Procedural Notes This meeting was held electronically as per Section 19. i) of the Town's Procedure By-law No. 6228-19, as amended, due to the COVID-19 situation. This meeting will be live streamed at https://www.youtube.com/user/Townofaurora2012/videos. 2. Approval of the Agenda Moved by Clarence Lui Seconded by Michele Boyer That the Agenda as circulated by the Secretary-Treasurer be approved. Carried 2 3. Declarations of Pecuniary Interest and General Nature Thereof 4. Receipt of the Minutes 4.1 Committee of Adjustment Meeting Minutes of November 12, 2020, Meeting Number 20-08 Moved by Steven D'Angeli Seconded by Daniel Lajeunesse That the Committee of Adjustment Minutes from the Meeting Number 20- 08 be adopted as printed and circulated. Carried 5. Presentation of Applications 5.1 MV-2020-24 – Yu & Zhou – 152 William Graham Drive The applicant is requesting the following relief from the Town’s Comprehensive Zoning By-law 6000-17, as amended, to permit a reduced rear yard setback for a newly proposed one-storey addition: • Section 24.408.2.2 allows a minimum rear yard of 7.0 metres for additions. The applicant is proposing a one-storey sunroom addition with a rear yard setback of 4.5 metres. The Chair invited the Applicant or Agent to address the Committee. In attendance was the applicant, Matt Jacewicz. The applicant provided a brief description of the Minor Variance Application in which was applied for. The Chair invited members of the public to provide comments. There were no live delegates present to provide comments. The Committee inquired about potential privacy concerns with the location of the sunroom. The applicant provided further clarification in addressing the privacy issues through examples of existing sunrooms. Moved by Daniel Lajeunesse Seconded by Michele Boyer 1. That the Minor Variance Application MV-2020-24 be APPROVED, subject to the conditions in Appendix “A” of the staff report. 3 Carried 5.2 MV-2020-10 – Hollidge Properties Inc. – 108-170 Hollidge Blvd The owner is requesting relief from the requirements of the Town of Aurora Comprehensive Zoning By-law 6000-17, as amended, to permit a “Restaurant” use on the subject lands. • Section 24.187.1 permits a “Maximum of one restaurant, drive-thru special”. The applicant is proposing a “Restaurant” as a permitted use. MV-2020-10 was considered at the June 18, 2020 Committee of Adjustment meeting. At this meeting, Committee passed a motion to defer the subject application to a future meeting date to facilitate further discussion with area residents and Town Staff. The Chair invited the Applicant or Agent to address the Committee. In attendance were the applicants Julian De Gasperis and Daniel Frustaglio. The applicant provided a brief presentation regarding the updates for the application. The Chair invited members of the public to provide comments. In attendance was the President of the Baywell Community Ratepayers Association, Randy Henderson. The delegate provided an update since the previous meeting, the preparation of the Memorandum of Understanding, and future concerns. The Committee inquired about how the Memorandum of Understanding may be enforced and included as part of the decision. Staff stated that if the Committee were to approve the application, that it would be contingent to the conditions, and that the MOU is noted on file but the Town does not have a mechanism to enforce it. The Committee further inquired to the applicants if they had been approached by tenants for uses that are already permitted in the Zoning By-law. The applicants stated that the permission is for the potential of the restaurant uses that align with the MOU and fit the community, but also welcome other uses. Additionally, the Committee discussed the options of including a temporal component as a condition with the applicant and Baywell Community Ratepayers Association. 4 Moved by Tom Plamondon Seconded by Steven D'Angeli That the Minor Variance Application MV-2020-10 be DENIED.
