This is the area
that is separate from the Scots pine plantation which is located on site and is discussed in
more detail below.
The property is vegetated with a mid-successional forest comprised of indigenous and non-
indigenous species. At its widest point, the subject property is dominated by a large raised
knoll. This prominent terrain feature is heavily vegetated with Scots pine (Pinus sylvestris).
It is, in effect, an abandoned Christmas tree plantation, or erosion protection forest. The
approximate area of this knoll is 0.6 ha. It is located immediately west of the property’s
Yonge St. frontage (Attachment 1 Map). The remainder of the property is either sloped or
low-lying lands and sustains a deciduous forest comprised of indigenous and non-indigenous
species.
The rationale for the removal of the significant woodland designation is linked to the
presence of the Scots pine plantation. This species is an invasive, non-native tree and its
abundance on the 0.6 ha portion of the subject property is sufficient grounds to have the
significant woodland designation removed.
According to the ORMCP Technical Paper # 7, Identification and Protection of Significant
Woodlands, the definition of a woodland is:
“woodland” means treed area, woodlot or forested area, other than a cultivated fruit or
nut orchard or a plantation established for the purpose of producing Christmas trees;"
(pg. 2, Section 4)
This statement limits the definition of woodland by exempting Christmas tree plantations and
orchards. It can be readily applied to the 0.6 ha knoll area on the subject property that is an
abandoned Scots pine plantation. According to the attached tree inventory (Attachment 2),
there are 553 Scots pine in this area — approximately 58 % of the 944 living trees
inventoried on the entire subject property. The largest Scots pine — approximately 10 m in
height — are planted in rows and are, for the most part, confined to the knoll feature. These
trees appear to be between 40 to 50 years of age. The rows of trees are periodically
interrupted with gaps where the trees have either been removed, or have succumbed to
disease. The understory of the Scots pine stand is dominated by Scots pine regeneration.
These young Scots pine have also spread to the surrounding sloped lands of the knoll outside
of the original pine plantation. The Scots pine regeneration varies in sizes from seedlings to 5
m tall trees.
Scots pine were introduced into Ontario in the 1920’s by the Department of Lands and
Forests— now Ministry of Natural Resources (MNR) — to reclaim poor-quality farmland
soils which were abandoned and being eroded by wind and water. During the next 30 years,

the species was widely planted as erosion protection forests. Following the second world
war, the tree became popular as a Christmas tree and many thousands of hectares of private
land were planted as Christmas tree farms. The market for Christmas trees was flooded with
Scots pine and many of these plantations were allowed to grow past their marketable size.
Since the Scots pine has little or no, timber or fibre value, the plantations were subsequently
abandoned.
Technical Paper # 7 goes on to further define a plantation as:
“ “Plantation" means a treed community in which the majority of trees have been
planted or the majority of the basal area is in trees that have been planted, often
characterized by regularly spaced rows. With time and forest management, natural
regeneration can become established and eventually convert the community to natural
forest.”
This statement adds the qualifier that a plantation may, through time and natural forest
succession, become naturalized and may qualify as a natural forest. This seems to imply that
some plantations or orchards may become a candidate for a significant woodland
designation.
The Scots pine plantation on the subject property shows no signs of becoming a natural forest
since the Scots pine dominate the plantation’s understory. Scots pine are highly prolific seed
producers and aggressively invade surrounding lands where there is sufficient understory
sunlight penetration. This is clearly the situation on the subject property and the Scots pine
have spread outward beyond the original plantation and are invading the remainder of the
deciduous forest.
On pages 3 and 4, Section 5, Identification of Significant Woodlands, Technical Paper # 7
provides more guidance to the forest evaluator in terms of what is, and is not, a significant
woodland. In particular it again emphasizes that plantations and orchards should not be
considered as significant woodlands. It also adds the proviso that forest communities which
are dominated by invasive species should also be exempt from the significant woodland
designation.
“Exceptions
Notwithstanding the above, significant woodlands do not include:
a plantation managed for production of fruits, nuts, Christmas trees or nursery stock; or
a plantation managed for tree products with an average rotation of less than 20 years
(e.g. hybrid poplar or willow); or
a plantation established and continuously managed for the sole purpose of complete
removal at rotation, as demonstrated with documentation acceptable to the planning
authority or the Ministry of Natural Resources, without a forest restoration objective.
Additional exclusions may be considered for communities which are dominated by the
invasive non-native tree species buckthorn (Rhamnus species) or Norway maple (Acer
platanoides) that threaten good forestry practices and environmental management. Such
exceptions may be considered where native tree species cover less than 10% of the ground
and are represented by less than 100 stems of any size per hectare.”
In addition, on page 6, Table 1 of Technical Paper # 7 there is a list of acceptable native tree
species that are to be used to define significant woodlands. Not only are the aforementioned
buckthorn and Norway maple excluded from this list, but so is Scots pine.

Although Scots pine is not specifically mentioned as an invasive species, it is considered to
be as such by the MNR. In its Landowner Resource Centre Extension Notes series, provided
to landowners, MNR recommends that landowners work toward removing Scots pine
plantations because the species is invasive and has little or no commercial value and has the
potential to invade other forested areas where sufficient sunlight is available.

In addition, there is some concern that Scots pine plantations may serve as the initial hosts
for a newly invading Eurasian pine pest that threatens Canada’s valuable native pine species.
In the early 1990’s some Scots pine plantations were found to harbour the pine shoot beetle
(Tomicus piniperda). Although the pine shoot beetle prefers to infest Scots pine, it is thought
that this species will also move to native Ontario pine species in the absence of Scots pine.
The MNR and the Canada Food Inspection Agency are currently conducting a quarantine
program to limit the spread of the pine shoot beetle by cutting and incinerating the trees from
any infected Scots pine plantations. Although there is no indication the pine shoot beetle is
present on the subject property, the potential exists that it could become infected and spread
the pest into other pine species on the subject property and beyond.

In summation, it is our opinion that owing to the presence of an abandoned Scots pine
plantation on a large part of the All Season Homes property, it does not qualify as a
significant woodland.
It is our understanding that the LSRCA provides the Town of Aurora’s planners with
expertise in environmental matters. In order to resolve this issue, we would suggest an on-
site meeting be scheduled with our planning team and the appropriate conservation authority
staff to conduct a preliminary survey of the boundaries of the Scots pine plantation. This
would then allow All Seasons Homes to bring forward a conceptual plan for the site’s
development taking into account the various other environmental and planning constraints
such as the minimum vegetation protection zones for the remainder of the property’s
deciduous woodlot.
