AGENDA ITEM # I TOWN OF AURORA PUBLIC PLANNING REPORT No. PL04-050 SUBJECT: Official Plan Amendment Application MI Developments Inc. Part of Lot 20, Concession 11 File Number D09-01-04 FROM: Sue Seibert, Director of Planning DATE: April 28, 2004 RECOMMENDATION THAT Report PL04-050 be received as information and that Council determine their position with respect to the application, subject to public comments received. BACKGROUND This report is an addendum to Public Planning Report No. PL04-032, which was before Council at the March 24, 2004 meeting and should be read in conjunction with that report. The application is for an official plan amendment which would delete a portion of the designated east -west collector road, located south of Wellington Street along the southern boundary of the "Mixed Use" and "Business Park" designations, and redesignate the lands to the underlying "Mixed Use" and "Business Park" designations. The need for the amendment arose as a result of a proposed site plan for the subject lands for a medical facility, the approval of which would prevent a portion of the designated east -west collector road from being constructed. At the previous public meeting, Council resolved to adjourn the application until the April 28, 2004 meeting. This was at the request of the applicant for the purpose of allowing the Region time to provide their comments. The Region has not provided their comments at this time, however it is our understanding that we will have them prior to the public meeting for Council's consideration. OPTIONS Should Council determine there is merit the subject application, they have the option of directing Staff to bring the draft official plan amendment forward to a Council meeting for adoption. As discussed at the previous public meeting, the applicant has requested that the official plan amendment be adopted by Council tonight, should Council wish to grant the applicant their request, the official plan amendment has been drafted and is attached to this report as Appendix 1. Finally, Council also has the option of referring the application to a further public meeting if they feel it is necessary or they have the option of denying the application outright. PUBLIC PLANNING APRIL 28 2004 -1- April 28, 2004 - 2 - Report No. PL04-050 CONCLUSION An application has been submitted for an Official Plan Amendment, which would delete a portion of the designated east -west collector road, located south of Wellington Street along the southern boundary of the "Mixed Use" and "Business Park" designations, and redesignate the lands to the underlying "Mixed Use" and "Business Park" designations. Should Council determine there is merit in the subject application, it is recommended that the Official Plan Amendment be adopted at either tonight's meeting or a subsequent Council meeting, subject to public comments received and receiving comments from the Region. FINANCIAL IMPLICATIONS Not applicable. LINK TO STRATEGIC PLAN The Strategic Plan contains objectives to ensure high quality, comprehensive community planning to protect the overall investment of citizens in the community. Critical review of the subject application through the OPA process facilitates this objective. It is for explanatory purposes only and does not form part of the Amendment. 2.0 PURPOSE The purpose of this amendment is to change the land use designation on the subject lands shown on Schedule "A", attached hereto and forming part of this amendment from a designated collector road to the underlying "Mixed Use" and "Business Park" designations. 3.0 LOCATION The subject lands affected by this amendment are located within the Town of Aurora, and are described as Part of Lot 20, Concession II. 4.0 BASIS OF THE AMENDMENT Council has enacted this amendment in response to the following: 4.1 An official plan amendment application has been submitted by MI Developments Inc. order to delete a portion of the designated east -west collector road, located south of Wellington Street along the southern boundary of the "Mixed Use" and "Business Park" designations, and redesignate the lands to the underlying "Mixed Use" and "Business Park" designations. 4.2 The need for the amendment arose as a result of a proposed site plan for the subject lands for a medical facility, the approval of which would prevent a portion of the designated east -west collector road from being constructed. 4.3 The deletion of a portion of the east -west collector road re -enforces the need for the implementation of the portion of the collector road system linking Bayview Avenue to Wellington Street in order to maximize accessibility to the abutting lands without compromising traffic operations of the intersection. PUBLIC PLANNING APRIL 28 2004 —8— PART 2 - THE AMENDMENT Page 2 1.0 INTRODUCTION All of this part of the document entitled Part 2 - The Amendment, consisting of the following text and attached map, designated Schedule "A" (Land Use Plan), constitutes Amendment No. 52 to the Official Plan for the Town of Aurora. 2.0 DETAILS OF THE AMENDMENT The Official Plan of the Town of Aurora is hereby amended as follows: Item (1): Schedule "AA" - Land Use Plan, being part of Official Plan Amendment No. 30, is hereby amended by deleting a portion of the designated east - west collector road, located south of Wellington Street along the southern boundary of the "Mixed Use" and 'Business Park' designations, and redesignating the lands to the underlying "Mixed Use" and 'Business Park' designations, as shown on Schedule "A" attached hereto and forming part of this Amendment. Item (2): That Section 3.10.1 (Transportation: Roads and Circulation) of Official Plan Amendment No. 30, is hereby amended by deleting the contents of Section "3.10.1.m." and replacing it with the following: • The Town recognizes that the deletion of a portion of the designated east -west collector road, located south of Wellington Street along the southern boundary of the "Mixed Use" and 'Business Park' designations, re -enforces the need for the implementation of the portion of the collector road system linking Bayview Avenue to Wellington Street in order to maximize accessibility to the abutting lands without compromising traffic operations of the intersection. The Town shall therefore require the construction of this collector road link in concert with the development of the abutting lands. 3.0 IMPLEMENTATION AND INTERPRETATION 3.1 The implementation and interpretation of this Amendment shall be in accordance with the respective policies of the Aurora Official Plan, Zoning By- law and Site Plan Agreements.
